SUBJ: LAKE BENNET CENTRE, FINAL SUBDIVISION PLANS
PROJECT NO. 93-010
ISSUE:
Should the Honorable Mayor and City Commission approve the Final
Subdivision Plans for Lake Bennet Centre, a commercial development?
BACKGROUND:
Lake Bennet Centre is a nine lot commercial subdivision comprised of 28 . 29
useable acres located north of S.R. 50 and east of Lake Bennet . The
property is zoned "C-2", Community Commercial District which provides for
a variety of moderate intensity uses such as banks, restaurants,
convenience stores, offices, retail stores, and nursing homes . The City
Commission approved the Preliminary Subdivision Plan for Lake Bennet Centre
on November 1 , 1994 . Subsequently, on April 4, 1995, the City Commission
entered into a Developer's Agreement with Zom Lake Bennet , Ltd. to further
prescribe the conditions under which the project would be developed.
DISCUSSION:
After a number of DRC reviews, the developer has conformed the Plans to the
Preliminary Subdivision Plan and the Developer's Agreement including the
Conditions of Approval . The Plans as submitted incorporate all minor
changes specified by the DRC per their unanimous approval on July 27 , 1995 .
As part of the DRC approval , some minor waivers to berm widths and
landscape buffer widths adjoining the two retention ponds are recommended
as delineated on Sheet 4 of 26 of the Plans . These slight reductions
negligibly affect access for maintenance and help minimize incursion into
the Shoal Creek floodway area.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
At their regular meeting on August 8 , 1995, the P&Z Commission voted
unanimously to recommend approval of the Final Subdivision Plans for Lake
Bennet Centre as submitted.
STAFF RECOMMENDATION:
Based upon the DRC recommendation and P&Z approval , Staff respectfully
recommends that the Honorable Mayor and City Commission approve the Final
Subdivision Plans for Lake Bennet Centre as date stamped received by the
City on August 1 , 1995 .
