Department Director: City Manager: Background Summary: Per Florida State Statutes 932.7055 "...any local law enforcement agency that acquires at least $15,000 pursuant to the Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less than 15 percent of such proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe neighborhood, or school resource officer program(s). Issue: Should the Honorable Mayor and Board of City Commissioners authorize the Police Department to expend and! or donate forfeiture funds to law enforcement related uses/ charities. Recommendations It is recommended that the Honorable Mayor and Board of City Commissioners authorize the Police Department to expend and! or donate forfeiture funds to law enforcement related uses/ charities as follows: $1500 to Central Florida Police Athletic League; $1500 to A Child Is Missing; $1500 to Orange County Sexual Assault Treatment Center; $1500 to Orange County Victim Services Center; $1500 to buy bicycle helmets; $2500 to Ocoee Police Explorers. Attachments: None Financial Impact: A total of$IO,OOO from the Police Forfeiture account. There is approximately $47,000 in this account. Goclon, Chief of Police DATE: September 12, 2005 RE: Approval to expend and! or donate forfeiture funds to law enforcement related usesl charities ISSUE Should the Honorable Mayor and Board of City Commissioners authorize the Police Department to expend and! or donate forfeiture funds to law enforcement related uses/ charities. BACKGROUNDIDISCUSSION Per Florida State Statutes 932.7055 "... any local law enforcement agency that acquires at least $15,000 pursuant to the Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less than 15 percent of such proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe neighborhood, or school resource officer program(s). The local law enforcement agency has the discretion to determine which program(s) will receive the designated proceeds." During fiscal year 04/05, the Police Department acquired at least $18,000 (15% of which would be $2,700). There is approximately $47,000 in the Police Forfeiture account. Because of the services they provide to the department and the community and because duplication of these programs by the Ocoee Police Department is not possible, the Ocoee Police Department recommends the following donations: $1500 to Central Florida Police Athletic League, a non-profit organization working with law enforcement that helps keep youth crime and drug free; $1500 to A Child Is Missing, a public/private partnership, devoted to assisting law enforcement in search and recovery efforts of missing children, elderly, and disabled persons and notifying the public about sexual predators; $1500 to the Orange County Sexual Assault Treatment Center; and $1500 to the Orange County Victim Services Center. The Ocoee Police Department would also like to expend $1500 to buy bicycle helmets to be given to children in need and $2500 to the Ocoee Police Explorers. Both ofthese are non-budgeted programs that depend upon fundraisers and donations. 1
