Mike Bruegger, PEC Steve Medeiros, PEC Pioneer Key Regional Drainage Improvements EXHIBIT "A" Scope of Services EXHIBIT" A" SCOPE OF SERVICES for PIONEER KEY REGIONAL DRAINAGE IMPROVEMENTS INTRODUCTION: The City of Ocoee has requested a scope of work and fee proposal to design and implement drainage improvements within the Pioneer Key study area (approximately 124 acres) consisting of Pioneer Key I Mobile Home Park, Pioneer Key II Mobile Home Park, and City owned property that will serve as the site for a regional stormwater pond. The Pioneer Key study area is located in Section 18 of Township 22 South and Range 28 East within the Northwest Ditch Drainage Basin. More specifically, Pioneer Key I is located immediately north of Silver Star Road (State Road 438), west of Bluford Avenue, and east ofOcoee-Apopka Road (County Road 437) while Pioneer Key II is located immediately south of Palm Drive, east of State Road 429 (Western Expressway), and west ofOcoee-Apopka Road (refer to Figure 1). Pioneer Key I has historically been plagued with chronic flooding, specifically the North Circle Key Drive area. The drainage characteristics of this area have been significantly altered over time due to the filling-in of the perimeter ditch system that previously surrounded Pioneer Key 1. Portions of Pioneer Key I drained from the roadway cul-de-sacs towards this perimeter ditch, while other areas were conveyed by the internal roadways to catch basins which collected and conveyed stormwater runoff via storm sewer to the existing wetland system north of Pioneer Key 1. Due to the fact that these cul-de-sacs can no longer discharge to the ditch, essentially no outfall exists until flood levels reach an elevation that is great enough to cause overflow to the previously mentioned catch basins. However, these cul-de-sacs . can never truly recover and therefore they experience substantial flooding during almost any rainfall event. Additionally, the previously mentioned catch basins are inadequate because they lack the capacity to both collect and convey stormwater runoff from the contributing drainage area. This results in substantial flooding throughout the mobile home park, especially in the vicinity of the catch basins. In addition, the prolonged flooding within the cul-de-sacs has caused significant pavement damage. In order to provide adequate flood protection, the existing storm sewer collection system must be upgraded. In an effort to alleviate the flooding conditions within Pioneer Key I, PEC recommends that the City implement significant stormwater conveyance improvements. The original plan to improve the drainage within Pioneer Key I was to convey the runoff to a wetland system north of the mobile home park. However, the City has been unsuccessful in securing the easements necessary to implement the original plan. The current plan consists of redirecting the runoff to a regional stormwater pond located directly west of Pioneer Key I and placing additional catch basins within Pioneer Key I to direct stormwater runoff to the regional stormwater pond. Once the runoff is collected within the mobile home park, it will be piped directly west for approximately 1,000 feet (refer to Figure 1). This alignment will require drainage easements, as well as an open cut across Ocoee-Apopka Road. It should be pointed out that at this time the proposed improvements do not include an extensive secondary conveyance system within Pioneer Key I (i.e., no additional inlets and storm sewer pipes within West Circle Key Drive, East Circle Key Drive, Shell Key Court, or Siesta Key Court). A-I P-4I28.SCO EXHIBIT "A" SCOPE OF SERVICES for PIONEER KEY REGIONAL DRAINAGE IMPROVEMENTS The Pioneer Key II mobile home park has also experienced chronic flooding with depths reaching 3 - 4 feet at times. However, the City of Ocoee, in conjunction with Orange County, recently implemented significant drainage improvements to drastically improve stormwater conveyance and lower flood stages. The improvements, which were partially funded by the Community Development Block Grant (CDBG) Program, were constructed during 2001. In order to implement the recommended drainage conveyance improvements within Pioneer Key I, as well as future conveyance improvements within the study area, a regional storm water pond will be constructed first to provide pollution abatement volume and some level of attenuation volume. The regional pond will be constructed on eight (8) acres currently owned by the City of Ocoee. The 8-acre site formerly consisted of three (3) perc ponds / infiltration basins used for disposal of treated effluent. In an effort to offset the $2.6 million capital costs to implement the various drainage improvements within the study area, PEC, on behalf of the City ofOcoee, has pursued and secured the following grants: · $850,000 from the Florida Department of Environmental Protection (FDEP) through the Florida Forever Program; and · $400,000 from Orange County through the Community Development Block Grant (CDBG) Program. OBJECTIVE: The objective of this project is to provide engineering services for the design, preparation of construction plans and project manuals, and acquisition of permits and easements in order to provide complete bid documents to implement the various drainage improvements. The proj ect will be undertaken in three (3) distinct phases: · Phase I - Regional Stormwater Facility · Phase II - Pioneer Key I Conveyance Improvements · Phase III - Pioneer Key I and II Pavement and Underdrain Repairs. Phase I will involve the preparation of construction plans and a project manual to construct the regional storrnwater pond on the City's 8-acre parcel. Phase I will also involve a control structure, a diversion structure in the Northwest Ditch in order to divert the runoff into the regional stormwater pond, parking lots to accommodate a future trailhead, and coordination with the City of Ocoee to realign a portion of Palm Drive. A-2 P-4I28.SCO EXHIBIT "A" SCOPE OF SERVICES for PIONEER KEY REGIONAL DRAINAGE IMPROVEMENTS Phase II will also involve the preparation of construction plans and a project manual to construct the conveyance improvements within Pioneer Key I, as well as the outfall pipe system from Pioneer Key I to the regional stormwater pond. Phase II will require drainage easements and coordination with Orange County to cross Ocoee-Apopka Road (County Road 437). Phase III will involve the evaluation of the pavement and base within the Pioneer Key I and II mobile home parks by the geotechnical subconsultant (Devo Engineering) in order to develop recommended pavement and underdrain improvements within the 1.62 miles of rights-of-way. PROFESSIONAL ENGINEERING SERVICES: Phase I: Regional Stormwater Pond Professional Engineering Consultants, Inc. (Consultant) shall provide the engineering serVices enumerated below. Engineering services for Phase I shall include the following tasks: 1. Coordinate with the Survey Subconsultant (Southeastern Surveying) to prepare survey drawings in support offinal design services. The survey drawings shall consist ofa boundary, location and topographic survey for the proposed pond site. The Survey Subconsultant shall also survey the Northwest Ditch adjacent to the pond to support the design of the diversion structure and the control structure. 2. Conduct a field review to confirm the content and accuracy of the survey drawings as well as establish the contributing basin area to the proposed regional stormwater pond. 3. Coordinate with the various utility entities in order to verify / confirm the location of existing underground utilities in the vicinity of the proposed improvements. 4. Conduct a pre-application meeting with the SJR WMD to establish the design criteria, type of permit and the permit application fee. 5. Coordinate with the Geotechnical Subconsultant (Devo Engineering) to establish the subsurface conditions and the seasonal high water table elevations in the vicinity of the proposed pond (refer to Exhibit "D"). In addition, the Consultant shall coordinate with the Environmental Subconsultant (Lotspeich and Associates, Inc.) to establish the jurisdictional wetland limits associated with the Northwest Ditch (refer to Exhibit "D"). A-3 P-4128.SCO EXHIBIT" A" SCOPE OF SERVICES for PIONEER KEY REGIONAL DRAINAGE IMPROVEMENTS 6. Perform a hydrologic / hydraulic analysis in order to design the stormwater pond and control structures. The Consultant shall utilize [CPR, Version 3 to flood route the runoffhydrographs through the stormwater pond to establish flood stages and rates for the various design storm events. 7. Prepare construction plans and a project manual to form a complete and single bid package ready to award for construction. All design parameters, surveys and construction plans shall be submitted in English Standard units. At a minimum, it is anticipated that the preparation of construction drawings for the proposed drainage improvements will include the following eleven (11) sheets: · Title Sheet (Sheet 1) . Overall Site Plan / Location Map (Sheet 2) . General Notes and Summary of Quantities (Sheet 3) . Site Plan of the Proposed Regional Stormwater Pond (Sheet 4) . Cross-Sections of the Proposed Pond (Sheet 5) . Diversion Structure and Control Structure Details (Sheet 6) · Landscape Plan (Sheet 7) · Irrigation Plan (Sheet 8) · Sediment and Erosion Control Plan (Sheet 9) · Miscellaneous Drainage Details (Sheets 10 and 11) The Consultant shall also prepare a Project Manual to support the construction plans which will be included in the final bid package. It is anticipated that the City of Ocoee shall prepare and provide the "front-end" documents and general conditions. 8. Prepare probable construction costs for the proposed improvements. Statements of probable construction costs and detailed cost estimates prepared by the Consultant represents his/her best judgment as a design professional familiar with the construction industry. It is recognized, however, that the Consultant has no control over the cost oflabor, materials, or equipment; over the contractor's methods of determining bid prices; or over competitive bidding or market conditions. Accordingly, the Consultant cannot and does not guarantee that bids will not vary from any statement of probable construction cost or other estimates prepared by him/her. 9. Prepare and submit an Environmental Resource Permit (ERP) Application to the SJRWMD (Altamonte Springs Service Center). The Consultant is also responsible for responding to all reasonable "requests for additional information" (RAI) letters from the WMD in order to acquire the necessary permits. The Consultant shall be responsible for addressing all technical issues but will not be required to defend an administrative hearing without additional compensation. Submit an NPDES construction permit application (Storm Water Pollution Prevention Plan and a Notice of Intent) to the Florida Department of Environmental Protection (FDEP). 12. Conduct five (5) status meetings with the City ofOcoee throughout the duration of the project. j Phase II: Pioneer Key I Conveyance Improvements Professional Engineering Consultants, Inc. (Consultant) shall provide the engineering services enumerated below. Engineering services for Phase II shall include the following tasks: 1. Coordinate with the Survey Subconsultant (Southeastern Surveying) to prepare survey drawings in support of final design services. The survey drawings shall consist ofa boundary, location and topographic survey for the proposed drainage conveyance improvements. The Survey Subconsultant shall also prepare drainage easement documents between Pioneer Key I and the regional pond. 2. Conduct a field review to confirm the content and accuracy of the survey drawings as well as establish the contributing basin area to the proposed conveyance improvements. 3. Coordinate with the various utility entities in order to verify / confirm the location of existing underground utilities in the vicinity of the proposed improvements. 4. Conduct a pre-application meeting with the SJRWMD to establish the design criteria, type of permit and the permit application fee. 5. Coordinate with the Geotechnical Subconsultant (Devo Engineering) to establish the subsurface conditions along the alignment of the storm sewer pipes in order to establish recommendations for trenching, pipe bedding and backfilling (refer to Exhibit "D"). 6. Perform a hydrologic / hydraulic analysis in order to design the storm water conveyance systems. The consultant shall utilize [CPR, Version 3 to flood route the runoff hydro graphs through the storm sewer pipes to establish flood stages and rates for the various design storm events. It is anticipated that the City of Ocoee shall prepare and provide the "front-end" documents and general conditions. 8. Prepare probable construction costs for the proposed improvements. Conduct five (5) status meetings with the City ofOcoee throughout the duration of the project. At the conclusion of Phase I and II, and upon approval of the Geotechnical engineering report, the Consultant shall revise the following Phase III Scope of Services, if necessary, and prepare a fee quotation proposalfor Phase III services. Phase III: Pioneer Key I and II Pavement and Underdrain Repairs Professional Engineering Consultants, Inc. (Consultant) shall provide the engineering services enumerated below. Engineering services for Phase III shall include the following tasks: 1. Coordinate with the Survey Subconsultant (Southeastern Surveying) to prepare survey drawings in support offinal design services. The survey drawings shall consist of a right-of-way, location and topographic survey for the proposed roadway improvements. 2. Conduct a field review to confirm the content and accuracy of the survey drawings. 3. Coordinate with the various utility entities in order to verify / confirm the location of existing underground utilities in the vicinity of the proposed roadway improvements. 4. A-8 P-4I28.SCO EXHIBIT" A" SCOPE OF SERVICES for PIONEER KEY REGIONAL DRAINAGE IMPROVEMENTS GENERAL: The Consultant will adhere to the following procedures throughout the course of the contract. 1. Ninety percent (90%) and one hundred percent (100%) complete plans shall be furnished to the City ofOcoee for review and approval prior to final plans submittal. For each plan submittal, five (5) bond copies shall be given to the City of Ocoee. Upon final review and approval, the Consultant shall submit five (5) copies of the final bid documents, five (5) signed and sealed bond copies of the final construction plans, plus thirty (30) unsealed bond copies of the final construction plans. 2. Pinal construction cost estimates shall show quantity breakdowns of all items following the Florida Department of Transportation numbering system when itemizing quantities. All back-up cost estimate worksheets shall be provided to the City for their record. 3. Digital copies of all Construction Plans and Supporting Documentation shall be provided to the City of Ocoee on a compact disc (CD). BASIS OF PROPOSAL / ASSUMPTIONS: The following conditions and assumptions are noted as qualifications to this proposal. 1. This Scope of Work has assumed that five (5) drainage easement documents will be required to implement the proposed Phase II improvements. If, due to utility conflicts or site constraints, the proposed drainage improvements require additional temporary construction and/or permanent drainage easements, then the survey sub consultant (Southeastern Surveying) shall prepare an amendment to the work order to provide additional services to prepare the necessary easement documents. 2. This scope of work has assumed that no wetland mitigation is required by the SJRWMD or the FDEP. 3. This scope of work has assumed no permitting with the Florida Department of Environmental Protection (FDEP) associated with relocation of existing water and/or wastewater utilities within the Ocoee-Apopka Road right-of-way. 4. Porthe purpose of this proposal, it is assumed that a Maintenance of Traffic (MOT) Plan will not be part of the construction plans but will be prepared by the Contractor, ifneeded, and submitted to the City and/or Orange County for approval prior to construction. Consulting Geotechnical Engineer Pioneer Key - Page 1 1.0 BACkGROUNd INFoRMATioN Figure 1 (attached) shows the proposed development plan for the Pioneer Key Regional Drainage Improvements project in the City of Ocoee, Florida. Relevant elements of the project are as follows: II An 8:t acre regional stormwater pond (wet detention) with discharge into the Northwest Ditch which flows north into lake Apopka. Note that a portion of this pond footprint overlies a former wastewater percolation pond. The pond will likely be 12 to 15 ft deep and will be designed in accordance with SJRWMD criteria. . Proposed conveyance pipe (1,400:t lineal ft) from Pioneer Key I Mobile Home Park to the regional pond; note that this pipe will cross under Ocoee-Apopka Road and will be constructed as an open cut. II Rehabilitation of the existing pavement in Pioneer Key I and Pioneer Key II Mobile Home Parks; there is approximately 4,550:t lineal ft of internal roadway in Pioneer Key I and 4,OOO:t lineal ft in Pioneer Key II. 2.0 ObjECTivES The objectives of this investigation are as follows: w Geotechnical investigation of the soil and water table conditions within the proposed pond footprint to assess: o the texture of the soils to be excavated and their engineering suitabil ity; @ seasonal high and low water table for design of pond control structure and construction dewatering considerations; @) chemical analysis of the soils in the existing wastewater disposal pond area to see if there are any contamination issues which will affect disposal of the excavated material; and Devo Seereeram, Ph.D., P.E. These parameters include: ,.. base of mobilized aquifer (ft NGVD) ,.. seasonal high water table altitude (ft NGVD) ,.. weighted horizontal hydraulic conductivity (ft/ day) ,.. fillable porosity (%) ~ Geotechnical investigation of pipe conveyance to assess the soil and water table conditions and provide recommendations for trench excavation (including dewatering), preparation of the pipe bedding, and backfilling of the trench backfill in structural and non-structural areas. ., Geotechnical investigation of the existing pavement within the Pioneer Key I and Pioneer Key II mobile home parks. This will include an assessment of the water table and its separation from the pavement base, subgrade soils, including any recommendations for pavement underdrains. The thickness of the pavement section and the soundness of the component layers will also be assessed. l.O FiEld & LAboRATORY TEST PROGRAMS The following program of field and laboratory testing will be undertaken to provide data for this assessment: W Five (5) 20 ft deep Standard Penetration Test (SPT) borings within the proposed pond area. Shallow piezometers will be installed adjacent to each borehole to obtain reliable measurements of the depth to the water table within the pond area. iii Collection of two (2) soil samples from the percolation pond area for laboratory analytical testing. iii Six (6) 7-10 ft deep hand auger borings with piezometers along the alignment of the conveyance pipes from Pioneer Key I to the pond. (L&A) (the Consultant) will provide ecological consulting services to Professional Engineering Consultants, Inc. (PEe) (the Client). SUBJECT: Pioneer Key Regional Drainage Improvements 124::1: acres in Sections 7 and 18, Township 22 South, Range 28 East City of Ocoee, Orange County, Florida 1.0 SCOPE OF SERVICES Provide necessary biological support data in order to represent the Client's interest with governmental agencies with statutory authority regulating land use in the State of Florida, and provide ecological consulting services needed for compliance with the potential permitting requirements of the U.S. Army Corps of Engineers (USACE), the St. Johns River Florida Water Management District (SJRWMD), the Florida Fish and Wildlife Conservation Commission (FFWCC), the U.S. Fish and Wildlife Service (USFWS), and the city ofOcoee using existing rules, regulations, and policies as of the date of initiation of this Scope of Services. Specifically, the city of Ocoee proposes to construct an outfall discharge point from the north side of Pioneer Key I, to an existing excavated drainage conveyance that will be improved as part ofthis project, ultimately discharging into a proposed 8::1: acre regional stormwater pond to the north of Palm Drive and west ofOcoee-Apopka Road. The Scope of Services is separated into tasks for clarity. The services outlined within Task I include the research and compilation of the ecological documentation necessary to evaluate the project area and determine any potential impacts associated with the proposed drainage improvements, while Task II includes coordination necessary for permitting the proposed improvements with the applicable regulatory agencies. This Scope of Services is further defined by the attached Summary Fee Sheet and the tasks outlined below. 1.1 Task I - Preliminary Ecological Assessment/Field Identification of Wetlands 1.1.1 Research existing published literature and available documents pertinent to the project site. 1.1.2 Request a database search from the USFWS and the FFWCC for the presence of federal and state listed plant and animal species. 1.1.3 Request database search from the FFWCC for the presence of the Southern Bald Eagle on site or within a one (1) mile radius of the project area. 1.1.4 Review site conditions and field flag/delineate the limits of wetland/surface water areas potentially within the jurisdiction of governmental agencies with statutory permitting authority following the Corps of Engineers Wetlands Delineation Manual (1987) and the Unified Wetland Delineation Methodology for the State of Florida dated 1 July 1994. Scope of Services Pioneer Key Regional Drainage Improvements L&A No. 2004-103.00 Doc: \2004-103-S0S-05G05.wpd 5 July 2005 Page 2 1.1.5 Evaluate and field mark the Seasonal High Water Elevation (SHWE) based upon observed biological indicators (i.e., lichen lines, scarp lines, etc.). 1.1.6 Coordinate with surveyors in locating the wetland flags and SHWE points, as necessary. 1.2 Task II - Report/Permit Coordination 1.2.1 Prepare an ecological summary report for inclusion in the appropriate permit applications which will include the following information pertinent to the project site: . Existing site conditions (including a FLUCFCS map); . Approximate landward extent of wetlands; . Potential for occurrence of listed and wetland dependent plant and animal species; . A discussion of secondary and cumulative impacts associated with the project, and; . A discussion of avoidance and minimization of wetland impacts associated with the project (alternate site plans must be prepared by others if required by the permitting agencies). 1.2.2 Assist in preparation of an Environmental Resource Permit (ERP) joint application for submittal to the USACE and the SJRWMD. 1.2.3 Respond to one (1) round of Requests for Additional Information (RAI) from the permitting agencies. 1.2.4 Coordination/meetings with project team (limited to three (3) Sr. Environmental Specialist hours). 2.0 ADDITIONAL SERVICES The following additional services may be provided at the Client's request and authorization. Additional services are not covered under the limiting fee for this Scope of Services. Upon written authorization, these services shall be provided by the Consultant and billed to the Client in accordance with the current year's Fee Schedule: 2.1 Meetings in excess of those defined above. 2.2 Conduct quantitative surveys for listed plant or animal species. 2.3 Develop management plans for anyon-site listed plant and animal species. 2.4 Prepare responses to additional RAIs from the SJRWMD and/or the USACE. Scope of Services Pioneer Key Regional Drainage Improvements L&A No. 2004-103.00 Doc: \2004-103-S0S-05G05.wpd 5 July 2005 Page 3 2.5 Develop and/or implement preliminary or final mitigation plans to satisfy permitting requirements relevant to wetland, upland, and listed species impacts. 3.0 LIMITING ASSUMPTIONS The following assumptions outline the limits of defined tasks as required Df Lotspeich and Associates, Inc. to provide the requested ecological consulting services for the Pioneer Key Regional Drainage Improvements project. 3.1 The landward extent of jurisdictional wetlands within the project area will be field flagged once for the Pioneer Key Regional Drainage Improvements project. If greater than a three-month period elapses between the delineation of the wetland and the field location of wetland flags such that additional site investigations are necessary to facilitate the location of the wetland flags, these services will be submitted as an additional cost. 3.2 If natural disasters or vandals should remove flags, the flags will be reset. The additional hours required for this service will be limited to those estimated for Item 1.1.4. 3.3 If governmental regulations change during the course of this project or between initial field reviews and permit application submittal such that additional site reviews are requested by the governmental agency, any such required modifications or additional site reviews will be submitted as an additional cost. Environmental permitting criteria will be established during pre-application meetings with the applicable governmental agencies prior to final project design. 3.4 Modifications to the final work product performed at the request of the Client that are not the result ofthe Consultant's errors or omissions shall be billed to the Client on an hourly basis as additional services in accordance with the current year's Fee Schedule. 3.5 No subsurface, soil, water, or hazardous materials investigations are included within the scope of this project. 3.6 No archaeological investigations or coordination with the Florida Division of Historic Resources (DHR) and/or the State Historic Preservation Officer (SHPO), such as that usually required by the USACE and the SJRWMD during permitting, are included within this Scope of Services. 3.7 Services in addition to or in excess of tasks and hours identified in Section 1.0 will be considered additional services and will require a modification to the contract. 3.8 The Consultant assumes no responsibility for work performed by others or for terms or agreements not specifically described herein. For purposes of this agreement, such circumstances include, but are not limited to, abnormal weather conditions; floods, earthquakes, fire, epidemics; war, riots, and other civil disturbances; strikes, lockouts, work slowdowns, and other labor disturbances; sabotage; judicial restraint; and inability to procure permits, appointments, licenses, or authorizations from any local, state, or federal agency for any of the supplies, materials, accesses, or services required to be prov.ided by the Consultant under this agreement. Should such circumstances occur, the non-performing party shall, within a reasonable time of being prevented from performing, give written notice to the other party, describing the circumstances preventing continued performance and the efforts being made to resume performance of this Scope of Services. 3.11 The services will be performed on behalf of and solely for the exclusive use of the Client and it's successors or assigns. 3.12 The services performed by the Consultant shall be conducted in a manner consistent with that level of care and skill ordinarily exercised by members of the environmental consulting profession in the same locale and acting under similar circumstances and conditions. Except as set forth herein, the Consultant makes no other representation, guarantee, or warranty, expressed or implied, in fact or by law, whether of merchantability, fitness for any particular purpose or otherwise, concerning any ofthe services that may be furnished by the Consultant to the Client. 3.13 This Scope of Services is based on existing rules, regulations, and policies in force on the date of this agreement. 3.14 Permit fees are not included within the fee estimate that accompanies this Scope of Services. 3.15 Engineering drawings prepared for inclusion in permits will be prepared by others and are not included within this Scope of Services.
