Subsequently, fines were established and accrued to approximately $16,800.00. At the September 28, 2004, Code Enforcement Board Meeting, the Respondent appeared before the Board and it was determined by the Board that the conditions were met in accordance with the agreement and that the fine should be reduced to $500.00. Issue: Should the Honorable Mayor and City Commission consider a reduction of fines and release of lien on Code Enforcement Board Case Nos.03-001219 and 03-002902, Mark and Katrina Johanson, property located at 1602 Little Spring Hill Drive Ocoee, Florida? Recommendations: It is Staff's recommendation that the $500.00 reduction of fine recommended by the Code Enforcement Board be upheld by the City Commission. Attachments: Financial Impact: A reduction in the collection of revenue should the fine have ever been collected. Parker, District 4 STAFF REPORT TO: The Honorable Mayor and City Commissioners FROM: Jim Phelps,Building Official DATE: October 11,2004 RE: Reduction of Fine/Release of Lien Code Enforcement Board Cases 03-001219& 03-002902 Mark and Katrina Johanson ISSUE Should the Honorable Mayor and City Commission consider a reduction of fines and release of lien on Code Enforcement Board Case Nos.03-001219 and 03-002902, Mark and Katrina Johanson, property located at 1602 Little Spring Hill Drive Ocoee, Florida? BACKGROUND/DISCUSSION This was an issue that was heard before the Code Enforcement Board on two separate violations; 1) For failure to call for a fmal inspection on a mechanical permit; 2) For overgrown grass & weeds. The Respondent was found to be in violation on both counts and was provided with time to bring the property into compliance. It was not brought into compliance within the set period of time. Subsequently, fines were established and accrued to approximately $16,800.00. The Respondent had requested consideration and a reduction of fine. The Code Enforcement Board entered into an agreement with the Respondents that if they would clean up the yard, remove the overgrowth, repair the roof leak, replace the garage door and bring the property to a status equal to surrounding properties, the Code Enforcement Board would consider reducing the fine to $500.00. There were some delays but they did ultimately accomplished all required elements. At the September 28, 2004, Code Enforcement Board Meeting, the Respondent appeared before the Board and it was determined by the Board that the conditions were met in accordance with the agreement and that the fine should be reduced to $500.00. RECOMMENDATION It is Staff's recommendation that the $500.00 reduction of fine recommended by the Code Enforcement Board be upheld by the City Commission.
