SUBJECT: WEEKEND DIRECTIONAL SIGNS
ISSUE
Should the Honorable Mayor and Board of City Commissioners
authorize an Amendment to the City Sign Ordinance. The Amendment
would permit builders and realtors to place directional signs
throughout the City that would direct potential customers to
subdivisions and construction sites. Directional signs would be
authorized for weekend use only.
BACKGROUND/DISCUSSION
Our City Sign Ordinance prohibits off-site advertising signs.
Builders and realtors have been erecting directional signs on
weekends within road right-of-ways and on private property, which
is a violation of our City Code.
Our Code Enforcement Officers remove the signs and notify the
builder or realtor of the violation. The Home Builders Association
of Mid Florida has requested the City Commission to consider
amending our sign ordinance to permit the placement of temporary
directional signs on private property on weekends. A research of
our City Code revealed the following:
1) Section 8-1 Article VIII Paragraph 3 , Land Development Code
prohibits all off-site advertising.
2) Section 8-1 Article VIII Paragraph 4, Land Development Code
prohibits temporary signs except those that are of a general
public interest.
3) Section 8-2 (A) Article VIII, Land Development Code requires a
building permit to be obtained to erect a sign.
4) Section 8-4 (N) Article VIII, Land Development Code permits a
temporary sign announcing any public, charitable, educational
or religious event or function provided that it is located on
the premises of the sponsoring institution.

5) Section 8-6 (G) (6) Article VIII, Land Development Code permits
real estate signs and flags at model homes and non-occpied
homes at the quantity of two (2) flags per home and four (4)
flags at the entrance of a subdivision under construction plus
realestate signs not exceeding four (4) square feet in all
zoning districts are permitted provided that only one sign may
be erected for each street frontage of the parcel of property
or unit offered for sale.
To assist in your consideration of this matter, the following
comments are submitted:
1) If signs are permitted to be placed on private property by
builders and realtors, how would the City prohibit other
businesses from having the same right such as restaurants,
special events, grocery stores, garage sales, sub-contractors,
bus stop bench advertisement or any type of business?
2) Weekend signs would cause sign clutter. Existing sign
ordinance is reasonable and effectively controls sign clutter.
3) Additional permit fees would be required for the enforcement
of weekend signs.
4) How would the proposed Amendment effect the location of
realtor signs for the resale of existing homes?
5) I have personally worked with the Home Builders Association of
Mid Florida to allow temporary weekend signs during their
Parade of Homes events. It has been my experience that there
has been a lack of control by the Home Builders Association of
temporary weekend signs for Parade of Homes events such as
numerous signs placed in State and County Right-of-ways, signs
nailed on power poles. Signs nailed on power poles 10 to 12
feet high required Code Enforcement Officers to use a ladder
to reach signs. Majority of temporary signs had to be removed
by City Personnel after completion of Parade of Homes event.
6) The City of Apopka has a weekend direction sign ordinance. A
review of this ordinance revealed weekend directional signs
are not limited to any particular type of business. Signs are
permitted to be placed on private property in all zoning
categories except a community redevelopment area. In my
discussions with the Apopka Zoning Department, it appears this
ordinance is not strictly enforced. (See attached copy of
Apopka ordinance) .

7) I called Orange County and requested a copy of their anti-
clutter ordinance. Orange County informed me that the
ordinance had not been adopted as of September 14, 1994 and
they would not send me a copy until it had been adopted.
8) If we amend our sign ordinance to permit the same number of
weekend directional signs as the City of Apopka allows (20 per
applicant) , there could possibly be from 200 to 400 separate
directional signs erected each weekend in the City.
9) From August 1, 1993 through August 31, 1994, the City has
issued 456 single family residential building permits. This
month alone from September 1, 1994 through September 14, 1994,
we have issued 10 single family building permits and are
currently reviewing an additional 30 single family permit
applications.
10) As of this date, we have eight new subdivisions under various
stages of construction. Construction of single family
residence will start in these subdivisions in the very near
future.
RECOMMENDATION
The Building and Zoning Staff recommends that the Honorable Mayor
and Board of City Commissioners not approve an Amendment to the
City Sign Ordinance to permit weekend directional signs.

Weekend Directional Signs may be permitted throughout
the City in accordance with Table VIII-1; however, said
Signs are prohibited in the Community Redevelopment
Area ( CRA) as identified on Table VIII-2 . Each
applicant is responsible for obtaining permission from
property owner prior to erecting Signs.
