(WSI) for assignment of Residential Collection Contract (RFP #03-001) to Waste Pro? BACKGROUNDIDISCUSSION Waste Services of Florida, Inc., the current City's hauler for the Residential Collection (garbage and recycling) has requested assignment of the Contract to Waste Pro per Section 16 (A) of the Contract RFP#03-001, which states: "This Agreement and the rights and privileges shall not be assigned or otherwise transferred by Contractor except with the express written approval of the City. The City reserves the right in its sole and absolute discretion to approve or disapprove any such requested assignment or transfer of this Agreement." The primary reason stated by WSI for the request to assign the contract is "... divesting certain aspects of our business and the City of Ocoee is part of that divestiture." Staff has evaluated the request from WSI and has formulated City's options in response to this request. WSI Performance WSI was awarded the contract for the residential collection through a competitive process and began operations in Ocoee in June 2004. The terms of the Contract involved 5 years with an optional2-year extension. The rate charged by WSI is $10.98 per household for garbage (twice per week) and recycling (once per week). This unit price was the lowest amongst the 6 proposals received by the City as summarized in the table below. As per the terms of the contract, rates are subject to a 3% adjustment in years 3 through 5. A performance summary for the first 12 months of service for WSI is attached to this report. Beyond the quantifiable statistics (misses, broken carts, etc.) as noted in the summary, the overall qualitative assessment of the performance has been judged as "poor to fair" on a scale of "poor to excellent" based upon the number of complaints received from the customers. The qualitative issues include, but not limited to leaving carts in the road, leaving carts in front of the mail boxes, leaving carts in the middle of driveway, not collecting extra garbage (even after a holiday), throwing bins, speeding, hydraulic spills, etc. Waste Pro's Credentials A package containing Waste Pro's credentials is included with this staff report, which provides list of existing customers and references. A selected list of comparable municipal customer include: . City of Fort Pierce - residential recycling . City of Longwood - residential garbage, recycling, and yard waste . City of Palatka - residential recycling . Putnam County - residential garbage, recycling, and yard waste . 81. Lucie County - residential garbage, recycling, and yard waste . Seminole County - residential garbage, recycling, and yard waste City's Potential Options 1. Approve Contract Assignment - City Commission may approve the assignment of the contract as requested by WS1. If this option is chosen, staff recommends negotiations with Waste Pro to insert several performance security measures currently not in the Agreement as provided below: . Insert semi-annual performance evaluation subject to contract termination or renewal by the City Commission on anniversary date of the assignment, providing for transition period of four (4) months to a new hauler. . Waste Pro to submit a list of active and spare equipment to be used in Ocoee on permanent basis subject to initial certification and regular inspection by staff. . Require Waste Pro to train their drivers on quality of service and customer service issues. . Consider negotiating and addition of extra bag concept to Ocoee service. 2. Disapprove Contract Assignment - City Commission may disapprove assignment of service and require execution of the terms of the Contract with WS1. Other Considerations City's current commercial and yard waste contracts with will expire in August 2006. City has the option of the (1) extending contracts for another 2 years, or (2) may negotiate lesser term transition service until a new contract is set in place through an RFP process. As an alternative solution, City Commission may also consider negotiation with WSI to extend their service through August 2006 while preparing a new RPF for all services (commercial, residential C & D, and residential curbside) to become effective upon termination of the current commercial and yard waste contracts. This option may be attractive to consider for the City due to combined overall services and potential savings to the City. The City of Lake Helen recently completed solicitation of proposals for similar services and, after lengthy interviews with the proposing firms, selected Waste Pro to be its solid waste collection and recycling services provider for the next five years. / Because Lake Helen had been provided service by another company since the early 1990's, and because Lake Helen's residents were obviously used to and satisfied with the collection methods and routines of that company, it was very important that Waste Pro be able to make a smooth transition between services provided by themselves and those of previous service provider. Collection routes were analyzed and ultimately established for efficiency and timeliness of collections (which resulted in initiating collections later in the morning and completing collections earlier in the afternoon). Waste Pro employees maintained close contact with City administrative personnel at all times during the transition process to solicit stafI's input and to advise staff of Waste Pro's activities and progress. Waste Pro also provided commercial customers with brand new dumpsters and purchased new waste collection vehicles customized for speci:fi9 residential and for commercial waste collection needs in Lake Helen. The provision of new dumpsters and new collection vehicles has really helped to improve the visual image of the City. When Waste Pro began collecting waste in. Lake Hele~ it did so in a very professional manner, with minimal service problems. What few service problems arose, as a result of the transitio~ were addressed immediately, willfugly and professionally. In fact, there have been instances where the driver of a collection vehicle has noticed that a resident has not put his/her garbage or recyclables out for collection and the driver has made several trips past the residence during the course of the collection day to insure that the resident was provided collection service that day. That's the kind of customer semce that John J. Jennings, owner of Waste Pro, a garbage . con~ctor with operations in three states, wants to give.
