Background Summary:
The Grace Community of Faith Church site includes about 6.92 acres of land and is located at 8900 Old
Silver Star Road southwest of the intersection of Silver Star Road and Old Silver Star Road and east of
Johio Shores Road. The Applicant proposes a 20,373 square feet multi-purpose building and the associated
parking spaces for a church use in Phase I and an additional sanctuary (13,743 square feet) and a chapel
(2,750 square feet) with additional parking spaces for Phase II.

Recommendations:
Based on the recommendation of the DRC and the Planning & Zoning Commission, Staff respectfully
recommends that the Mayor and City Commissioners approve the Preliminary Site Plan for Grace
Community of Faith Church, as date stamped received by the City on February 3, 2005, subject to City
Commission approval of the requested Annexation, Initial Zoning and Special Exception to allow for a church
facility subject to the conditions identified in the Staff Report.

Grace Community of Faith Church?
BACKGROUNDIDISCUSSION
The Grace Community of Faith Church site includes about 6.92 acres of land and is situated on the
southern-most portion of an existing Orange County enclave. Specifically, the subject property is located
at 8900 Old Silver Star Road southwest of the intersection of Silver Star Road and Old Silver Star Road
and east of Johio Shores Road. The abutting properties of the subject site are mostly comprised of single-
family residential subdivisions. The surrounding properties to the south, east and west have City R-IA or
R-IAA residential zoning and to the north is unincorporated Orange County R-CE residential zoning.
Finally, there is also a portion of an adjacent property to the extreme southwest (on Silver Star Road),
which is currently used for a retention pond. The subject property is currently undeveloped and mostly
covered with pine trees.
Grace Community of Faith Church has submitted a Preliminary Site Plan for approval of a church with
associated buildings. The proposed uses on the site will ultimately include a sanctuary (13,743 square
feet), a multi-purpose building (20,373 square feet) and a chapel (2,750 square feet). As a result, the
church complex will consist at build-out of (3) three one-story buildings. Additionally, as shown on the
PSP, the church anticipates building its facilities in two phases. Phase 1 of the development will consist
of the construction for the Multi-Purpose building and associated (parking, landscaping, utilities etc.)
infrastructure. The Multi-Purpose building is designed to have a maximum height of 32+/- feet with a
drive-thru canopy. Phase 2 will consist of the remaining buildings with their associated infrastructure.
Commencement of a "new" traffic study will occur at that time to assess traffic operations, concurrency
and anticipated off-site improvements. This approval of the large-scale site plan (master plan) will enable
the church to submit small-scale site plans for each phase of the project over time. Small-scale site plans
are processed administratively by staff only.
The subject site will have primary access from Johio Shores Road and secondary access from Old Silver
Star Road. To expand the current substandard right-of-way along Old Silver Star Road, 10 feet of
additional right-of-way will be granted by the applicant. Additional right-of-way along Johio Shores
Road will also be dedicated to the City in order to be consistent with buffer width requirements. In order
to facilitate pedestrian travel, 6 feet wide sidewalks along public right-of-way have been proposed. The
preliminary site plan meets with adopted requirements of the Land Development Code including
setbacks, landscaping and parking requirements.
The subject property is designated "Low Density Residential" on the Joint Planning Area (JPA) Future
Land Use Map. The applicant has, concurrently, requested annexation and initial zoning with a special
exception to allow for a church facility. These requests are consistent with the JPA Land Use Map
designation. Therefore, the requested Preliminary Site Plan will be consistent with directives of the
Comprehensive Plan and the adopted Land Development Code (LDC), which would permit development
and construction of the proposed land use.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC) met on January 26, 2005 and reviewed the Preliminary Site
Plan. There were several minor technical issues to be addressed from the Planning and Engineering
departments that were identified in written staff comments and presented verbally. All of the issues were
discussed and a few minor changes to the Plan were agreed upon.
When the discussion was finished, the DRC voted unanimously to recommend approval of the
Preliminary Site Plan, subject to the developer making changes specified in the reports. These changes
were made and shown on the plans date stamped received February 3,2005.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
On February 8, 2005, the Planning & Zoning Commission held a public hearing to consider the proposed
Preliminary Site Plan for Grace Community of Faith Church. The City Staff and the Applicant of the
project answered extensive questions regarding potential uses of the site, parking, access, traffic issues,
corner visibility, and landscape buffers. Citizens from the audience raised concerns about the proposed
secondary access on Old Silver Star Road, including a privacy wall on Old Silver Star Road, the
architectural look of the building, handling projected overflow parking, and existing traffic issues on
Silver Star and Johio Shores.
The P&Z Commission suggested that the applicant should increase of height of the proposed shrubs to
buffer the residential use from the institutional use. The P&Z Commission also suggested architectural
details to soften the look of the building, which would include a minimum architectural standard of a
stucco exterior finish for the buildings. In order to prevent parking overflow, the P&Z Commission
reinforced the parking requirements in order to limit church seating. Therefore, the P&Z Commission
suggested a parking ratio of no less than one (1) parking space for every four (4) seats on the site, which
would in turn limit the building capacity to roughly 400 seats.
To address the traffic concerns, the Planning & Zoning Commission concluded that, at a minimum, a
right turn lane on Silver Star Road and Johio Shores Road would be needed to accommodate the
proposed development and existing traffic conditions. Staff explained that the applicant is not responsible
for all of the suggested improvements since the traffic issue is an existing condition. Staff, additionally,
explained that a proportionate fair share would need to be further analyzed in order to facilitate this
request. However, right-of-way dedication for future turn lanes and minor intersection modification
would be appropriate for Phase 1 of the development.
After finishing its deliberations, the Planning & Zoning Commission voted unanimously to recommend
approval of for Grace Community of Faith Church Preliminary Site Plan, as date stamped received by the
City on February 3, 2005, subject to City Commission approval of the requested Annexation, Initial
Zoning and Special Exception to allow for a church facility and with the following conditions:
I) A) Right-of-way on Silver Star Road and Johio Shores Road to be dedicated for future turn lanes
prior to Phase 1 FSP approval; B) Additional traffic analysis to implement minimum radii
improvements at the intersection of Silver Star Road and Johio Shores Road for Phase I FSP
Approval;
2) The facilities will be limited to four (4) seats for every parking space available;
3) Architectural details to soften the buildings; therefore, minimum architectural standard of stucco
exterior finish (no metal or metal clad buildings);
4) Substituted shrub height along Old Silver Star Road and Johio Shores Road from 24" to 36."
STAFF RECOMMENDATION:
Based on the recommendation of the DRC and the Planning & Zoning Commission, Staff respectfully
recommends that the Mayor and City Commissioners approve the Preliminary Site Plan for Grace
Community of Faith Church, as date stamped received by the City on February 3, 2005, subject to City
Commission approval of the requested Annexation, Initial Zoning and Special Exception to allow for a
church facility and with the following conditions:
1. Condition of Approval No. 21 located on Sheet 3 of the Preliminary Site Plan for Grace
Community of Faith Church to be revised to read as follows:
The Developer/Applicant shall, prior to Final Site Plan approval for Phase 1, dedicate
and convey additional road right-of-way along Johio Shores Road and Silver Star Road
to the City by warranty deed free and clear of all liens and encumbrances except for
those matters acceptable to the City. The form of the warranty deed shall be subject to
the approval of the City. The Owner shall, contemporaneously with the dedication and
conveyance of the property, provide to the City a current attorney's opinion oftitle or a
current title commitment to be followed by a policy of title insurance, evidencing that
fee simple title to the property is free and clear of all liens and encumbrances except for
those matters acceptable to the City. The costs and expenses related to the conveyance
and dedication of the property, including the cost of title work, shall be borne solely by
the Owner. Real property taxes on the property shall be prorated as of the day of the
City's acceptance of the conveyance of the same, and the prorated amount of such real
property taxes attributable to the Owner shall be paid and escrowed by the Owner in
accordance with the provisions of Section 196.295, Florida Statutes; provided, however,
that if the conveyance occurs between November I and December 31, then the Owner
shall be responsible for real property taxes for the entire year. Neither the Owner, its
successors and assigns, nor any other person or entity shall be entitled to any road
impact fee credits or other compensation of any kind for, on account of, or with respect
to the required conveyance of the property. The exact dimensions of said right-of-way
conveyances shall be determined as part of FSP review.
2. The following new Conditions of Approval to be added to Sheet 3 of the Preliminary Site Plan for
Grace Community of Faith Church:
a. The Developer! Applicant shall undertake additional traffic analysis to implement minimum
radii improvements at the intersection of Silver Star Road and Johio Shores Road as part of
the Phase 1 FSP;
b. The facilities will be limited to four (4) seats for every parking space available;
c. The buildings shall be constructed with a minimum architectural standard of exterior stucco
finish. Metal or metal clad buildings are prohibited;
d. Shrubs located along Old Silver Star Road and Johio Shores Road shall have a height of no
less than 36 inches.
