The western portion of the ROW is in Winter Garden (vacated on August 12,2004) and the eastern portion is within the City of Ocoee. The roadway dead-ends and serves only Auto Auction properties and is not an arterial or collector road. The vacation will exclude the north 40 feet to allow for the future widening of Story Road from two to four lanes. Progress Energy requested a guying easement and this agreement was executed between the applicant and Progress Energy on December 8, 2004. Since the roadway is neither a collector nor an arterial road, a Planning & Zoning Commission recommendation is not required. Issue: Should the Mayor & City Commissioners adopt a resolution abandoning and vacating the public road right- of-way for Wofford Road lying between 40 feet south of the southern right-of-way line of Story Road and the Western Beltway/SR 429 right-of-way? Recommendations Staff recommends the Mayor and City Commissioners approve a resolution abandoning and vacating with public right-of-way for Wofford Road between the southern right-of-way of Story Road and the right-of-way for the Western Beltway/SR 429 subject to the following conditions: · Lessening out of the northern 40 feet of right-of-way to allow for the future widening of Story Road; and . The distribution and guying easements requested by Progress Energy. James, Principal Planner ~ THROUGH: Russ Wagner, Community Development Director DATE: February 16, 2005 RE: Wofford Road Right-of-Way Vacation Florida Auto Auction Vacation Resolution V AC-04-004 ISSUE: Should the Mayor & City Commissioners adopt a resolution abandoning and vacating the public road right-of- way for Wofford Road lying between 40 feet south of the southern right-of-way line of Story Road and the Western Beltway/SR 429 right-of-way? BACKGROUND: Wofford Road is an inactive roadway with a sixty-foot right-of-way bisected by the boundary between the City of Winter Garden and the City ofOcoee (See attached "Sketch of Description"). The roadway's western side is within the City of Winter Garden (Parcell), while the eastern side is within the City of Ocoee (Parcel 2). The total land area within Ocoee's Parcel 2 is approximately 0.89 acres. The roadway is not a collector or arterial roadway. Historically, Wofford Road connected Story Road with Colonial Drive; however, when the Orlando-Orange County Expressway Authority (OOCEA) built the Western Expressway (SR429), the new Expressway right-of way effectively severed this connection. The Applicant is requesting the City of Ocoee to vacate the eastern 30 feet of the Wofford Road right-of-way south of the Story Road to approximately 1,291.81 foot to its termination at the Western Expressway right-of- way. On August 12,2004, the City of Winter Garden vacated the western 30 feet of the right-of-way of similar length. The Winter Garden ordinance lessened out the northern 40 feet of the right-of-way to allow for the future widening of Story Road from two to four lanes. DISCUSSION: Wofford Road no longer a thoroughfare since it terminates at the Western Expressway right-of-way. The Florida Auto Auction owns the parcels on both sides of the proposed vacation. This roadway does not provide access to any other residential or non-residential buildings other than those owned by the Florida Auto Auction. Since the roadway is neither a collector nor an arterial road, a Planning & Zoning Commission recommendation is not required. Progress Energy indicated the need for a distribution easement and a guying easement on Wofford Road. The Progress Energy and the Auto Auction executed this requested easement on December 8, 2004. Sprint has raised concerns over a needed easement; however, after further discussions with the applicant, Sprint indicated it had no further objections or concerns over this ROW vacation. The northern 40 feet of the Ocoee portion of Wofford Road (Parcel 2) should not be vacated in order to accommodate the future widening of Story Road. RECOMMENDA nON: Staff recommends the Mayor and City Commissioners adopt a resolution abandoning and vacating with public right-of-way for Wofford Road between the southern right-of-way of Story Road and the right-of-way for the Western Beltway/SR 429 subject to the following conditions: . WHEREAS, the City Commission of the City of Ocoee desires to abandon and vacate that portion of Wofford Road, a sixty (60) foot wide public right of way, lying within the City of Ocoee and lying between forty (40) feet south of the southerly right of way line of Story Road and the northeasterly right of way line of the Western Beltway (S.R. 429), said right of way lying and being in Section 18, Township 22 South, Range 28 East, Orange County, Florida, a legal .1 description of such right of way to be abandoned and vacated is attached hereto as Exhibit" A" and by this reference made a part hereof (the "Roadway"); and WHEREAS, the City Commission of the City of Ocoee desires to reserve a public utility easement over, under and/or upon the Roadway in connection with existing or future utility facilities as well as the right of ingress and egress in, over, under and/or upon the Roadway for the purpose of maintaining said utilities and any other utilities which may now or hereafter be located in, over, under and/or upon the Roadway; and WHEREAS, the applicant has complied with the provisions of Section 153-10 of the Code of the City of Ocoee regarding the provision of certain information in connection with the application; and WHEREAS, pursuant to Section 153-13(D)(1) of the Code of the City of Ocoee, a Notice of Public Hearing before the City Commission was provided by regular mail to owners of real property abutting the Roadway and all owners of the property within three hundred (300) feet in all directions of the Roadway; and WHEREAS, pursuant to Section 153-13(D)(2) of the Code of the City of Ocoee, a Notice of Public Hearing was published one (1) time in a newspaper of general circulation in the City of Ocoee; and WHEREAS, pursuant to Section 153-(D)(3) of the Code of the City of Ocoee, a sign setting forth notice of the public hearing before the City Commission was posted upon the Roadway; and WHEREAS, the City Commission of the City of Ocoee finds that said application and supporting documents are in accordance with the requirements of Article II of -2- .1 Chapter 153 of the Code of the City ofOcoee and that the requested action is consistent with the City of Ocoee Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authoritv. The City Commission of the City of Ocoee has the authority to adopt this Resolution pursuant to Article VIII of the Constitution of the State of Florida, Chapter 166, Florida Statutes, and Article II of Chapter 153 of the Code of the City of Ocoee. SECTION 2. Abandonment and Vacation of the Roadwav. Subject to the provision of Section 3 set forth below, the City Commission of the City of Ocoee, Florida, hereby abandons, vacates and renounces any rights in and to the Roadway. SECTION 3. Reservation of Public Utilitv Easement. The City of Ocoee hereby reserves a public utility easement over, under and/or upon the Roadway in connection with any existing or future utility extensions that may be located in the Roadway and any other utilities which may now or hereafter be located in, over under and/or upon the Roadway; provided, further, that the reserved utility easement shall also reserve unto the City and public utility companies, including their successors and assigns, the right of ingress and egress to and from the Roadway for the purpose of maintaining said utilities and any other utilities which may now or hereafter be located in, over, under and/or upon the Roadway. SECTION 4. Recordation. A certified copy of this Resolution shall be filed with the Orange County Comptroller and duly recorded among the Public Records of Orange County, Florida. -3- .1 SECTION 5. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto.
