Project
Background Summary:
To perform the work in tapping the CONSERV pipeline, the contractor was required to work around the
existing water mains in the area; one of the existing gate valves was not operating correctly and needed to be
replaced. Progress Energy changed the required electrical connection from what was designed to an isolated
breaker meter connection for safety reasons. The contractor requested additional time because of delays
associated with the three hurricanes. Their location was either unknown or in an area that was not in the way
of the new construction. The change order amount to include these items is $5,322.67 with an increase of
forty-three calendar days.
The attached document is Change Order NO.3 with Prime Construction Group, Inc.
Issue:
The Reclaimed Water Booster Pumping Facility Project requires the additional equipment to operate
effectively according to the design intent.
Recommendations
The Engineering - Public Utilities staff recommends that the City Commission approve Change Order No. 3
for the additional gate valve, upgrade in electrical connection, and additional days associated with hurricane
delays in the amount of $5,322.67, with an increase in contract time of forty-three days, and authorize the
Mayor and City Clerk to execute the change order.

Financial Impact:

ISSUE
The Engineering - Public Utilities Department requests that the City Commission approve Change Order no. 3
with Prime Construction Group, Inc. on the Reclaimed Water Booster Pumping Facility Project for the
installation of an additional gate valve, change to the electrical service equipment as required by Progress
Energy, and additional time as a result of delays caused by the hurricanes. The change order results in an
increase of $5,322.67, with an increase in contract time of forty-three calendar days.
BACKGROUNDIDISCUSSION
The Reclaimed Water Booster Pumping Facility project includes the construction of a pump station, connection
to the CONSER V pipeline, and associated piping and instrumentation to allow for the drawing of reclaimed
water from the CONSER V pipeline, a system operated by the City of Orlando and Orange County. The City of
Ocoee purchased a lot on south Maguire Road near the CONSERV pipeline that generally runs along Moore
Road to be the location of the Reclaimed Water Booster Pumping Facility.
The additional gate valve was required to replace an existing gate valve that was not operating correctly. The
replacement of this valve was required to allow the contractor to perform required work at another location and
will provide for better operations in the future. The electrical panel changes were based upon Progress Energy's
requirement for a isolation breaker for the meter connection. This change was provided when the contractor
contacted Progress Energy and was different than what was required when the design was performed. The
additional days are as a result of delays associated with the three hurricanes. The contractor was required to
safe the site before, clean up the site afterward, and delays associated with deliveries from suppliers.
The negotiated cost for these work items was $5,322.67 and forty-three additional calendar days in contract
time. This change order provides for an increase of 0.48% in the contract amount of $1,097,000. The new
contract value including this change order is $1,144,176.42 and the new contract completion date is May 18,
2005. The change order is attached for review.

CHANGES ORDERED:
I. GENERAL
This change order is necessary to cover changes in the work to be performed under this Contract.
The GENERAL CONDITION, SUPPLEMENTARY CONDITIONS, SPECIFICATIONS and all parts
of the Project Manual listed in Article 1, Definitions, of the GENERAL CONDITIONS apply to and
govern all work under this change order.
II. REQUIRED CHANGES
C03-01 Required changes include a 12-inch gate valve to accommodate necessary piping
reconfiguration of the existing watermain located along the east side of Maguire Road
serving the Hess Station. No additional days will be added to the contract term as a result
of the change.
C03-02 Required changes include a 600 amp meter base and disconnect. No additional days will
be added to the contract term as a result of the change.
C03-03 Required changes include an additional 14 calendar days to the Contract Terms for the
Jack and Bore and 29 calendar days to the Contract Terms for wet tap to the 54-inch Conserv II
Reclaimed Water Main. A total of 43 calendar days to be added to the Contract Terms as a result
of this change.
III. JUSTIFICATION
C03-01 The addition of a 12-inch gate valve in the reconfiguration/relocation of the 12-inch and 4-
inch watermain serving the Hess Station allows for the least amount of interrupted service
to the Hess Station and provides for an easier reconnect once the wet tap to the 54-inch
is complete.
C03-02 Progress Energy requires a 600 amp "K" meter base and a disconnect on the line side of
the meter base. The proposed C.T. metering was not acceptable per Progress Energy.
C03-03 The Contractor has requested (1) an additional 14 calendar days to be added to the
Contract Terms due to the impact and the aftermath of the September 5th hurricane which
affected the Jack and Bore originally scheduled for September 13, 2004 and rescheduled
for September 27, 2004 and (2) an additional 29 calendar days as a result of the
rescheduling of the wet tap to the 54-inch Conserv II Reclaimed Water Main due to
excessive high water levels resulting from the September hurricanes.
IV. NARRATIVE OF NEGOTIATIONS
C03-01 Contractor provided lump sum cost of $1,340.33 as shown in the proposal dated
November 10, 2004, which includes furnishing and installation of the 12-inch valve at the
54-inch Conserv II Wet Tap. Contractor's proposal appears reasonable and is hereby
recommended for acceptance by the Engineer (PEC, Inc.).
C03-02 Contractor provided a lump sum cost of $3,982.34 as shown in the attached proposal
dated November 24, 2004 and includes a credit for the C.T. Box and Sase and the labor
involved. Contractor's proposal appears reasonable and is hereby recommended for
acceptance by the Engineer (PEC, Inc.).
C03-03 Contract provided a proposal for an extension of the Contract by 14 calendar days due to
the delay of the Jack and Bore and by 29 calendar days due to the time delay of the wet
tap. Both are due to hurricane related conditions and are addressed in the attached
proposal dated December 9, 2004. Contractor's proposal appears reasonable and is
hereby recommended for acceptance by the Engineer (PEC, Inc.).

VI. APPROVAL AND CHANGE AUTHORIZATION
This proposed change to the Contract is to be approved by the Ocoee City Commission.
Acknowledgments:
The aforementioned change, and work affected thereby, is subject to all provisions of the original contract
not specifically changed by this Change Order; and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on the
original contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the
adjustments in Contract Price and Time shown hereon constitute full and complete compensation and
satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a result
of this Change Order. No other claim for increased costs of performance or modifications of time will be
granted by the OWNER for the Work covered by this Change Order. The CONTRACTOR hereby waives
and releases any further claims for cost or time against the OWNER arising from or relating to the matters
or Work set forth or -CO/lated by this Change Order.

Dear Robert;
Per our conversation at the November 24th Progress Meeting, please find our request for additional days
to be added to our construction contract for the following reasons:
JACK & BORE
The Jack and Bore was scheduled for September 13th but due to weather conditions resulting from the
hurricane on September 5th we had to reschedule for September 27th.
This request is for an additional 14 calendar days.
TAP
On September 30th Conserv II requested a rescheduling of the tap due to the excessive high water levels
brought on by the September 5th and September 26th hurricanes. The tap was scheduled to be performed
on October 5th and 6th but was rescheduled for November 2nd and 3rd.
This request is for an additional 29 calendar days.
The above request for time is only for the extension of the contract and not for any monetary
consideration.
