Background Summary:
The Old Winter Garden Road/Professional Parkway project will widen these roads to a four lane
divided section and realign the intersection of Bluford Avenue from a ''wye'' intersection to a
signalized "cross" intersection. The project also includes relocation of underground utilities within
the roadway right-of-way.
PEC, Inc. is providing Construction Administration Services for the project during construction. The
city had been providing the full time inspection services until Mr. Ron Winfrey left the City's
employment. Until such time as the City can hire another inspector to fill the vacant position, the
City has requested that PEC, Inc. provide the necessary personnel to cover the construction
inspection. PEC, Inc. has proposed to utilize the services of PSI, Inc., who is performing materials
testing on the project, to provide the resident inspection of the construction. Additionally, PEC, Inc.
has employed the services of Mr. Winfrey, as an outside consultant, to assist with any project
specific technical assistance. The amount of the change order is an increase of $26,968.39, with
no adjustment in contract time.
Issue:
The Engineering Department proposes to provide for resident inspection services, until such time
as the inspector position is filled, by increasing the services of Professional Engineering
Consultants, Inc. who are providing Construction Administration Services for the project.
Recommendations
The Engineering Department recommends that the City Commission approve Amendment No. 1 to
Addendum No. 02-01 to the Agreement For Consulting Engineering Services with Professional
Engineering Consultants, Inc. for the Professional Parkway/Old Winter Garden Road Bidding
Phase/Construction Administration Services in the not to exceed amount of $68,170.00 and
authorize the Mayor and City Clerk to execute the Amendment.

Financial Impact:
This Amendment to the Agreement for Consulting Services will be funded under the terms and
conditions of the JPA Agreement with Orange County. The percentage breakdown for shares of
the JPA Agreement are 66.43% ($45,285,33) Orange County and 33.57% ($22,884.67) Ocoee.
Any portion not covered by the vacant position wages and benefits would be covered by the project
contingency, which is covered by Transportation Impact Funds.

ISSUE
The Engineering Department requests that the City Commission approve Amendment No. 1 to Addendum No,
02-01 to the Agreement F or Consulting Engineering Services with Professional Engineering Consultants, Inc.
For the Professional Parkway/Old Winter Garden Road Project Bidding Phase/Construction Administration
Services on the Old Winter Garden RoadJProfessional Parkway project in the amount of a not to exceed
increase of $68,170.00 to cover construction inspection services.
BACKGROUNDIDISCUSSION
The Old Winter Garden RoadJProfessiona1 Parkway project will widen these roads to a four lane divided section

The project also includes relocation of underground utilities within the roadway right-of-way. PEC, Inc. is
providing Construction Administration Services for the project during construction. The city had been
providing the full time inspection services until Mr. Ron Winfrey left the City's employment.
Until such time as the City can hire another inspector to fill the vacant position, the City has requested that PEC,
Inc. provide the necessary personnel to cover the construction inspection. PEC, Inc. has proposed to utilize the
services ofPSL Inc., who is performing materials testing on the project, to provide the resident inspection of the
construction. Additionally, PEC, Inc. has employed the services of Mr. Winfrey, as an outside consultant, to
assist with any project specific technical assistance.
At such time as the City fills the vacant inspector position, the City will work the new inspector into the project
to take over the full time duties of the project. The position has been advertised, but it will be at least another
month before the City can expect to fill the position. If the Engineering Department transfers one its other
inspectors onto this project, then that will create a shortfall in performing inspections of development and City
CIP projects,
The negotiated cost for this work items was a not to exceed amount of $68,170.00, to be billed based upon
actual hours worked (time and materials concept). While this work was not budgeted, it can be covered by the
transfer of wages and benefits saved during the position being vacant and by the terms and conditions of the
JPA Agreement with Orange County. The percentage breakdown for shares of the JPA Agreement are 66.43%

AMENDMENT NO, 1 TO ADDENDUM NO, 02-01 TO
AGREEMENT FOR CONSULTING ENGINEERING SERVICES
INCLUDING
ENGINEERING SERVICES FOR
CITY OF OCOEE
PROFESSIONAL PARKWAY/OLD WINTER GARDEN ROAD
BIDDING PHASE/CONSTRUCTION ADMINISTRATION SERVICES
This Amendment NO.1 to Addendum No, 02-01 hereinafter called the Addendum, as of this _
day of 2005, shall constitute and Amendment to the Addendum to the Agreement
for Consulting Engineering Services between the City of Ocoee, Florida (the CITY) and
Professional Engineering Consultants, Inc., 200 East Robinson Street, Suite 1560, Lake Eola
Centre, Orlando, Florida (the CONSULTANT), dated the 21st day of August, 1984, hereinafter
referred to as the AGREEMENT,
WHEREAS, the CITY and CONSULTANT entered into an AGREEMENT whereby the CITY
retained the CONSULTANT to provide professional engineering services as required from time to
time, and WHEREAS the CONSULTANT will perform consulting engineering services for the CITY
as herein defined.
NOW THEREFORE, in consideration of the mutual covenants and promises hereinafter set forth
on the part of both parties to be kept and performed, the parties do mutually agree as follows:
Section 1 - Services of the Consultant
1,1 The CONSULTANT shall perform the Engineering Inspection Services as outlined in the
attached proposal (P-5337) dated September 14, 2005 relative to the provision of bidding
phase services and construction administration services to the CITY,
Section 2 - Compensation
2,1 Compensation by CITY for engineering services for Professional Parkway/Old Winter
Garden Road Bidding Phase and Construction Administration Services is provided under
this Addendum shall be computed under Paragraph 6.1.2,3 of the Agreement, utilizing the
Lump Sum Method of Compensation with the compensation for this authorization not-to-
exceed $68,170.00 as outlined in the attached proposal (P-5337) and man-hour fee,
Section 3 - Time of Completion
3.1 The CONSULTANT shall provide the bidding phase services and the construction
administration services within a 1-year period from the notice to proceed.

Dear Mr. Wheeler:
Professional Engineering Consultants, Inc, (PEC) is please to present the enclosed proposal for
construction phase inspection services concerning the widening of Old Winter Garden Road and
Professional Parkway,
PEC proposes to provide the construction phase inspection services for a total amount not to exceed
$68,170,00, It is noted that the City's agreement with Orange County will result in Orange County paying
for approximately 75% of the engineering service costs which would include these referenced service
costs, These costs should also be offset in part by present City budgeted Direct City Inspection Service
costs which would no longer be required,
As a component of our proposed construction inspection services, we have included subconsultant fees
for PSI, Inc, (full time roadway inspection services through the end of project phase 2), PEC will provide
part time on-site resident project representative services through the remainder of the project at an
estimated 12 hours per week,
The assumed contract period for construction of the remainder of the project through the end of Phase
2 construction and through the end of the project is 180 calendar days and 270 calendar days
respectively,
