ISSUE
Should the Mayor and City Commissioners approve the Preliminary Subdivision Plan of Ingram Estates?
BACKGROUNDIDISCUSSION
The Ingram Estates property includes approximately 33.48 acres. The property is located on the southeast
comer of the intersection of Ingram Road and McCormick Road.. The subject property contains a house,
several agricultural buildings with a few trees along Ingram Road and along McCormick Road.
The surrounding land to the north is in unincorporated Orange County with the County owning 712 acres and
operating a solid waste disposal facility on a portion of that land, zoned A-I "Citrus Rural District". To the
south is the Meadow Lakes LLC property, zoned R-1AA (LUP pending for Arden Park residential PUD with
approximately 950 single-family and townhouse units). To the east is the 40 acre Gormican property which is
heavily treed containing a single-family residence, zoned R-1AA. To the west is the McCormick Woods
property that will be developed as a 182 lot single-family residential subdivision, zoned R-1A.
DISCUSSION:
Along with the usual utility improvements, the documents indicate that the property owner will provide 10 feet
additional road right-of-way on the south side McCormick Road for future road widening. The proposed
subdivision will consist of 104 single-family residentia110ts with a typical lot size of 9,000 square feet and a
minimum living area of 1,400 square feet. Sidewalks for these students and others will be provided along both
sides of all internal streets. Sidewalks will also be installed along the subdivision where it fronts on Ingram and
McCormick Roads.
As shown in the Preliminary Subdivision Plan, Ingram Estates will have one access point from Ingram Road.
Sheets 3 and 4 shows the 10 feet of additional right-of-way along McCormick Road that will be dedicated by
the Applicant to the City.
This subdivision will not be gated. There will be a 6-foot brick wall with appropriate landscaping on both sides
of the entrance with the wall extending northward along Ingram Road to the north boundary of the subdivision
and eastward along McCormick Road to the east property boundary. Water and wastewater will be provided by
Orange County while reclaimed water, solid waste and police and fire protection will be provided by the City.
As a result of the traffic impact analysis, the applicant is constructing or paying the cost of, a northbound left
turn lane on Ingram Road at McCormick Road and paving Ingram road curb and gutter along the length of the
property which will include a southbound turn lane for traffic entering the site. They will also install a right
turn lane on McCormick at Ingram Road.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION
The Development Review Committee (DRC) reviewed the Ingram Estates Preliminary Subdivision Plan on
November 11, 2004. The DRC discussed the items in the report from the City Attorney's office and the
Planning Division and the developer agreed to make the requested changes. The Engineering Dept. and the
City's transportation consultant had no outstanding issues. It was noted that an Annexation Agreement has
been executed between the developer and the City. There was discussion of re-use line along Ingram Road and
it was agreed that the developer and the City would meet with the County concerning this. Also discussed was
the alignment of the entrances to the Ingram Estates Subdivision and the McCormick Woods Subdivision being
placed directly opposite of each other on Ingram Road The developer agreed to coordinate with the developer
of McCormick Woods and ensure this. The DRC voted unanimously to recommend approval of the
Preliminary Subdivision Plan.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The proposed Preliminary Subdivision Plan of Ingram Estates was reviewed by the Planning and Zoning
Commission on December 14, 2004. There was a discussion on roadway access to adjacent properties to the
east and south. It was noted that the adjacent property owner to the south has not expressed any interest in
roadway interconnection when his property is developed. The adjacent property owner to the east expressed
his concern that a roadway from Ingram Estates not require him to continue the roadway to the east to connect
with Clark Road. He was given assurance that he will not be required to create a direct connection when he
develops his property. The was also a suggestion from the resident that consideration be given by the County
and City to construct a horse and bike trail along McCormick Road to accommodate the new residents and their
children.
Another resident spoke about joint use of utilities. The developer of McCormick Woods said that
representatives of the Ingram Estates project have not approached them to discuss joint utility use plans. The
Community Development Director noted that the issue of joint use of utilities will be addressed later and that
there are alternate ways to handle utilities. He said that the Planning and Zoning Commission could move
forward on a review and recommendation on the Preliminary Subdivision Plan for Ingram Estates. Some board
members discussed the desirability of installing 6-foot wide sidewalks rather than 5-foot wide sidewalks along
Ingram and McCormick Woods Roads.
The Planning and Zoning Commission recommended approval of the Preliminary Subdivision Plan with the
following conditions:
1. Widen the sidewalks along Ingram Estates to 6 feet; and
2. The developers of McCormick Woods and Ingram Estates subdivisions should get together and
resolve the issue of joint use of utilities.
STAFF RECOMMENDATION:
Based on the recommendation of the DRC and the Planning & Zoning Commission, Staff recommends that the
Mayor and Commissioners approve the Preliminary Subdivision Plan for Ingram Estates Subdivision, as date
stamped received by the City on December 3, 2004, subject to the developer working out sewer and water
connections to the property prior to Final Subdivision plan submission
