Background Summary: The Towns of Westyn Bay includes approximately 18.3 acres and is located on the north side of Ocoee Crown Point Parkway, west of its intersection with Ocoee Apopka Road. The subject property is proposed to be developed with 172 fee-simple town home units. The City Commission originally approved the Final Subdivision Plan on April 20, 2004, with conditions. At the Pre-Construction meeting with staff on August 11, 2004, the developer had revised the layout of the plan due to resizing of the retention ponds per St. John's River Water Management District (SJRWMD). This resulted in the relocation of two town home buildings. Because these changes were viewed as a substantial change to the approved plan, it was requested by staff during the Pre-Construction meeting that the developer submit these changes as an amendment to the Final Subdivision Plan. Issue: Should the Mayor and City Commissioners approve an amendment to the Final Subdivision Plan for the Towns of Westyn Bay? BACKGROUNDIDISCUSSION The Towns of Westyn Bay includes approximately 18.3 acres and is located on the north side of Ocoee Crown Point Parkway, west of its intersection with Ocoee Apopka Road. The property is bounded to the west and north by the single family portion of Westyn Bay and the Vineyards single family subdivision, both with R- IAA zoning; bounded to the east by Ocoee Apopka Road and bounded to the south by Ocoee Crown Point Road. The subject property was included as part of the overall Westyn Bay Preliminary Subdivision Plan and was designated as a future multi-family development with R-3 zoning. The property is currently under construction. The Towns of Westyn Bay development is a gated community with a single entrance onto Ocoee Crown Point Parkway. The development program calls for a total of 172 fee-simple townhome units, with a density of 9.38 units per acre. The townhomes will not have an individual homeowner's association (HOA), but will be included in the overall Westyn Bay master HOA. Recreation facilities for the residents are proposed, but meeting space will be shared at the main recreation complex for the Westyn Bay subdivision. To provide for pedestrian linkage, a pedestrian gated connection is provided for access to Westyn Bay Boulevard from the townhome development. A 6' high buffer wall with landscaping is provided between the townhomes and the two adjacent single family subdivisions and is being constructed along Ocoee Apopka Road and Ocoee Crown Point Parkway to match the existing wall and landscaping provided for Westyn Bay. The City Commission originally approved the Final Subdivision Plan on April 20, 2004, with conditions. DEVELOPMENT REVIEW COMMMITTEE (DRC) RECOMMENDATION The amendment to the Final Subdivision Plan for the Towns of Westyn Bay was reviewed by the DRC on February 23,2005. There were a few minor issues discussed related to the landscaping at the pool and details on the pool fence. The developer presented revised landscape plans with the changes, which will be incorporated into the overall amended Final Subdivision Plan. The Committee voted unanimously to recommend approval of the amended Final Subdivision Plan. ST AFF RECOMMENDATION Based on the recommendation of the DRC, staff respectfully recommends that the Mayor and the City Commissioners approve the amended Final Subdivision Plan for the Towns of Westyn Bay, as date stamped received by the City of March 3, 2005. All construction is to conform with City of Ocoee standards and specifications, unless otherwise waived by the County Engineer. 2. The Engineer certifies that all roadways were designed to the applicable standards, as set forth by City of Ocoee and the latest edition of the Florida Department of Transportation Manual of Uniform Standards for Design, Construction, and Maintenance for Streets and Highways. 3. The Contractor shall coordinate all work within existing road right-of-ways with City of Ocoee and the Florida Department of Transportation. 4. It will be the responsibility of the Contractor to get the necessary Right -of -Way Permit(s) and provide for the safety and control of local traffic during construction. 5. The Contractor shall be extremely cautious when working near trees that are to be saved, whether shown in the plans or designated in the field. 6. The Contractor shall be responsible for locating and verifying (horizontally and vertically) all existing utilities before construction, and for notifying the various utility companies to arrange for any relocation, temporary disruption of service, or clarification of activity regarding said utility. The contractor shall exercise caution when crossing an underground utility, whether shown in these plans or field located. All utilities which interfere with the proposed construction shall be relocated by the respective utility companies and the Contractor shall cooperate with them during relocation operations. Any delay or inconvenience of the various utilities shall be incidental to the contract and no extra compensation will be allowed. 7. The locations of all existing utilities, facilities, and any other features shown on these plans have been determined from the best available information and are provided for the convenience of the Contractor. The Engineer does not guarantee the accuracy or the completeness of the location information provided. Any inaccuracy or omission in such information shall not relieve the Contractor of his responsibility to protect such existing features from damage or unscheduled interruption of service. Should a discrepancy arise between these plans and actual field conditions which would appreciably affect the execution of these plans, the Contractor will halt construction and notify the Engineer immediately. 8. The Contractor shall be responsible for meeting all inspection criteria and schedules, and for signing for said inspections. 9. Water and wastewater service shall be provided by Orange County. The water distribution system and wastewater collection system shall be installed by the Contractor and shall conform with Orange County Manual of Standards and Specifications for Wastewater and Water Main Construction. 10. The electrical distribution system is to be designed and installed by the electrical power utility. The Contractor will coordinate scheduling with the electrical power utility to ensure proper construction phasing, and to allow the utility to install street crossings and other required sleeves. 11. Completely sod detention ponds to two (2) feet below normal water level. 12. The Contractor shall not excavate, remove, or otherwise disturb any material, structure, or part of a structure which is located outside the lines, grades or grading sections established for this project, except where such excavation or removal is provided for in the contract, plans or specifications. 13. All work and all materials furnished shall conform with the lines, grades, grading sections, cross sections, dimensions, material requirement, and testing requirements specified in the contract, plans or specifications. 14. Prior to commencing work, the Contractor shall furnish, erect, and maintain all barricades, warning signs, and markings for hazards and the control of traffic, in conformity with the Manual of Uniform Traffic Control Devices for Streets and Highways or as directed by the City of Ocoee Traffic Engineer, to effectively prevent accidents in all places where the work causes obstruction to traffic or constitutes in any way a hazard to the public. 15. All ductile iron pipe and fittings shall have an interior protective seal coat (30 mil thick) of coal tar epoxy in accordance with ANSI/AVWVA A21.51/C151. 16. Compact all utility trenches within the top two (2) feet of the roadways to 98% of the Modified Proctor Maximum Density, and to 95% within other areas. 17. After the roadway has been constructed to subgrade, it shall be proof -rolled to assure that proper compaction has been attained. The proof -rolling and compaction operations shall be inspected and tested by a Florida licensed Soils Engineer to assure that the specified compaction is maintained and all deleterious materials have been removed. 18. In areas which require fill material, the Contractor will strip or otherwise remove all vegetation such as brush, heavy sods, heavy growth of grass, decayed vegetable matter, rubbish, and any other deleterious material before the embankment is started. Immediately prior to the placing of fill materials, the entire area being filled shall be scarified in a direction approximately parallel to the axis of fill. The Geotechnical Engineer shall approve the area prior to the placement of fill. 19. Telephone system will be designed and installed by telephone utility. The Contractor will coordinate scheduling with the telephone utility to ensure proper construction phasing, and to allow the utility to install street crossings and other required sleeves. 20. Install valve boxes with all valves. Valve boxes under pavement shall have traffic -bearing covers. 21. The Contractor shall be responsible for the maintenance of all landscape buffers, retention and detention facilities until the work has been accepted by the Owner. All disturbed areas shall be returned to their original condition. 22. The Contractor shall comply with all legal load restrictions in the hauling of materials in public roads beyond the limits of the work_ A special permit will not relieve the Contractor of liability for the damage that may result from the moving of material and equipment. 23. The Contractor shall familiarize himself with the policies and guidelines established by City of Ocoee, Florida for the preservation of all public and private property. The Contractor shall be responsible for all damage or injury to property of any character during the execution of the work, resulting from any act, omission, neglect, or misconduct in his manner or method of executing the work, or at anytime due to defective work or materials. 24. Gravity sanitary sewer to be PVC S.D.R. 35 OR S.D.R. 26. 25. Force mains are to have a minimum of 36" of cover. Force mains shall be PVC AWWA C900 (minimum DR25). Metallic tape shall be placed over the main at depth of two (2) feet below the surface, and tied into valve boxes. 26. Fire protection shall be provided according to City of Ocoee Regulations. 27. The Contractor shall ensure that proper soil densities are achieved for placement of all headwall/ endwall footings, retaining wall footings, and in general, any footing support described on these plans. It will also be the responsibility of the Contractor to ensure that sufficient geotechnical testing has been performed prior to construction. 28. The F.D.O.T. Roadway and Traffic Design Standards (booklet dated January 1994) is to be used for drainage structures and pavement markings. 29. Water and Sewer: a. Water mains shall be laid to provide a minimum separation of 18 inches between the bottom of the water main and the top of the sewer pipe. Where water and gravity sanitary sewer mains cross with less than 18 inches vertical separation, or the sanitary sewer main is above the water main, the sanitary sewer shall be constructed of 20 feet of PVC pipe upgraded to water main standards, centered on the point of crossing, and pressure tested. If the conflict is caused by a storm sewer, the water main shall constructed of 20 feet of ductile iron pipe centered on the point point of crossing. Adequate structural support for both the water main and sewers shall be provided to prevent excessive deflection of joints and settling. b. When a water main parallels a gravity sanitary sewer main, a separation (measured edge to edge) of at least 10 feet shall be maintained. Where this separation is not met, one of the following must occur: (1). The water main is laid in a separate trench or on an undisturbed earth shelf located on one side of the sewer at such an elevation that the bottom of the water main is at least 18 inches above of the sewer. (2). If both sanitary sewer and potable water mains are proposed and the above 28b(1) is not met, the sanitary sewer pipes shall be upgraded to the DR -18 PVC and pressure tested. (3). If the sanitary sewer is existing and the potable water main is proposed, the water main shall, at a minimum, be upgraded to ductile iron pipe, constructed in separate trenches, laid at a higher elevation than the sanitary sewer, and utilize staggered joints. c. Where water mains parallel storm sewer pipes with less than 10 feet horizontal clearance, the water main shall be AWWA C150/C151 ductile iron in those locations. d. Reuse water mains shall maintain a five (5) foot (center to center) separation, or three (3) feet edge to edge, from potable water mains and storm sewer lines. This only applies to unrestricted access reuse water. e. Where ductile iron pipe is required for water mains, it shall conform to ANSI/AWWA A21.51. A minimum thickness of Class 50 per ANSI/AWWA shall be supplied. f. All water main fittings, valves, restraints, couplings, pipe, and in general those materials required for installing the water supply system, shall comply with minimum material standards, ratings and classifications established by the Orange County and AWWA Standards and Specifications. PVC water mains four (4) inches diameter or greater shall be AWWA C-900 (DR18) minimum. All PVC pipe greater than 12 inches must be in accordance with AMA C-905. All water mains shall bear the NSF logo for approval for drinking water. g. Water main connections shall be made under the supervision of Orange County Public Utilities. All valves shall be operated by Orange County personnel only. Water mains are to be disinfected per ANSI/AW`NA C651-92 and Orange County Public Utilities standards and specifications for wastewater and water main construction which includes a full diameter flush. All water mains shall be hydrostatically tested in accordance with the latest version of AWWA standards C600 for ductile iron pipe and C905 for PVC. h. All sanitary lines (either gravity or pressure systems), fittings, valves, restraints, couplings, pipe, and in general those materials required for installing the wastewater collection system shall comply with the minimum material standards, ratings and classifications established by Orange County Public Utilities Division. Metallic marking of utility lines shall comply with Orange County standards and specifications for wastewater and water main construction. Air release valves shall be installed in high points in the main only as designated on the plans, and shall be installed in vaults with traffic -bearing lids. Pressure testing of gravity sewer lines shall be in accordance with Orange County standards, and with the latest Uni-Bell low pressure air test standard. All force mains shall be hydrostatically tested with a minimum test pressure of 100 psi for two (2) hours. Pressure testing of force shall be comply with Orange County standards and specifications. 30. Mitered end sections are included in all stormwater pipe lengths. 31. All Reinforced Concrete Pipe (RCP) shall be minimum Class III. 32. It is the Contractor's responsibility to obtain a copy of the Geotechnical Engineer's report for this project from GTC Engineering Corporation and meet the Geotechnical Engineer's requirements for soil preparation on the site. The Contractor's Geotechnical Engineer shall certify all site, utility, and roadway compaction as well as underdrain and pavement construction to GTC Engineering Corporation. Geotechnical recommendations are not the responsibility of GTC Engineering Corporation. GTC Engineering Corporation has relied on the geotechnical report in the preparation of the plans. Any conflict between information within the report and these plans shall be reported to the Engineer and/or Owner. GTC Engineering Corporation assumes no responsibility for the correctness, completeness. or accuracy of the geotechnical information. 33. During construction, no direct discharge of water will be allowed to downstream receiving waters. The Contractor is responsible for water quality and shall route discharges in such a manner to adequately remove silt before runoff from the site. 34. For sign details, refer to the "Manual on Uniform Traffic Control Devices," published by the U.S. Department of Transportation, Federal Highway Administration -1978 (ANSI D6.1- 1983). All signs to be single mounted according to F.D.O.T. Index No. 11862 (70 mph wind loading) and F.D.O.T. Index No. 17302. 35. Blue reflective pavement markers shall be placed in the center of the driving lane in front of all Fire Hydrants. 36. Erosion Control Notes a. Provide effective temporary and permanent erosion control following the requirements in Section 104 of the State of Florida Department of Transportation Standard Specifications for Road and Bridge Construction, 1992 Edition (FDOT Section 104). b. Control features, methods and conditions included in this contract include the following as indicated by X in blank: (1) X Coordinate construction of temporary erosion control features with permanent erosion control features. (2) X Control operation which result in water pollution (FDOT Section 104-3). (3) X Provide schedule for clearing and grubbing, earthwork operations and construction of permanent erosion control features and proposed use of temporary erosion control features (FDOT Section 104-5). The Contractor is to submit an erosion control plan to the City of Ocoee Engineer for approval prior to the preconstruction meeting for this project. d. During construction, the Contractor is to install a turbidity screen along areas abutting the conservation area. e. The Contractor is responsible for maintaining all erosion protection, especially along the wetland boundary during the entire construction process, including repairs, etc., to prevent any siltation from entering these areas, as well as any unsuitable discharges offsite or into the existing wetland. 37. Miscellaneous Engineer Notifications a. The Contractor shall provide the Engineer 48 hour advance notification for the following construction and inspection activities: (1) Sanitary sewer lamping, low pressure air testing, and T.V. Inspection. (2) Connections to existing systems. (3) Thrust block pours and restraint connections. (4) Storm drain lamping. (5) Inlet top pours (reinforcing steel check). (6) Water and force main pressure tests. (7) Bacteriological sampling. (8) Base observation and sounding. (9) Asphalt placement. (10) Pre -final inspection. (11) Final inspection. b. The Contractor shall keep DAILY "As -built" drawings employing the criteria shown on the Paving and Drainage, Sanitary and Water Detail sheets. Record all As-builts in waterproof RED ink. c. Before the start of construction, the Contractor shall prepare and submit to the Engineer a project construction schedule (Bar Graph) and update the schedule monthly. d. Any fuel storage areas shall have owner's prior approval and appropriate measures shall be taken to ensure protection of groundwater and soil resources. e. The Contractor shall coordinate all backfill operations with the Resident Geotechnical Engineer and submit test reports to the Engineer prior to beginning work on the next item of work. f. The Engineer reserves the right to require the Contractor to perform any action necessary to ensure that the improvements have been constructed in accordance with the plans and specifications. g. The Contractor shall provide GTC with a copy of the sanitary sewer T.V. results. 38. Although all existing utilities have been field verified, the Contractor shall field verify horizontal and vertical information for all connection points to existing utility systems, as well as the location and depth of all clusters of fittings and valves, before submittal of shop drawings. 39. Any sanitary sewer built for phasing of the project shall have a 10 -foot stabilized access road over the line and be constructed to and including the next manhole with a 20 -foot utility easement centered over the pipe and manhole. 40. Any discrepancy between the dimensions and measurements shown on the plans and the actual field conditions shall immediately be brought to the Engineer's attention. Failure to do so shall make the Contractor completely liable for whatever errors and/or problems that may subsequently arise. 41. It will be the responsibility of the Contractor(s) to ensure that all required permits are obtained and are in hand at the job site prior to the commencement of construction. Contractor shall abide by all conditions contained therein. Permits included (but not necessarily limited to) are: a. St. John's River Water Management District, Management and Storage of Surface Waters. b. FDEP water distribution and FDEP sewer collection. c. Local right-of-way use. d. Local underground utilities. 42. The Contractor shall stake all improvements using the plat. Contractor shall confirm with American Surveying And Mapping , Inc. (Phone 407-539-2274) that the plat is current prior to construction. It is the sole responsibility of the contractor to completely stake and check all improvements to ensure adequate positioning, both horizontal and vertical, including minimum building setbacks, before the installation of any improvement. 43. The Contractor shall be responsible for protecting all existing survey monumentation. Disturbed monumentation shall be restored by a Florida -licensed land surveyor selected by the Owner at the Contractor's expense. 44. The Contractor is responsible for grading all pavement areas to drain positively. Intersections shall be transitioned to provide smooth driving surfaces while maintaining positive drainage. Should areas of poor drainage be observed, the Contractor shall notify the Engineer prior to paving so that recommendations for correction may be made. 45. The quantities and lengths of materials shown on plans should be verified by the Contractor. Any discrepancy between callouts and actual shown in plan view is to be brought to the Engineer's attention by the Contractor prior to bidding. It is the Engineer's intention to build what is shown on the construction plans. 46. The Contractor is to maintain weekly monitoring reports per general conditions of N.P.D.E.S. General Permit. 47. Record Drawing: At the end of construction, the Contractor shall provide one (1) set of drawings showing ALL CHANGES marked in waterproof red with the following Contractor Certification executed on EACH SHEET: The Contractor hereby certifies to the OWNER that improvements covered by this drawing and the related details have been constructed as indicated or as modified by the notes and graphics shown. The Lift Station Tract has been dedicated to Orange County. 48. All storm water pipe joints will be wrapped with filter fabric in accordance with FDOT Index 280. 49. The existing overhead power lines running across the site, and any easements for electrical service will be removed and vacated, respectively, prior to issuing a Certificate of Completion for the subdivision improvements. 50_ Fire Hydrants shall be painted yellow per Ocoee City Code. 51. EMERGENCY WASTEWATER SPILL AND WATERMAIN BREAK PROCEDURES a1. Excavate Cautiously The contractor shall exercise extreme caution when excavating in proximity of wastewater gravity sewers. Sewer locations shown on plans are not exact or guaranteed. Contractor is responsible for field verifying existing utility locations. a2. Telephone Notification The Orange County dispatch operator shall be notified immediately in the event of a gravity sewer or water main break or damage at 407-836-2777. a3. Repair Immediately All damage to Orange County Public Utilities sewer mains or water mains shall be repaired immediately by the contractor at the contractor's expense. If the repair is not made in a timely manner, as determined by the Orange County Utilities Inspector, the County may perform repairs and the contractor will be charged for repairs. a4. All common areas will be owned and maintained by the homeowner's association. 3. Water and sewer service will be provided by Orange County. At the time of platting, easements will be placed over service lines and dedicated to Orange County. 4. Reclaimed water will be used for irrigation purposes. A master irrigation system will be installed to service all common areas and residential lots. This master system will be owned and maintained by the homeowner's association. 5. The project site contains no conservation areas 6. The project site contains no lands that lie within the 100 yr. flood prone area. 7. Roadways will be private and owned/maintained by the homeowner's association. 8. The stormwater system will be designed in conformance with the City of Ocoee and SJRWMD standards. All ponds and conveyance systems will be owned and maintained by the homeowner's association. Ponds will be unfenced. Side slopes will adhere to the City of Ocoee Land Development Code. 9. The project will be gated. Gates will be equipped with the opticom system for access by emergency vehicles. 10. A tree survey will not be required for this project. 11. Topography is based upon a survey provided by Sears Surveying. 12. Soils information is provided by the Orange County SCS. 13. The entire Property is subject to the terms and conditions of that certain Development Agreement dates June 5, 2001 recorded in Official Records Book 6289, Page 4193, Public Records of Orange County, Florida. 14. Each fire hydrant shall be OSHA yellow in color and blue reflective marker shall be affixed to the street in the center of the lane closest to the hydrant. 15. The project is a private community with a mandatory homeowners association owning and maintaining the private streets and drainage facilities. Prior to, or at the time of platting, an easement will be granted to all utility suppliers for ingress and egress over the private street tracts for access and maintenance of their utilities and to the City of Ocoee law enforcement and emergency personnel for ingress and egress to the property. 16. All landscape areas will be irrigated and have an automatic rain sensor. 17. Short-term rentals (rental term less the 6 months) shall be prohibited. This restriction shall be incorporated into the homeowner's association documents and shall also be enforced by the City. 18. The deed restrictions for the subdivision will include language requiring that garages must be used for parking cars and that parking will be prohibited on the private streets, except in designated off-street parking spaces. 19. No RV or boat parking will be provided within the subdivision. 20. Open space between townhome units, which is not part of an individual lot, shall be owned and maintained by the homeowners association. 21. All on-site utilities including electrical, cable TV and telephone shall be placed below ground. 22. All tracts, which are to be conveyed and maintained by the homeowners association, shall be conveyed to the homeowners association by plat. 23. Except as specifically noted on this plan, development of this property shall be consistent with the requirements of the City of Ocoee Code. 24. The City of Ocoee is subject to the terms, provisions and restrictions of Florida Statutes Chapter 163 concerning moratoria on the issuance of building permits under certain circumstances. The City has no lawful authority to exempt any private entity, or itself, from the application of such state legislation and nothing herein should be considered as such an exemption. 25. There shall be no access from the project to any public roads except at the approved locations shown on the plan. 26. Any damage caused to any public road as a result of the construction activities related to the project, shall be promptly be repaired by the Developer to the applicable government standards at the Developer's sole cost and expense. 27. A homeowners association will be created for maintenance and management of all common areas and facilities, unless otherwise noted. 28. The Towns of Westyn Bay will be a sub -association of the Westyn Bay Master Homeowners Association. The Westyn Bay recreation center and all of its facilities will be available for use by the residents of the Towns of Westyn Bay. On-site recreation areas within the Towns of Westyn Bay will be for the exclusive use of the residents of that community. 29. Pursuant to Ordinance No. 2001-18 all subdivision signage must be consistent with the legally assigned name of the subdivision. Any subsequent change to the name of the subdivision must be approved by the City Commission. 30. All building setbacks from all retention areas shall be 15 feet from top of bank. 31. The development will comply with Section 6-15 of the Ocoee Land Development Code. Where discrepancies occur between the PUD Land Use Plan and Section 6-15 of the LDC, the PUD Land Use Plan shall prevail. CONDITIONS OF APPROVAL 32. Intentionally Deleted 33. In the event gates are installed on the private roads the gates and subdivisions shall comply with Article VIII, Chapter 34 of the Orange County Code for gated communities as well as the amendments to that Article that may be enacted prior to the approval of the Preliminary Subdivision Plan. All references in said County Code Chapter to the "County" shall be deemed to refer to the "City" for purposes of this requirement. 34. Not withstanding the conveyance of the storm water retention pond to the homeowners association or any provision to the contrary contained in these Conditions of Approval, the Developer shall remain responsible for the maintenance of the project's stormwater management system (SWMS), including all stormwater retention ponds, until such time as: (i) the entire SWMS for the project is constructed and appropriate certificates of completion issued by both the City and SJRWMD, (ii) the stormwater retention ponds intended to be conveyed to the home owners association have in fact been conveyed to the homeowners association, (iii) the homeowners association is designated as the maintenance entity on the records of the SJRWMD and all transfer records required by SJRWMD have been executed and accepted by SJRWMD, (iv) the City has been provided with a copy of the Developer's proposed maintenance plan with respect to the SWMS, and (v) the City has been provided with a written statement from the homeowners association acknowledging receipt of the Developer's proposed maintenance plan with respect to the SWMS and that the homeowners association is responsible for maintenance of the SWMS. 35. The Declaration of Covenants, Conditions and Restrictions for the subdivision (the "Declaration") shall contain a provision allowing the City of Ocoee the opportunity to levy, collect and enforce assessments for maintenance of the common areas should the homeowners association fail to do so or should the homeowners association fail to collect assessments at a level allowing for adequate maintenance of the common areas. These rights will be consistent with and limited to rights granted with Article VIII, Chapter 34 of the Orange County Code. 36. The Declaration shall to contain a provision granting the City of Ocoee the right, but not the obligation, to repair and maintain the stormwater system should the homeowners association fail to do so and seek reimbursement from the homeowners association, or from the Developer if (i) turnover of control of the members has not occurred, or (ii) if the Developer is still responsible for the maintenance of the stormwater system. These rights will be consistent with and limited to rights granted with Article VIII, Chapter 34 of the Orange County Code. 37. The Declaration shall provide that the homeowners association shall at all times be in good standing with the Florida Secretary of State. 38. The Declaration shall contain a provision that at the time of turnover of control of the homeowners association to the members, the Declarant shall deliver to the new Board of Directors the maintenance plan for the stormwater system accompanied by an engineer's certification that the stormwater system is functioning in accordance with all approved plans and permits. To the extent that any such engineer's report indicates any corrective action is required, the Declarant shall be required to diligently undertake such corrective action at the Declarants expense and to post a cash bond with the homeowners association for the estimated cost of such corrective action. 39. The Declaration shall contain a provision that any amendment to any provision affecting the City of Ocoee requires the consent of the City of Ocoee in an instrument recorded with the amendment. 40. The Declaration shall contain a provision providing that the stormwater system will be transferred to a responsible operation and maintenance entity acceptable to the City of Ocoee in the event of the dissolution of the homeowners association and that if dissolution occurs without such approval then the City of Ocoee may continue to levy and collect assessments and impose liens with respect thereto notwithstanding the dissolution of the homeowners association. 41. The Declaration shall specifically provide that no property owned by the City of Ocoee or any other government entity within the subdivision shall be subject to assessments levied by the homeowners association. 42. Proposed Facilities within the recreation area Tract "F", shall be a pool, a cabana, and benches. 43. At all the corners and where otherwise applicable, sidewalks shall have access ramps constructed to accommodate those in wheelchairs and others who are physically challenged. 44. All screen walls, landscape buffers, all common area landscape improvements, as well as sidewalks along Ocoee -Apopka Road and Ocoee Crown Point Parkway, and along all other perimeter property lines shall be completed prior to issuance of the Certificate of Completion. 45. The landscape buffer tracts along Ocoee -Apopka Road and Ocoee Crown Point Parkway shall have, at a minimum, shade trees planted every 30 feet and shrubs planted along at least 25% of the length of the wall. Such landscaping shall include the same types of materials with the same pattern as was used along the Westyn Bay subdivision buffer wall adjacent to Ocoee Crown Point Parkway. The buffer wall shall be constructed at least 5 feet from the road right-of-way line. 46. Street trees shall be provided by the home builder at a rate of one tree per townhome unit prior to Certificate of Occupancy for each building. At least half of these street trees shall be shade trees, a minimum of 2" DBH and 10' tall at the time of planting. The remaining street trees shall be under -story trees as defined in the Land Development Code. 47. The plan shows available pad size for reference only. All underground utilities shall comply with Ordinance No. 95-17, which requires pedestal -mounted utility boxes to be placed back off the street, no more than 5 feet forward of the front building setback line, on all residential lots which are less than 70 feet in width where the lot abuts the street right-of-way line. 50. All legal instruments, including but not limited to homeowners association documents such as articles of incorporation, bylaws, and declaration of covenants and restrictions, shall be provided to the City for review and approval prior to or at the time of platting all or a portion of the property. 51.
