SUBJ: Request For Fee Refund
St . Pauls Presbyterian Church
Pastor Bryan Stamper
St . Pauls Presbyterian Church on Citrus Oaks Avenue in Ocoee
previously filed an amendment to their Special Exception to permit
placement of a temporary modular classroom building on the site.
Pastor Stamper has requested that the City Commission refund the
$750 Special Exception application flat fee as well as all other
review fees paid in connection with this case.
In the past, the City Commission has granted fee waivers for
rezonings and special exceptions which were initiated by church
sponsors . This has included the Reformed Presbyterian Church in
1988, St . Paul 's Presbyterian Church in 1990 and 1992 , Glad Tidings
Assembly of God in 1994, and Winter Garden Seventh Day Adventist
Church in 1994. This is a fairly common practice by other local
governments, although the City's Land Development Code does not
specifically address such waivers . In this instance, due to the
need for a prompt review of the case, the Church actually paid the
application fee rather than wait an additional 2-3 weeks to be
scheduled on the next Commission agenda to request the waiver.
Accordingly, Pastor Stamper is seeking a refund of the fees which
would have normally been waived based upon the prior policy of the
City Commission.
Staff Recommendation:
Staff recommends that the Honorable Mayor and City Commissioners
approve a refund of all fees related to the St . Pauls Presbyterian
Church Special Exception amendment .

special exception request, Case #1-3SE-94. The amount was $750.00,
check #11473, dated July 22, 1994 and $45.25 for a copy of the
transcript, check #11940, •dated November 17, 1994. Enclosed
is a copy of an earlier request for such waiver.
Thanks for your consideration in this matter. ' l believe this
might be the most discussed, documented and written about portable
in the history of Ocoee!
