Background Summary: The proposed Shoppes of Ocoee will be a restaurant/retail commercial establishment, located in the commercial designated portion (Lot "Q") of the Ocoee Commons PUD. Specifically, the site is located on the north side of W. Colonial Drive (SR 50) just east of Blackwood Avenue adjacent to the existing West Orange Professional Center. This one-story commercial building consists of a total 33,938 square feet of floor area of which a portion (+/-11,326 square feet) will be allocated for potential restaurant space. Issue: Adjoining PUD infrastructure is presently being constructed under the Ocoee Commons Final Subdivision Plan, which was approved by the City Commission on April 6, 2004. However, it should also be noted that the Ocoee Commons PUD "Plaf' has not yet been formally approved. Recommendations: Based on the recommendation of the DRC and the Planning & Zoning Commission, Staff respectfully recommends that the Mayor and City Commissioners approve the Preliminary/Final Site Plan for Shoppes of Ocoee, as date stamped received by the City on December 27, 2004, subject to Approval of the Waiver pertaining to minimum size of parking spaces, and Approval, Execution and Recording of the Ocoee Commons PUD "Plat." BACKGROUNOIDISCUSSION: The proposed Shoppes of Ocoee will be a restaurant/retail commercial establishment, located in the commercial designated portion (Lot "Q") of the Ocoee Commons PUD. Specifically, the site is located on the north side of W. Colonial Drive (SR 50) just east of Blackwood Ayenue, on a +/- 4.859 acres lot adjacent to the existing West Orange Professional Center. This one-story commercial building consists of a total 33,938 square feet of floor area of which a portion (+/- 11,326 square feet) will be allocated for potential restaurant space. The structure itself will incorporate a 51.8+/- feet high clock tower design with outdoor sitting areas for patron use. Adjoining PUD infrastructure is presently being constructed under the Ocoee Commons Final Subdivision Plan, which was approved by the City Commission on April 6, 2004. However, it should also be noted that the Ocoee Commons PUD "Plaf' has not yet been formally approved. The surrounding properties to the south and east of the subject site are improved with institutional (Health Central Hospital) and commercial (West Orange Professional Center) land use. The rest of the surrounding properties to the north ("Crestwood Commons" townhomes) and west (future bank site) of the subject site are part of the Ocoee Commons PUD. There are no wetlands on the site and the site is outside the 100-year floodplain. Several existing oak trees are scheduled to be preserved along the west and south property lines. These trees will be credited toward meeting the landscape requirements. The subject site will have primary access from W. Colonial Drive and secondary access from Blackwood Avenue through the internal Ocoee Commons PUD road network. In order to facilitate direct pedestrian connection from the northern "Crestwood Commons" townhomes, a 5 feet wide walkway with landscaping will be provided on Tract "P." Additionally, required landscape buffers will be proYided on the west and east portion of Tract "P." January 4,2005 Honorable Mayor and City COmmissioners Page 2 The Future Land Use designation for the site is Commercial. The property is zoned "PUD" Planned Unit Development which permits development and construction of the proposed land use. Therefore, the requested use is consistent with directives of the Comprehensive Plan. The proposed Shoppes of Ocoee Preliminary/Final Site Plan meets the requirements of the Land Development Code (LDC) with the exception of Art. VI, Sec. 6-4, H, (1) of which waiver is currently being requested. The applicant is requesting a waiver from Art. VI, Sec. 6-4, H, (1), which requires that minimum size parking spaces to be 9 feet wide by 20 feet deep. The purpose for the waiver is to preserve existing specimen trees and increase the available green area around the base of those trees within the parking lot area. Therefore, the applicant is formally requesting a relaxed standard from the LDC whereby certain parking spaces will only be 18 feet deep. In addition, the developer is proposing to provide 24 feet aisle width with wheel stops to separate and define the parking areas. Wheel stops are also proposed to protect sidewalk areas within the development. Staff supports this waiver in order to insure the survival of certain specimen trees and to ensure that the applicant provides the total number of parking spaces required. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on November 18, 2004 and reviewed the Shoppes of Ocoee Preliminary/Final Site Plan. There were seyeral technical issues to be addressed from the City Attorney, Planning, and Engineering that were identified in written staff comments and presented verbally. All of the issues were discussed and a few minor changes to the Plan were agreed upon. The applicants were made aware of the following issues: 1. A building permit will not be issued until the Ocoee Commons "Plaf' has been properly approved, executed and recorded. 2. A building permit can be secured with the understanding that a Certificate of Occupancy (C.O.) will not be issued until certain infrastructure of Ocoee Commons PUD is constructed resulting in an issuance of a Certificate of Completion. When the discussion was finished, the DRC voted unanimously to recommend approval of the Preliminary/Final Site Plan, subject to the developer making changes specified in the reports and incorporating the waiver request into the proposal as discussed. These changes were made and shown on the plans date stamped "Receiyed December 9, 2004." However, there were additional minor deficiencies, which needed to be addressed before the City Commission formal site plan approyal. Staff's additional comments were: 1. Site Data Table needs to reflect the actual handicapped and standard parking spaces provided. 2. Ensure that all roof-mounted equipment is screened completely from yiew. 3. Provide an acceptable lighting plan that meets code. 4. Ensure that the lighting program is consistent with the rest of the Dcoee Commons PUD commercial development. PLANNING AND ZONING COMMISSION RECOMMENDATION: On December 14, 2004, the Planning & Zoning Commission held a publiC hearing to consider the proposed Preliminary/Final Site Plan for Shoppes of Ocoee. The City Staff and the Developer of the project answered questions regarding clock tower design, outdoor sitting areas, proposed bicycle racks, and the locations of the reduce length parking spaces. There was no one from the publiC to speak regarding this request. After finishing its deliberations, the January 4, 2005 Honorable Mayor and City Commissioners Page 2 Planning & Zoning Commission voted unanimously to recommend approval of Shoppes of Ocoee Preliminary/Final Site Plan, as date stamped by the City "Received December 9, 2004, subject to the completion of Staff's additional comments before City Commission action, and Approval, Execution and Recording of the Ocoee Commons PUD "Plat." The plans have now been revised to address all the comments that were outstanding. STAFF RECOMMENDATION: Based on the recommendation of the DRC and the Planning & Zoning Commission, Staff respectfully recommends that the Mayor and City Commissioners approve the Preliminary/Final Site Plan for Shoppes of Ocoee, as date stamped received by the City on December 27, 2004, subject to Approval of the Waiver pertaining to minimum size of parking spaces, and Approval, Execution and Recording of the Ocoee Commons PUD "Plat."
