RE: Special Exception Application
Winter Garden Seventh-Day Adventist Church
Case No. 1-4SE-94
The above-referenced Special Exception was considered by the
City Commission at a public hearing held on September 20, 1994
which was continued to October 18, 1994 and again continued to
November 1, 1994 in order allow the City staff to explore possible
solutions for the improvement of Wofford Road so that it would be
adequate to support the existing school operation and an expanded
school and daycare operation. Please bring with you to the meeting
the packet on this matter included with your October 18, agenda
packet.
The Church has submitted a report by Yovaish Engineering
Sciences, Inc. recommending certain improvements which, in their
opinion, would allow the roadway to provide adequate support for
access by fire trucks and other emergency vehicles. The estimated
cost for implementing the solution recommended by Yovaish
Engineering is $10, 000. 00.
City Engineer Jim Shira has reviewed the Yovaish Engineering
report and believes that the recommendations contained therein
provide, at best, a short term solution which should last between
1 and 12 years. A long term solution would involve paving the
roadway and adding required drainage. The estimated cost for such
a project is set forth on the proposal attached hereto. On a
shorter term basis, Ray Brenner and Jim Shira have indicated that
normal monthly maintenance of Wofford Road should provide adequate

support for fire truck access for approximately 6 months due to the
passage of the rainy season and improvements recently made by the
City; however, this maintenance would not be adequate once the
rainy season returns.
We are continuing discussions with the Florida Auto Auction
regarding Wofford Road. However, we do not anticipate a quick
conclusion to these discussions. The following options are
available to the City Commission in connection with the Church's
application for a Special Exception:
(1) Deny the application without prejudice to the right of
the Church to reapply for a Special Exception at such
time as private funding is in place to implement
improvements to Wofford Road. This action would require
that school operation be discontinued.
(2) Approve the Special Exception with the condition that it
will automatically terminate on May 3 , 1995 and that such
action would be without prejudice to the right of the
Church to apply for an extension of the Special
Exception. This action would not require any current
financial commitment by the Church.
(3) Approve the Special Exception with the following
conditions:
(a) That the Church, at its sole cost and expense, fund
the improvements to Wofford Road called for by the
Yovaish Engineering Sciences, Inc. report dated
October 17, 1994;
(b) That the Church reimburse the City for any
increased maintenance costs incurred by the City
beyond the current maintenance program; and
(c) That the Special Exception terminate May 1, 1996
without prejudice to the right of the Church to
apply for an extension of the Special Exception.
(4) Approve the Special Exception subject to the Church
funding, at its sole cost and expense, the paving of
Wofford Road along with appropriate drainage, with any
such road improvement plans being subject to the approval
of the City.
All of the above options are acceptable to the City staff and do
not involve the expenditure of any City funds beyond those

currently spent for normal and routine maintenance of Wofford Road.
Additionally, all of the above options contemplate that the City
will close Wofford Road to all truck traffic and will further close
Wofford Road to through traffic by barricading the middle of the
road just past the Wofford family property.
The options set forth in this letter are being communicated to
legal counsel for the Church so that they are in a position to
advise you at the Tuesday meeting regarding their preferred
alternative.
