Background Summary: Waste Services of Florida began providing residential garbage and recycling service in Ocoee on June 1, 2004. There have been numerous issues with the performance of the company as documented by staff. Various attempt by staff to correct the performance issues,including assessment of substantial penalties, have been unsuccessful to date. On September 21, 2004,City Commission directed staff to request Waste Services of Florida to be present at a City Commission meeting to provide explanations for the poor performance record to date. ISSUE: City Commission to consider presentation by Waste Services of Florida(formerly Florida Recycling Services)and provide guidance to staff BACKGROUND/DISCUSSION On September 21, 2004,City Commission directed staff to request Waste Services of Florida to be present at a City Commission meeting to provide explanations for the poor performance record to date. Waste Services of Florida began providing residential garbage and recycling service in Ocoee on June 1, 2004. There have been numerous issues with the performance of the company as documented by staff. Various attempt by staff to correct the performance issues, including assessment of substantial penalties, have been unsuccessful to date. Damage to Carts There is excessive damage to carts due to incompatible equipment and harsh treatment by employees. City replaced 53 carts and repaired 11 carts broken by FRS during August. This is by far the highest number of damaged carts since start of service. The introduction of new equipment seems to have little effect on curtailing the damage to our carts. The new side-load vehicles appear to have design issues with respect to the shallow depth of the intake hopper.The 96-gallon containers are emptied in multiple loadings per collection,thereby over-stressed the carts.The handling of the carts by FRS personnel also contributes to the damage. The side effect of the incompatible equipment is delay and late pick up. Tardy Service Tardy pickup and late pick up has been a constant problem since the inception of the service. Inadequate resources are the root cause of this problem. In City's estimation,a 6th route garbage is needed now and the 3"'recycling route. The terms of the contract is pick up between 7:00 AM to 5:00 PM,which is generally violated now by FRS. Penalties will be assessed to FRS in,accordance with the terms of the contract. Missed Service The number of missed services has not improved over the previous months;in fact,they have declined constantly where entire streets or subdivisions are being missed. The same issues described in this letter have been shared with FRS management in meeting and phone conversations without an effective response. In many cases promises to recover missed service are not followed through by supervisory personnel. Overall Performance Overall,the level-of-service has declined to unacceptable levels. Therefore,we are requesting that FRS prepare and submit a plan to the City which describes FRS's immediate action to resolve these performance issues as soon as possible. Without an immediate service improvement and a plan to sustain an effective operation, City will be left with no choice to consider drastic measures in accordance with the terms of the contract.
