Background Summary:
The Old Winter Garden Road/Professional Parkway project included upgrades to the Orange
County Utility system, addition of a reuse system, and improvements to the existing utilities and
stormwater systems within the road project limits. Change Order NO.2 includes eleven changes to
the Orange County Utility system, three changes to reuse system, and five changes to the overall
road project. Details of the proposed changes are included in the attached copy of the Change
Order NO.2. The amount of the change order is an increase of $56,228.14, with no adjustment in
contract time.
Issue:
The Engineering -Public Utilities Department has proposed changes to the Old Winter Garden
Road/Professional Parkway project to and requests that the City Commission approve Change
Order no. 2 with Prime Construction Group, Inc. in the amount of an increase of $56,228.14, with
no adjustment in contract time.
Recommendations
The Engineering - Public Utilities Department recommends that the City Commission approve
Change Order No. 2 for the additional work and increase the construction contract by $56,228.14,
with no adjustment in contract time, and authorize the Mayor and City Clerk to execute the change
order.

Financial Impact:
This change order will be funded in part by Orange County Utilities ($16,922.00), Orange County
Public Works ($4,009.95), and funds from the Ocoee Utility Bond Issue ($33,269,78), and Ocoee
Transportation Bond Issue ($2,026.41).

ISSUE
The Engineering -Public Utilities Department requests that the City Commission approve Change Order no. 2
with Prime Construction Group, Inc, on the Old Winter Garden Road/Professional Parkway project in the
amount of a reduction of $56,228.14, with no adjustment in contract time.
BACKGROUNDIDISCUSSION
The Old Winter Garden Road/Professional Parkway project will widen these roads to a four lane divided section
and realign the intersection of Bluford Avenue from a "wye" intersection to a signalized "cross" intersection.
The project also includes relocation of underground utilities within the roadway right-of-way, All of the
utilities in the area are affected and require some amount of relocation.
Change Order NO.2 includes adjustments and additions for the work being performed for Orange County
Utilities, Ocoee Utilities, and as part of the joint venture Ocoee/Orange County roadway widening project. The
Orange County Utilities work is being performed under a JP A Agreement, between both parties, and is funded
totally by Orange County Utilities. The roadway widening project is being performed under a JP A Agreement
and the funding is spelled out in that agreement. Ocoee Utilities is funding its work.
The first 11 items on the change order involve additions of fittings, pipe, and services and the removal of an
existing fire hydrant to the Orange County Utilities portion of this project. All of these changes have been
approved by Orange County Utilities and the reimbursement will be forwarded upon transmittal of the approved
change order to Orange County Utilities.
The changes to the road widening project are covered in items 2-12 to 2-15, inclusive, The changes involve
addition of Bahai sod, which was not included in the original bid, and the deletion of the same amount of St.
Augustine sod. This areas where the sod has been changed are areas that will not receive irrigation. Item 2-14
involved extra work associated with conflicts with an Ocoee water main and its thrust restraint. The water main
and representative work was under Old Winter Garden Road and required night time construction in order to
close the road. The water main was not where it was shown and the thrust restraint was a massive concrete
obstruction. The work required that the water main be moved and the concrete thrust block be removed. Item
2-15 involves the placement of temporary striping at the intersection of Old Winter Garden Road and
Professional Parkway to aide in traffic control.
Items 2-16 to 2-18 involve changes to the Ocoee utilities being installed as a part of this project. All three items
are on the reuse system. They involve connections to the Wal-Mart outside irrigation, Oak Forest Apartments
phase 2, and extending the reuse system to serve the Citrus Medical and Office Complex. Wal-Mart and Oak
Forest Apartments phase 2 are currently using potable water for irrigation and changing over to reuse water will
help Ocoee reduce potable water production to meet its CUP permit. Citrus Medical will be a new customer.
Item 2-19 is an adjustment in a substantial completion requirement for the temporary traffic signal at
Blackwood and Old Winter Garden Roads. The delay was due to the three hurricanes in august and September.
There is no cost for this delay.
The change order is attached for review.

This change order is necessary to cover changes in the work to be performed under this
Contract. The GENERAL CONDITION, SUPPLEMENTARY CONDITIONS,
SPECIFICATIONS and all parts of the Project Manual listed in Article 1, Definitions, of

x 4" reducer, 4" GV, 4" cap and miscellaneous DI RW pipe (with restraint).
2-17 Furnish and install RW service at STA 138+50 to east section of Oak Forest
Apartments. Work includes 6" wet tap and valve to 16" RWM, 6" cap and 130'\7'
of 6" DI RW pipe (with restraints).
2-18 Modify RWM at Blackwood increasing size from 4" to 6", provide 2" RW service
to median of Blackwood south of Old Winter Garden Road and extend 6" RWM
from STA 143+00 to STA 149+00, right. Work includes 16" x 6" tee, 2-6" GV's,
2-6" 450 bends, 2-6" 900 bends, 1-6" 11.50 bend, 6" x4" tee, 4" x 2" reducer, 875'
of 6" DI RWM and 2" RW service (130' of 2" HDPE piping with curb stop and
box) (with restraint). Cost includes providing deleted 4" DI RWM pipe, valves
and fittings to the City for storage/use.

A. Orange County Utilities (OCU) JPA Changes
2-1 through 2-8 RFP No. 001 was issued on December 7, 2004. Contractor's CPS
was received on December 10, 2004. Final quantity and cost
negotiations on December 22,2004.
2-9 Contractor's proposed removal cost on November 17, 2004. OCU
accepted proposed cost on December 22, 2004.
2-10 Contractor proposed using established City of Ocoee unit price for
potable water service for OCU potable water service. OCU verbal
acceptance addressed with PEC on January 27,2004.

City of Ocoee unit price for 6" DI WM.

CitylPEC requested Bahia sod unit cost during project progress
meeting NO.5. Contractor proposed unit cost of Bahia sod at $1.48/sy.
Same results in decrease quantity adjustment for St. Augustine sod by
9,134 SY at $3.00/sy. Total decrease adjustment for St. Augustine sod
at $27,402.00. Contractor's proposal appears reasonable and is
hereby recommended for acceptance by Engineer (PEC, Inc.).

Contractor submitted request for compensation for additional work on
January 26,2005 at a total cost of $17,128.04. No extension of time
requested. Same appears reasonable and is hereby recommended for
acceptance by Engineer (PEC, Inc.).

VI. APPROVAL AND CHANGE AUTHORIZATION
This proposed change to the Contract is to be approved by the Ocoee City Commission.
Acknowledgments:
The aforementioned change, and work affected thereby, is subject to all provisions of the original contract
not specifically changed by this Change Order; and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on the
original contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments
in Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all
costs and modifications of performance time incurred by the CONTRACTOR as a result of this Change
Order. No other claim for increased costs of performance or modifications of time will be granted by the
OWNER for the Work covered by this Change Order. The CONTRACTOR hereby waives and releases any
further claims for cost or time against the OWNER arising from or relating to the matters or Work set forth or
