Recommendation: Adoption of Ordinance No. 2004 - 2 2 amending the current language to reflect the increase in required automatic fire protection systems in certain multi-family residential units from 5 to read 3 or more, with language addressing an effective date. Background Summary: The reason for the requested change is that it will • include the 3 and 4 unit buildings in subdivision plans, increasing fire protection and reducing any confusion by emergency responders to decide whether a building has automatic fire protection (fire sprinklers) or not. Fiscal Impacts: Minor construction cost increases to developers and builders. Parker, District 4 STAFF REPORT TO: The Honorable Mayor and City Commissioners FROM: Richard Firstner, Assistant Fire Chiea DATE: August 25, 2004 RE: Ordinance No. 2004 - 2 2 ISSUE Amend section 78-14 of Article II of Chapter 78 of the Code of Ordinances of the City of Ocoee relating to fire prevention; requiring automatic fire protection systems for certain multi-family residential units comprised of three or more dwelling units. BACKGROUND/DISCUSSION By increasing the requirement from the existing 5 units or more to 3 units or more the fire protection will be increased for the entire sub development, and decrease the confusion on the part of emergency responders as to what units are protected with fire sprinklers or not. RECOMMENDATION Approve the amended ordinance increasing the requirement from 5 or more units to 3 or more units, with the addition of language establishing an effective date. ORDINANCE NO. 2004-22 AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA AMENDING SECTION 78-14 OF ARTICLE II OF CHAPTER 78 OF THE CODE OF ORDINANCES OF THE CITY OF OCOEE RELATING TO FIRE PREVENTION; REQUIRING AUTOMATIC FIRE PROTECTION SYSTEMS FOR CERTAIN MULTI-FAMILY RESIDENTIAL UNITS COMPRISED OF THREE OR MORE DWELLING UNITS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authority. The City Commission of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Amendment of Section 75-14. Section 78-14 of Article II of Chapter 78 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended to read as follows (with deletions stricken and additions underlined): § 78-14. Multifamily residential units. Multifamily residential units comprised of five-three or more dwelling units, regardless of square footage or number of stories, shall require automatic fire protection systems; provided how_ever_ that—the__for egoing_shalLnot_apply_tQ_multi-family_residential units consisting of 3 or__4._d.welling units_which_have_received a proval__nf_a_final _ •.-- •.. . , � . _. •_A • _ SECTION 3. Severahility. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of 006.345675.1 competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 4. Codification. It is the intention of the City Commission of the City that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City; and that sections of this Ordinance may be renumbered or relettered and the word "ordinance" may be changed to "chapter," "section," "article," or such other appropriate word or phrase in order to accomplish such intentions; and regardless of whether such inclusion in the Code is accomplished, sections of this Ordinance may be renumbered or relettered and the correction of typographical errors which do not affect the intent may be authorized by the City Manager, without need of public hearing, by filing a corrected or recodified copy of same with the City Clerk.
