Pursuant to the attached memorandum and after meeting with Acting Police Chief Tony Wilson, it is our recommendation that you continue the current ordinance that is in effect to date. Rosenthal, City Attorney PA DATE: April 1, 1994 RE: Ordinance No. 93-04 Relating to Abandoned Shopping Carts Ordinance No. 93-04 relating to abandoned shopping carts was adopted by the City Commission on April 20, 1993 pursuant to a motion to review the Ordinance in one year to determine its suitability at that time. Accordingly, this matter should be agenda'd for review by the City Commission. This Ordinance will continue in effect until expressly repealed by an ordinance adopted by the Ocoee City Commission. Our review of the minutes of the April 20, 1993 meeting reveals that the following options were discussed: 1. Continue the ordinance in effect as adopted. 2. Repeal the ordinance after a determination of the Board of City Commissioners that the ordinance was no longer necessary. 3. Repeal the ordinance based upon an Agreement by local grocery stores to provide several carts and a coral to areas which traditionally contained abandoned shopping carts, which carts would be retrieved at the store owner's expense from time to time. 4. Repeal the ordinance based upon an agreement by the neighboring store owners that the people who need a shopping cart could check one out from the store and keep it at home. 5. Revise the Ordinance to impose a fine on the persons who take the carts instead of the storeowners. Please note that when the City Commission reaches agreement on an alternative, we will prepare the necessary ordinance or other documentation, if any, needed to effectuate their decision. In the event no action is taken, the Ordinance will remain in effect. /jh -2-
