AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, AMENDING THE
OCOEE COMPREHENSIVE PLAN AS ADOPTED IN 1991, AS AMENDED;
AMENDING THE INTERGOVERNMENTAL COORDINATION ELEMENT OF
THE COMPREHENSIVE PLAN TO ADD THE SEVENTEENTH AND
EIGHTEENTH AMENDMENTS TO THE JOINT PLANNING AREA
AGREEMENT BETWEEN THE CITY OF OCOEE AND ORANGE COUNTY,
FLORIDA, AND TO IDENTIFY A PLANNING HORIZON OF 2028;
AMENDING THE FUTURE LAND USE ELEMENT TO REFLECT THE
SEVENTEENTH AND EIGHTEENTH AMENDMENTS TO THE JOINT
PLANNING AREA AGREEMENT; AMENDING THE FUTURE LAND USE
MAP TO CONFORM TO THE JOINT PLANNING AREA AGREEMENT, AS
AMENDED, AND TO REFLECT SMALL SCALE COMPREHENSIVE PLAN
AMENDMENTS AND ANNEXATIONS SINCE JULY 2011; AMENDING THE
EXISTING LAND USE MAP TO CONFORM TO THE JOINT PLANNING
AREA AGREEMENT, AS AMENDED, AND TO REFLECT SMALL SCALE
COMPREHENSIVE PLAN AMENDMENTS AND ANNEXATIONS SINCE
JULY 2011; AMENDING THE FUTURE LAND USE ELEMENT TO ADD THE
JOINT PLANNING AREA MAP TO THE FUTURE LAND USE MAP SERIES;
PROVIDING FOR TRANSMITTAL; PROVIDING FOR REPEAL OF
CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on September 18, 1991, the City Commission of the City of Ocoee
("City") adopted the City of Ocoee Comprehensive Plan pursuant to Chapter 163, Florida
Statutes, as set forth in Ordinance 91-28, which has been amended from time to time
("Comprehensive Plan"); and
WHEREAS, on February 11, 1994, Orange County, Florida ("County") and the City
entered into that certain Joint Planning Area Agreement, which has been amended from
time to time ("JPA"); and
WHEREAS, the JPA was incorporated into and made a part of the Comprehensive
Plan by CPA-95-1-1 (Ordinance No. 96-02), adopted February 20, 1996, and
subsequently amended by CPA-99-002 (Ordinance No. 2000-16), adopted May 16, 2000,
and by CPA-2002-1-1 (Ordinance No. 2002-11), adopted October 1, 2002, and by CPA-
2010-006 (Ordinance No. 2011-09), adopted July 19, 2011; and

WHEREAS, subsequent to the incorporation of the JPA into the Comprehensive
Plan, and the above-referenced amendments thereto, the City and County have made
further amendments to the JPA, as set forth below:
i. Effective July 2, 2013, the City and County entered into that certain Seventeenth
Amendment to the JPA, a true copy of which is attached hereto as Exhibit "A" and
incorporated herein by reference ("Seventeenth JPA Amendment"); and
ii. Effective April 25, 2014, the City and County entered into that certain Eighteenth
Amendment to the JPA, a true copy of which is attached hereto as Exhibit "B" and
incorporated herein by reference ("Eighteenth JPA Amendment"); and
WHEREAS, the City desires to update the Comprehensive Plan to reflect therein
the above-referenced amendments to the JPA; and
WHEREAS, the last update to Figure 2 (Future Land Use Map) of the Future Land
Use Element of the Comprehensive Plan was made as a part of CPA-2010-006
(Ordinance No. 2011-09), adopted July 19, 2011, and the City desires to update the
Comprehensive Plan so that it conforms to the JPA amendments entered into since that
time; and
WHEREAS, the last update to Figure 1 (Existing Land Use Map) of the Future Land
Use Element of the Comprehensive Plan was made as a part of CPA-2010-006
(Ordinance No. 2011-09), adopted July 19, 2011, and the City desires to update the
Comprehensive Plan so that it conforms to the JPA amendments entered into since that
time; and
WHEREAS, subsequent to the adoption of CPA-2010-006 (Ordinance No. 2011-
09), adopted July 19, 2011, the City has annexed certain parcels of property pursuant to
the following ordinances:

WHEREAS, the City wishes to update to Figure 1 (Existing Land Use Map) and
Figure 2 (Future Land Use Map) of the Future Land Use Element of the Comprehensive
Plan to reflect annexations and comprehensive plan amendments adopted since the
adoption of CPA-2010-006 (Ordinance No. 2011-09), adopted July 19, 2011; and
WHEREAS, the City has initiated this amendment to the Comprehensive Plan (the
"Amendment") in order to (i) incorporate by reference the Seventeenth and Eighteenth
Amendments to the JPA; (ii) amend Subsection I of the Future Land Use Element in order
to reflect the Seventeenth and Eighteenth Amendments to the JPA; (iii) amend the Future
Land Use Map (Figure 2) to conform to the JPA, as amended, and to reflect small scale
comprehensive plan amendments and annexations since the last update to Figure 2; and
(iv) amend the Existing Land Use Map (Figure 1) to conform to the JPA, as amended, and
to reflect small scale comprehensive plan amendments and annexations since the last
update to Figure 1; and
WHEREAS, in adopting this amendment, the City is looking at the planning horizon
to the year 2028; and
WHEREAS, pursuant to Section 163.3174(4), Florida Statutes, the City's Local
is
Planning Agency held an advertised a public hearing on February 13, 2018, and
recommended approval of the Amendment by the City Commission; and
WHEREAS, on August 21, 2018, and December 4, 2018, the City Commission
conducted advertised public hearings in order to obtain public comment regarding the

proposed Amendment, and recommended transmittal of the Amendment to the Florida
Department of Economic Opportunity (DEO); and
WHEREAS, all required public hearings have been held after due public notice in
accordance with Chapter 163, Florida Statutes, and Sections 1-8 and 1-10 of Chapter 180
of the City of Ocoee Land Development Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are hereby ratified and confirmed as
true and correct and incorporated herein by this reference.
Section 2. Authority. The City Commission of the City of Ocoee has the
authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State
of Florida and Chapters 163 and 166, Florida Statutes.
Section 3. Amendment to the Intergovernmental Coordination Element.
The City Commission hereby amends the Intergovernmental Coordination Element of
the Comprehensive Plan to amend existing page 25, as set forth in Exhibit "C",
attached hereto and incorporated herein by reference.
Section 4. Amendment to the Future Land Use Element. The City
Commission hereby amends the existing pages 1 - 5 of Subsection I (Introduction) of
the Future Land Use Element of the Comprehensive Plan as set forth in Exhibit "D",
attached hereto and incorporated herein by reference, to incorporate in its entirety the
Seventeenth and Eighteenth Amendments to the JPA.
Section 5. Future Land Use Map Amendment. The City Commission hereby
amends Figure 2 (Future Land Use Map) of the Future Land Use Element of the
Comprehensive Plan to replace the existing Figure 2 (Future Land Use Map) with the
Existing Land Use Map as set forth in Exhibit "E", attached hereto and incorporated
herein by reference. The foregoing amendment is for the purpose of updating the Future
Land Use Map (Figure 2) to be consistent with the current JPA Land Use Map as
described in the JPA and annexation and amendments to the comprehensive plan
adopted subsequent to the adoption of CPA-2010-006 (Ordinance No. 2011-09), adopted 1'
July 19, 2011, and to identify a planning horizon of 2028.
Section 6. Existing Land Use Map Amendment. The City Commission hereby
amends Figure 1 (Existing Land Use Map) of the Future Land Use Element of the
Comprehensive Plan to replace the existing Figure 1 (Existing Land Use Map) with the
Existing Land Use Map, as set forth in Exhibit "F", attached hereto and incorporated
herein by reference. The foregoing amendment is for the purpose of updating the
Existing Land Use Map (Figure 1) to be consistent with the current JPA Land Use Map

as described in the JPA and annexation and amendments to the comprehensive plan
adopted subsequent to the adoption of CPA-2010-006 (Ordinance No. 2011-09), adopted
July 19, 2011.
Section 7. Ocoee/Orange County Joint Planning Area Map. The City
Commission hereby adopts Figure 1 a (Ocoee/Orange County Joint Planning Area Map)
into the Future Land Use Element of the Comprehensive Plan to reflect small scale
comprehensive plan amendments and annexations since the last update to Figure 1.
Figure 1 a (Ocoee/Orange County Joint Planning Area Map) is set forth in Exhibit "G",
attached hereto and incorporated herein by reference.
Section 8. Transmittal of Adopted Amendment. The City Commission hereby
designates the City Planner as the designee of the City Commission to transmit the
adopted Amendment pursuant to the requirements of section 163.3184(4), Florida
Statutes.
Section 9. Conflicting Ordinances. All ordinances or parts of ordinances in
conflict herewith are hereby repealed and rescinded.
Section 10. Severability. If any section, subsection, sentence, clause, phrase
or portion of this Ordinance is for any reason held invalid or unconstitutional by any
court of competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the remaining
portion hereto.
Section 11. Effective Date. This Ordinance shall become effective on the 10th
day following passage and adoption on second reading.

SEVENTEENTH AMENDMENT TO JOINT PLANNING AREA AGREEMENT
BETWEEN ORANGE COUNTY AND THE CITY OF OCOEE
THIS SEVENTEENTH AMENDMENT TO JOINT PLANNING AREA
AGREEMENT (this "Amendment") is made and entered into as of the ID" day of
, 2013, by and between ORANGE COUNTY, FLORIDA, a political
subdivisis of the State of Florida (the "County") and the CITY OF OCOEE, a Florida
municipal corporation(the"City").
RECITALS
WHEREAS, the County and the City have entered into a certain Joint Planning Area
Agreement, dated February 11, 1994 as amended by the First Amendment thereto dated August
4, 1998, as amended by the Second Amendment thereto dated January 19, 1999 as amended by
the Third Amendment thereto dated November 2, 1999, as amended by the Fourth Amendment
thereto dated November 14, 2000, as amended by the Fifth Amendment thereto dated May 6,
2003, as amended by the Sixth Amendment thereto dated July 15, 2003, as amended by the
Seventh through Tenth Amendments thereto dated February 10, 2004, as amended by the
Eleventh Amendment thereto dated April 5, 2004, as amended by the Twelfth Amendment
thereto dated August 3, 2004, as amended by the Thirteenth Amendment thereto dated F
November 29, 2005, as amended by the Fourteenth and Fifteenth Amendments thereto dated
January 27,2009, as amended by the Sixteenth Amendment thereto dated December 4, 2009, and
as amended by that certain First Amendment to Joint Planning Area Land Use Map, dated
August 4, 1998 (hereinafter collectively referred to as the "Joint Planning Area Agreement");
and

WHEREAS, the Joint Planning Area Agreement relates to property described therein

which is located in and around the boundaries of the City (the"Joint Planning Area"); and
WHEREAS, both the County and the City exercise comprehensive planning authority
pursuant to Chapter 163, Florida Statutes, the Local Government Comprehensive Planning and
Land Development Regulation Act, and enforce land development regulations to regulate the

development of land within the respective areas of jurisdiction of each party; and
WHEREAS, the County and the City have the authority to enter into this Amendment
pursuant to the Local Government Comprehensive Planning and Land Development Regulation
Act in general and Section 163.3171, Florida Statutes, in particular; and
WHEREAS, the provisions of the Joint Planning Area Agreement set forth certain I
procedures for amending the future land use designations shown on the Joint Planning Area Land
Use Map(hereinafter the"JPA Land Use Map"); and
WHEREAS, the County and City desire to amend the Joint Planning Area Agreement in
order to completely update the area map and the Land Use Map to reflect all amendments made
to these maps to date, include a land use equivalency chart, and update notification provisions of
the existing agreement; and I
WHEREAS, the County and City desire to add certain properties to the Joint Planning
Agreement and to delete certain properties from the Joint Planning Area Agreement; and
WHEREAS, the County and City desire to change the future land use designation on
certain properties that are subject to the Joint Planning Area Agreement; and
WHEREAS, the local planning agencies of both the County and City have considered
this Amendment and made recommendations to the Orange County Board of County
Commissioners and the Ocoee City Commission, respectively; and I

WHEREAS, pursuant to Section 163.3171(3), Florida Statutes, this Amendment has
been approved at advertised public hearings held by both the Orange County Board of County
Commissioners and the Ocoee City Commission.
NOW, THEREFORE,in consideration of the covenants made by each party to the other
and of the mutual advantages to be realized by the parties hereto, the receipt and sufficiency of
which is hereby acknowledged,the County and the City hereby agree as follows:
Section 1. Recitals. The above Recitals are true and correct and are incorporated
herein by reference.
Section 2. Authority. This Amendment is entered into pursuant to (1) Chapters 125,
163 and 166, Florida Statutes, (2) the general authority of Section 163.01, Florida Statutes,
relating to interlocal agreements, (3) the Charters of the County and City, and (4) the Joint
Planning Area Agreement.
Section 1 Definitions. All terms and phrases used in this Amendment shall be as
defined in the Joint Planning Area Agreement, as amended,unless otherwise indicated.
Section 4. Joint Planning Area Map Update. The Joint Planning Area, as set forth
in Exhibit"A"to the Joint Planning Area Agreement, is hereby amended and replaced with the

Exhibit"A" attached hereto and by this reference made a part hereof. The amendment to the
Joint Planning Area map includes the addition and deletion of the properties identified in Exhibit

1 attached hereto and by this reference made a part hereof.
Section 5. Joint Planning Area Land Use Map Update. The Joint Planning Area
Land Use Map, as set forth in Exhibit "B" to the Joint Planning Area Agreement, is hereby
amended and replaced with the Exhibit "B attached hereto and by this reference made a part

hereof. The amendment to the Land Use Map includes changes to the future land use
designations of the properties identified in Exhibit "2" attached hereto and by this reference
made a part hereof.
Section 6. Text Change amendment--Notices of Certain Applications. Subsection
A. of Section 13 of the Joint Planning Area Agreement, relating to notice, is hereby amended to
read as follows:
A. With respect to all lands located within the JPA, the City and County will each provide to
the other notice of receipt of the following applications: (1) Annexation, (2) Deannexation, (3)
Comprehensive Plan Amendment, including an amendment to the future land use map, (4)

Rezoning, and/or(5) Development of Regional Impact(collectively the "Applications"). For the
purposes of this Agreement, all references to Applications shall include any of the foregoing
which are initiated by the City, the County and/or the property owner. Such notice shall be
provided within thirty (30) days (except for annexation which will be provided within fifteen
(15) business days) of receipt of an Application or initiation of such action by the City or
County. Upon request, either party may obtain a copy of any such Application and be notified of
all public hearing dates with respect thereto and of all other dates on which action may be taken
with respect to such Application.
Section 7. Text Change Amendment -- Notices. Section 20 of the Joint Planning
Area Agreement,relating to notice, is hereby amended to read as follows:
All notices, consents, approvals, waivers, and elections which any party shall be
requested or shall desire to make or give under this Agreement shall be in writing and shall be
given only by hand delivery for which a receipt is obtained or certified mail, prepaid with ,
confirmation of delivery requested, or by facsimile transmission. Notices shall be addressed to

the addresses set forth below or that a party may otherwise designate in the manner prescribed F

Notices, consents, approvals, waivers, and elections shall be deemed given when received by the
party for whom intended at such party's address first herein specified, or such other address as
such party may have substituted therefore by notice to the other.
Section 8. Continuing Effect. Except as expressly set forth herein, the Joint
Planning Area Agreement, as amended, remains unchanged and in full force and effect.

EIGHTEENTH AMENDMENT TO JOINT PLANNING AREA AGREEMENT
BETWEEN ORANGE COUNTY AND THE CITY OF OCOEE
THIS EIGHTEENTH AMENDMENT TO JOINT PLANNING AREA
AGREEMENT (this "Amendment") is made and entered into as of the Dbday of
, 2014, by and between ORANGE COUNTY, FLORIDA, a political
subdivision of the State of Florida (the "County") and the CITY OF OCOEE, a Florida
municipal corporation(the"City").
RECITALS
WHEREAS, the County and the City have entered into a certain Joint Planning Area
Agreement, dated February 11, 1994 as amended by the First Amendment thereto dated August
4, 1998, as amended by the Second Amendment thereto dated January 19, 1999 as amended by
the Third Amendment thereto dated November 2, 1999, as amended by the Fourth Amendment
thereto dated November 14, 2000, as amended by the Fifth Amendment thereto dated May 6,
2003, as amended by the Sixth Amendment thereto dated July 15, 2003, as amended by the
Seventh through Tenth Amendments thereto dated February 10, 2004, as amended by the
Eleventh Amendment thereto dated April 5, 2004, as amended by the Twelfth Amendment
thereto dated August 3, 2004, as amended by the Thirteenth Amendment thereto dated
November 29, 2005, as amended by the Fourteenth and Fifteenth Amendments thereto dated
January 27, 2009, as amended by the Sixteenth Amendment thereto dated December 4, 2009, as
amended by the Seventeenth Amendment thereto dated May 7, 2013, and as amended by that
certain First Amendment to Joint Planning Area Land Use Map, dated August 4, 1998
(hereinafter collectively referred to as the"Joint Planning Area Agreement");and

WHEREAS, the Joint Planning Area Agreement relates to property described therein
which is located in and around the boundaries of the City (the "Joint Planning Area"); and
WHEREAS, both the County and the City exercise comprehensive planning authority
pursuant to Chapter 163, Florida Statutes, the Local Government Comprehensive Planning and
Land Development Regulation Act, and enforce land development regulations to regulate the
development of land within the respective areas of jurisdiction of each party; and
WHEREAS, the County and the City have the authority to enter into this Amendment
pursuant to the Local Government Comprehensive Planning and Land Development Regulation
Act in general and Section 163.3171, Florida Statutes, in particular; and
WHEREAS, the provisions of the Joint Planning Area Agreement set forth certain
procedures for amending the future land use designations shown on the Joint Planning Area Land
Use Map (hereinafter the "JPA Land Use Map"); and
WHEREAS, the County and City desire to change the future land use designation on
certain properties that are subject to the Joint Planning Area Agreement; and
WHEREAS, the local planning agencies of both the County and City have considered
this Amendment and made recommendations to the Orange County Board of County
Commissioners and the Ocoee City Commission, respectively; and
WHEREAS, pursuant to Section 163.3171(3), Florida Statutes, this Amendment has
been approved at advertised public hearings held by both the Orange County Board of County
. Commissioners and the Ocoee City Commission.
NOW, THEREFORE, in consideration of the covenants made by each party to the other
and of the mutual advantages to be realized by the parties hereto, the receipt and sufficiency of
which is hereby acknowledged, the County and the City hereby agree as follows:

Section 1. Recitals. The above Recitals are true and correct and are incorporated
herein by reference.
Section 2. Authority. This Amendment is entered into pursuant to (1) Chapters 125,
163 and 166, Florida Statutes, (2) the general authority of Section 163.01, Florida Statutes,
relating to interlocal agreements, (3) the Charters of the County and City, and (4) the Joint
Planning Area Agreement.
Section 3. Definitions. All terms and phrases used in this Amendment shall be as
defined in the Joint Planning Area Agreement, as amended, unless otherwise indicated.
Section 4. Joint Planning Area Land Use Map Update. The Joint Planning Area
Land Use Map, as set forth in Exhibit "B" to the Joint Planning Area Agreement, is hereby
amended and replaced with the Exhibit "B attached hereto and by this reference made a part
hereof The amendment to the Land Use Map includes changes to the future land use designation
of the property identified in Exhibit "1" attached hereto and by this reference made a part
hereof
Section 5. Continuing Effect. Except as expressly set forth herein, the Joint
Planning Area Agreement, as amended, remains unchanged and in full force and effect.

for the basis of historic and future populations.
For the purpose of the population projections, the 1990 Census average persons per household
for single-family units was set at 3.03, multi-family units at 1.72, and seasonal units at 2.08.
Table 2 below lists the population and dwelling unit projections for 1997. Based upon a
comparison of land-use based population projections versus historic growth rates both in housing
units and employment, it was determined that the City and JPA would substantially build out by
2020. Table 2 shows the seasonal population remaining constant. Seasonal population is
primarily comprised of migrant farm workers with a small population of "snow birds" and
persons with extended business stays. The methodology assumes that the number of migrant
workers will steadily decrease through 2020 as agricultural lands are developed, while the
number of"snow birds" and persons with extended business stays will proportionally increase
through 2020.

Since 1997, the JPA Agreement has been amended eighteen times. Collectively, the
