Maguire Pointe is a proposed 1-sto.t ,:4:0`quare feet general retail building to be located in the
Plantation Groves PUD, adjacent to the south side of the Key Isle Apartment complex and adjacent
to the west side of the Ocoee fire station. In order to proceed with the current site plan, the
developer has indicated he needs a waiver from City Code requirements.
The waiver request involves:
• a release from the requirement of having to construct a 6-foot high brick or stucco wall
along the north side of the site to separate the commercial use of the site from the
adjacent residential use to the north (Key Isle Apartments).
The developer requests this release from having to construct a wall, due to:
• A large vegetative barrier(hedge) that currently exists along the north property line of
the Maguire Pointe site.
• The Ocoee fire station, adjacent to the east of the Maguire Pointe site, does not have
a wall separating its site from the residential use.
Recommendation:
Staff recommends approval of the requested waiver to Article V, Section 5-18 City Code to release
the developer from the requirement to construct a wall between a commercial use and an adjacent
residential use.

ISSUE
Should the Mayor and City Commissioners grant a waiver from the Land Development Code to release the
developer from the requirement of Article VI Section 6-14 C (2) (c) iv. which requires that a 6-foot brick
wall must be erected to separate non-residential land uses from residential land uses.
BACKGROUND/DISCUSSION
Maguire Pointe is a proposed 1-story 4,960 square feet general retail building to be located in the
Plantation Groves PUD adjacent on the south side of the Key Isle Apartment complex and adjacent to the
west side of the Ocoee fire station. In order to proceed with the current site plan, the developer has
requested a waiver from City Code requirements.
The City Commission has sole discretion to approve waivers from Code requirements based upon four
criteria:
1. If the project is part of an integrated and master planned development.
2. If the project is compatible with surrounding developments.
3. If the project imposes no impacts on City infrastructure greater than that generated by other uses
normally permitted in the underlying zoning district; and/or
4. If the project provides an off-setting public benefit which is technically sound and measurable.
Since this is a Small Scale Site Plan which is administratively reviewed (less than 25,000 square feet of
building), the City Commission will not be acting on the site plan for approval. The City Commission will
instead be reviewing the waiver request only.
After the City Commission takes action on the waiver requests, Staff will complete its review process on
the site plan, making sure that it is consistent with all Code requirements except for any waivers that may
be approved by the City Commission.
The waiver request involves:
• a release from the requirement of Article VI Section 6-14 (2) (c) iv which states that:
"A six (6) foot high brick screening walls with landscaping per the Ocoee Land
Development code are required where professional office, service, commercial, or
industrial projects abut residential properties."
The developer requests this release from having to construct a wall, due to:
• A large vegetative barrier (hedge) that currently exists along the north property line of the
Maguire Pointe site, that will effectively screen the Maguire Pointe commercial building
from the apartments.
• The Ocoee fire station, adjacent to the east of the Maguire Pointe site, does not have a wall
separating its site from the residential use (Key Isle Apartment complex)to the north.
• A six (6) foot high brick wall will not be more effective than the current large vegetative
barrier along the north property line in screening from view the Maguire Pointe commercial
building from someone looking out the window on the second floor of the Key Isle
Apartments adjacent to the north.
Staff is in support of this request due to the willingness of the developer to provide a barrel tile roof on his
building similar in character to the adjacent Ocoee fire station, so that the project is compatible with the
surrounding development.
RECOMMENDATION
Staff recommends approval of the requested waiver to Article V, Section 5-18 City Code to release the
developer from the requirement of constructing a brick wall between a commercial use and an adjacent
residential use.

Dear Mr. Grimms:
Maguire Pointe, LLC is submitting this letter to request a waiver to the requirement for a
brick wall to run along the north property line of Lot 2 Opus South outparcel. The basis
for the waiver is that our adjacent property owner, the city of Ocoee fire department,
was not required to build the brick wall when the fire station was constructed. If they
were exempt from this requirement, then we should be exempt as well.
