BACKGROUND/DISCUSSION The subject property is an abandoned warehouse/storage facility formally owned by West Orange Industries Inc and currently owned by Mary S. Costantino. TBCOM Properties, LLC (the Applicant) has proposed to demolish the existing structure and construct a telecommunications wireless facility utilizing a 165 feet high monopole tower. The Future Land Use classification for this entire property is "Commercial"; current zoning classification is Community Commercial (C-2). The property is also located on Area Three as designated on the (Map 5-19) Telecommunications Service Facility Location Map. The current zoning classifications and actual uses of parcels surrounding the subject property: Direction Zoning Classification Actual Use North C-2 Vacant East C-2 Ocoee Shopping Center (Parking Lot); U.S. Post Office South C-2 Water Retention Ditch; Office Warehouse Buildin s (Birket Engineering Inc.) West I C-2 J Vacant Other actual land uses in close proximity to the subject site worth mentioning; A manufactured home (Pioneer Key Park) subdivision is located approximately 200 feet west of the subject site and a city park (Palm Drive Park) is located approximately 250 feet north of the subject site. Telecommunications Service Facilities procedures & standards: The proposed use of a Telecommunications Service Facility utilizing a monopole tower requires the applicant to submit a Special Exception application with corresponding Site Plan. The City of Ocoee has determined that the use of conventional zoning classifications are inappropriate for the permitting of telecommunications service facility locations. Accordingly, the City adopted Map 5-19 "Telecommunications Service Facilities Location Map," which is used for permitting the location and types of telecommunications service facilities within three areas (Areas One, Two, and Three). Area Three is the least restrictive of the designated telecommunications areas, which allows for monopole type antennas with a maximum height of 200 feet. Special Exceptions are defined in Subsection 2-4.0 (282) of the City of Ocoee Land Development Code as: A special exception is a use that would not be appropriate without restrictions throughout the zoning division or district. However, if controlled as to number, area, location or relation to the neighborhood, would promote the public health, safety, welfare, morals, order, comfort, convenience, appearance, prosperity or general welfare, such uses would be appropriate. (Emphasis added) In accordance with Section 4-8 and 5-19 of the Ocoee LDC, staff must also consider the proposed use in relation to the compatibility with surrounding land uses. Additionally, Staff must also evaluate and consider the new telecommunications service facilities in order to promote, protect, and improve the public health, safety, general welfare, and aesthetics of the community by addressing their significant aesthetic and safety impacts. The applicant has proposed a telecommunications facility on a 10,000 square feet lot adjacent to the Ocoee Shopping Center parking lot. The telecommunications facility will be utilizing a 165 feet high monopole with a 5 feet high lighting rod. As a result, the proposed total height of the monopole tower would be 170 feet. The applicant is also proposing flush -mounted antennas, which are less intrusive than conventional antennas, and has proposed a limit of 24 mounted antennas. The proposed site plan shows the required landscape buffers, landscaping and setbacks requirements. Access to the site will be via a dedicated 20 feet wide access and utility easement. The fencing surrounding the facility will be 6 feet high decorative metal painted black to properly screen the telecommunications equipment. Staff conducted an analysis to ensure land use compatibility, appearance and visual impact of the proposed telecommunications service facility. A map was provided by the applicant (see attached) that depicted the pattern of adjacent land uses and the roadway network within a 660 feet radius of the proposed location. The depicted area show a mixture of light to heavy industrial, warehouse, commercial and manufactured homes (Pioneer Key Park). Before and after pictures were also submitted to depict its visual appearance. The pictures contained color photo -simulations of the proposed facility. Each elevation indicated the approximate height and location of the proposed facility in relation to the existing skyline, viewpoints, and view corridors. Furthermore, sight line representations drawn from view points within 660 feet of the proposed facility to the highest point of the telecommunications service facility were submitted for review and consideration. Staff has concluded that the proposed telecommunications service facility will have a minimal visual impact to its surroundings. In consideration of the close proximity to the office warehouse (Birket Engineering) building to the south, the applicant has agreed to an Indemnification and Hold Harmless Agreement (see attached). Moreover, the monopole tower has been engineered to collapse within a 45 feet radius. This will ensure that if the monopole tower ever fails, it will collapse totally within its site boundary. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: On August 2, 2005, the Development Review Committee reviewed the "Final Site Plan for Special Exception for TBCOM Properties, LLC" date stamped July 1, 2005. There were several technical issues to be addressed from the City Attorney, Planning, and Engineering that were identified in written staff comments and presented verbally. All of the issues were discussed and a few minor changes to the Plan were agreed upon. It should be noted that the Ocoee Fire Department expressed interest in co - locating their emergency back-up VHF system on the proposed monopole facility. The Applicant has agreed to this request; thus, an agreement between the applicant and the City of Ocoee Fire Department will be forthcoming to handle any potential issues that may arise in the future. When the discussion was finished, the DRC voted unanimously to recommend approval of the Special Exception, subject to the developer making changes specified in the reports and discussed at the DRC meeting. Since the site plan is considered small-scale, the changes will be handled administratively and incorporated into the City Commission packet prior to final action. These changes were made and shown on the plans date stamped received August 30, 2005. The Applicant has met the above proposed requirements for the Special Exception petition as shown in the "Final Site Plan for Special Exception for TBCOM Properties, LLC' date stamped August 30, 2005. PLANNING AND ZONING COMMISSION RECOMMENDATION: On August 9, 2005, the Planning and Zoning Commission considered the Special Exception to permit construction of a wireless telecommunications facility utilizing a monopole tower located in Area Three district of the (Map 5-19) Telecommunications Service Facilities Location Map. The City Staff and the Applicant for the project answered questions regarding the access to the site, emergency power generation and abandonment procedures. All of the concerns mentioned were addressed appropriately in the P&Z meeting. There was no one from the public to speak regarding this request. After finishing its deliberations, the Planning & Zoning Commission voted unanimously to recommend approval of the Special Exception to permit construction of a wireless telecommunications facility utilizing a monopole tower located in Area Three district of the (Map 5-19) Telecommunications Service Facilities Location Map. STAFF RECOMMENDATION: Based on the recommendation of the DRC and the Planning and Zoning Commission, Staff respectfully recommends that the Mayor and City Commissioners approve the Special Exception for construction of the wireless Telecommunications Service Facility utilizing a monopole tower located in Area Three district of the (Map 5-19) Telecommunications Service Facilities Location Map. O:\Staff Reports\2005\SR05041_AF_TBCOM_SEU.doc INDEMNIFICATION AND HOLD HARMLESS AGREEMENT THIS INDEMNIFICATION AND HOLD HARMLESS AGREEMENT (hereinafter referred to as the "Agreement") is made and entered into this day of , 2005, by and between the CITY OF OCOEE, FLORIDA, a Florida Municipal Corporation, whose principal place of business is 150 N. Lakeshore Drive, Ocoee, FL 34761, (hereinafter referred to as the "City"), and TBCOM PROPERTIES, L.L.C., a Florida limited liability company, whose principal address is 1133 Louisiana Avenue, Suite 114, Winter Park, Florida 32789 (hereinafter referred to as "TBCOM"). WITNESSETH WHEREAS, TBCOM is developing a wireless telecommunications facility in the City of Ocoee which development is known as "TBCOM wireless telecommunications facility" and which is located at 491 W. Silver Star Road, and more particularly described as follows: [INSERT LEGAL DESCRIPTION OF SITE]; and WHEREAS, TBCOM is the Lessee of the property described above, and has provided City with evidence of its authority to develop and construct a wireless telecommunications facility, as Lessee, at the property described above; and WHEREAS, TBCOM desires to obtain approval of the Special Exception needed to permit development of the TBCOM wireless telecommunications facility. NOW THEREFORE, in consideration of the mutual covenants and conditions contained herein, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto covenant and agree as follows: 1 a) Disclaimer of Liability. The City shall not at any time be liable for injury or damages occurring to any person or property from any cause whatsoever, arising out of the City's issuance of a Special Exception, Development Approvals, Development Orders, Pernuts, Certificates of Completion or Certificates of Occupancy for the development known as TBCOM wireless telecommunications facility or arising out of TBCOM's construction, maintenance, repair, use and operation of the facility or facilities on the development known as TBCOM wireless telecommunications facility, and, including any structural failure, toppling of the wireless telecommunications tower or failure of any of the facilities located at the TBCOM wireless telecommunications facility. b) Indemnification. In consideration of being granted an approval of the Special Exception Application, for the TBCOM wireless telecommunications facility, and for other additional good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, TBCOM shall, at its sole cost and expense, indemnify and hold harmless the City, its representatives, employees and selected and appointed officials from and against: i) Any and all liability, damages, penalties, claims, liens, costs, charges, losses and expenses (including, without limitation, reasonable fees and expenses of attorneys, for trials and appeals, expert witnesses and consultants), which may be imposed upon, incurred by or be asserted against the City by reason of any act or omission of City or TBCOM, their personnel, employees, agents, customers, subsequent purchasers, tenants, subtenants, contractors, or subcontractors, resulting in personal injury, bodily injury, sickness, disease, or death to any person or damage to, loss of or destruction of tangible or intangible property, invasion of privacy or any other right of any person, firm or corporation, which may arise out of, or be, in any way, connected with the use, 2 maintenance, repair, construction or operation of the facilities on the development known as TBCOM wireless telecommunications facility, and any structural failure, toppling of the wireless telecommunications tower or failure of any of the facilities located at the TBCOM wireless telecommunications facility, or for TBCOM's failure to comply with any federal, state or local statute, ordinance or regulation. ii) Any and all liabilities, penalties, claims, liens, costs, charges, losses, and expenses (including, without limitation, reasonable fees and expenses of attorneys, for trials and appeals, expert witnesses and other consultants), which are imposed upon, incurred by or asserted against the City by reason of any claim or lien arising out of work, labor, materials, or supplies, provided or supplied to TBCOM or City, their contractors or subcontractors, for the installation, construction, operation, maintenance, repair or use of the facilities on the development known as TBCOM wireless communications facility or for the issuance of a Special Exception, Development Approval, Development Order, Permits, Certificates of Completion or Certificates of Occupancy for the development known as TBCOM wireless communications facility, and including any structural failure, toppling of the wireless telecommunications tower or failure of any of the facilities located at the TBCOM wireless telecommunications facility. iii) Any claim asserted or liability imposed upon the City for personal injury or property damage to any person arising out of TBCOM or City's installation, operation, maintenance, repair, condition or use of the facilities on the TBCOM wireless communication facility development, or the City's issuance of a Special Exception, Development Approvals, Development Orders, Permits, Certificates of Completion or Certificates of Occupancy for the development known as TBCOM wireless 3 telecommunications facility and, including any structural failure, toppling of the wireless telecommunications tower or failure of any of the facilities located at the TBCOM wireless telecommunications facility. c) Defense to the City. In the event any action or proceeding shall be brought against the City by reason of any matter for which the City is indemnified hereunder, TBCOM shall, upon notice from the City, at TBCOM's sole cost and expense, resist and defend the same with legal counsel mutually selected by TBCOM and the City; provided, however, that TBCOM shall not admit liability in any such matter on behalf of the City without written consent of the City and provided, further, that the City shall not admit liability for, nor enter into any compromise or settlement of any claim for which it is indemnified hereunder, without the prior written consent of TBCOM.
