Recommendation:
Staff recommends approval of Change Order# 1 to Contract B04-07 to Gibbs&Register, Inc.,
for the amount of$16,025.00
Background Summary:
The design of the existing water main and distribution system was relatively unknown due to the
age of the system. Modification to the design of the main and distribution system became
necessary as described in the attached Change Order form.
Fiscal Impacts:
The additional $16,025 is available from the Water R&R Funds. The balance of the Water R&
R.Funds is estimated at$515,000 after this expenditure.

RE: McKey Street Project Change Order# 1
ISSUE
Approval of Change Order# 1 for the amount of$16,025 for Gibbs&Register, Inc., for
modifications to the water main and distribution system.
BACKGROUND/DISCUSSION
Contract B04-07 was awarded to Gibbs&Register on June 15, 2004,which included the
replacement of the existing 6" water main on McKey Street. The details of the existing water
main and distribution system were relatively unknown at the time of the design due to the age of
the system. As the south side of the McKey Street was excavated, it became apparent that
modification to the design of the main and distribution system as necessary. A Change Order
Form and detail breakdown of the items are attached to this report.
The additional $16,025 is available from the Water R&R Funds. The balance of the R&R
Funds is estimated at$515,000 after this expenditure.
RECOMMENDATION
Staff respectfully recommends City Commission approve Change Order# 1 for the amount of
$16,025 from the Water R&R Funds; and authorize the Mayor and Clerk to execute the Change
Order.

CHANGES ORDERED:
I. GENERAL
This change order is necessary to cover changes in the work to be performed under this Contract. The
GENERAL CONDITION,SUPPLEMENTARY CONDITIONS, SPECIFICATIONS and all parts of the
Project Manual listed in Article 1,Definitions,of the GENERAL CONDITIONS apply to and govern all
work under this change order.
II. REQUIRED CHANGES
Modify the water main design and the connections to the existing water main at Bluford Avenue,provide service
connections to customers along McKey Street,provide 4"extension for future use on McKey Street,and extend and
terminate distribution line on Cumberland Avenue,north of McKey Street.
III. JUSTIFICATION
The original design included the replacement of the existing 6"water main on McKey Street. The details of the
existing water main and distnbution system were relatively unknown at the time of the design due to the age of the
system. As the south side of the McKey Street was excavated,it became apparent that modification to the design of
the main and distribution system was necessary.Also,to serve the future needs,

VI. APPROVAL AND CHANGE AUTHORIZATION
This proposed change to the Contract is to be approved by the Ocoee City Commission.
Acknowledgements:
The aforementioned change,and work affected thereby,is subject to all provisions of the original contract not
specifically changed by this Change Order;and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original
contract other than matters expressly provided herein.
CONTRACTOR acknowledges,by its execution and acceptance of this Change Order,that the adjustments in
Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs and
modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other
claim for increased costs of performance or modifications of time will be granted by the OWNER for the Work
covered by this Change Order. The CONTRACTOR hereby waives and releases any further claims for cost or time
against the OWNER arising from or relating to the matters or Work set forth or contemplated by this Change Order.
