Subject: FOOT permit signature resolution
Background Summary:
The Florida Department of Transportation (FDOT) requires permits from local government authorities to
temporarily close state roads that are located within the local government authorities' jurisdictions. Parade permit
requests and special event requests on state roads are often applied for shortly before the event, allowing no time for
a public meeting. The designation of the City Manager (Acting City Manager) or Public Works Director (Acting
Public Works Director) or Chief of Police (Acting Chief of Police) as the signatory authority for the local
government authority will expedite the permitting process with FDOT.
Issue:
Should the Honorable Mayor and Board of City Commissioners adopt a resolution designating the City Manager
(Acting City Manager) or in his/her absence the Public Works Director (Acting Public Works Director) or Chief of
Police (Acting Chief of Police) as the individuals authorized on behalf of the City of Ocoee to sign Florida
Department of Transportation temporary road closing and special use of the state road permit applications.
Recommendations
It is recommended that the Honorable Mayor and Board of City Commissioners adopt a resolution designating the
City Manager (Acting City Manager) or in his/her absence the Public Works Director (Acting Public Works
Director) or Chief of Police (Acting Chief of Police) as the individuals authorized on behalf of the City ofOcoee to
sign Florida Department of Transportation temporary road closing and special use of the state road permit
applications.

ISSUE
Should the Honorable Mayor and Board of City Commissioners adopt a resolution designating the City Manager
(Acting City Manager) or in his/her absence the Public Works Director (Acting Public Works Director) or Chief
of Police (Acting Chief of Police) as the individuals authorized on behalf of the City of Ocoee to sign Florida
Department of Transportation temporary road closing and special use of the state road permit applications.
BACKGROUNDIDISCUSSION
The Florida Department of Transportation (FDOT) requires permits from local government authorities to
temporarily close state roads that are located within the local government authorities' jurisdictions. Florida
Administrative Code Rules Chapter 14-65 require the local government authority include in its request for
temporary closing of state roads, a certified copy of minutes or an executed resolution authorizing the special
event. Florida Administrative Code Rule Chapter 14-65 states that the governmental authority, by resolution,
may delegate the authority to sign for the body. FDOT internal auditing procedures also require that they have
on record individuals charged with signatory authority for such permits. Parade permit requests and special
event requests on state roads are often applied for shortly before the event, allowing no time for a public meeting
and the designation of the City Manager (Acting City Manager) or Public Works Director (Acting Public Works
Director) or Chief of Police (Acting Chief of Police) as the signatory authority will expedite the permitting
process with FDOT. The resolution has been reviewed by Foley and Lardner.
A RESOLUTION OF THE CITY OF OCOEE, FLORIDA DESIGNATING THE CITY MANAGER (ACTING
CITY MANAGER) OR IN IDS/HER ABSENCE THE PUBLIC WORKS DIRECTOR (ACTING PUBLIC
WORKS DIRECTOR) OR THE CIDEF OF POLICE (ACTING CIDEF OF POLICE) TO AUTHORIZE AND
SIGN FLORIDA DEPARTMENT OF TRANSPORTATION TEMPORARY CLOSING/SPECIAL USE OF THE
STATE ROAD PERMITS AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Florida Department of Transportation has notified the City of Ocoee of the requirements of Florida
Administrative Code Rules Chapter 14-65; and
WHEREAS, Florida Administrative Code Rules Chapter 14-65 required the local government authority include in its
request for temporary closing of state roads, a certified copy of minutes or an executed resolution authorizing the special
event; and
WHEREAS, Florida Administrative Code Rules Chapter 14-65 states that the governmental authority, by resolution, may
delegate the authority to sign for the body; and
WHEREAS, parade permit requests and special event requests are often applied for shortly before the event and the
designation of the City Manager (Acting City Manager) or Public Works Director (Acting Public Works Director) or Chief
of Police (Acting Chief of Police) as the signatory authority will expedite the permitting process.
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OCOEE AS
FOLLOWS:
SECTION 1. The above recitals are true and correct and are incorporated herein by reference and made a part hereof.
SECTION 2. The City Manager (Acting City Manager) or in his/her absence the Public Works Director (Acting Public
Works Director) or Chief of Police (Acting Chief of Police) are hereby designated as the individuals authorized on behalf
of the City of Ocoee to sign Florida Department of Transportation temporary road closing and special use of the state road
permit applications.
SECTION 3. This Resolution shall become effective immediately upon adoption.
