Recommendation: Staff recommends approval of the additional 13 days provided contractor provides assurances that McKey Street will be safe and passable for Founder's Day celebration on October 15 and 16, 2004. Background Summary: McKey Street contractor, Gibbs&Register, Inc., has requested 13 days time extension for lost time during Hurricane Charley, Hurricane Frances, and additional work for Change Order# 1. Staff has reviewed this request and agrees with the lost time. If approved,this change will postpone the substantial completion date to November 16, 2004 and final completion date to January 15, 2005. Fiscal Impacts: There is no direct financial impact. BACKGROUND/DISCUSSION Gibbs&Register, Inc., has requested 13 days time extension for lost time during Hurricane Charley, Hurricane Frances, and additional work for Change Order# 1. Staff has reviewed this request and agrees with the lost time. If approved,this change will postpone the substantial completion date to November 16, 2004 and final completion date to January 15, 2005. There is no direct financial impact. RECOMMENDATION Staff respectfully request the Mayor and City Commission to approve the requested 13 days time extension for Gibbs&Register, Inc.; and authorize Mayor and City Clerk to execute Change Order#2. NARRATIVE OF NEGOTIATIONS Staff has reviewed the request and concur with the time extension as requested. V. PAYMENT There is no direct financial impact. VL APPROVAL AND CHANGE AUTHORIZATION This proposed change to the Contract is to be approved by the Ocoee City Commission. Acknowledgements: The aforementioned change,and work affected thereby,is subject to all provisions of the original contract not specifically changed by this Change Order;and, It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original contract other than matters expressly provided herein. CONTRACTOR acknowledges,by its execution and acceptance of this Change Order,that the adjustments in Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other claim for increased costs of performance or modifications of time will be granted by the OWNER for the Work covered by this Change Order. The CONTRACTOR hereby waives and releases any further claims for cost or time against the OWNER arising from or relating to the matters or Work set forth or contemplated by this Change Order. The rain and recovery time was necessary because time was lost due to preparation for and cleanup after the two storms. Adverse soil conditions from the heavy rain prevented G&R from productively performing controlling items of work. Change Order#1 added additional items of work for the water line portion of the contract and that work will extend the contract period. The following are the number of days that were added or lost during the period: Rain and Recovery Time—Hurricane Charlie 4 Days Rain and Recovery Time—Hurricane Frances 4 Days Additional Work Change Order#1 5 Days 13 Days New Dates-Substantial Completion 11/16/04 and Final Completion 1/15/05 Please review the above request and should they be acceptable please process a change in the number of contract days.
