BACKGROUND: The Plantation Grove PUD is a multi -use project located on both sides of Maguire Road, with the larger portion of the project located within the northeast quadrant of the intersection of Maguire Road and Moore Road / Roberson Road. The entire PUD contains approximately 201 acres, including approximately 133 acres of single family residential areas, 35 acres of multiple family residential area, 25 acres of commercial area, a fire station site and a day care center site. The entire Plantation Grove PUD is vested from concurrency, and the only remaining portions of the PUD to be developed include the multiple family area and Phases 2 & 3 of the commercial area. The applicant is now ready to develop the multiple family portion of the PUD. The proposed Preliminary Site Plan for the project, known as the Esplanade at Plantation Grove (presented separately), incorporates several features and amenities intended to produce a high quality development including mostly two-story buildings, traffic calming devices, heavy landscaping and a village concept. However, to achieve this goal, a few amendments to the Conditions of Approval for the Plantation Grove PUD will be necessary. The proposed PUD amendment does not change any of the approved land uses, land use densities, or land use areas in the PUD. 9 July 2, 1998 Honorable Mayor and City Commissioners Page 2 Prior to being annexed into the City, the land currently included within the Plantation Grove PUD had a Low Density Residential comprehensive plan designation and a Residential Country Estates (RCE) zoning designation. The property was given a City comprehensive plan designation of Residential (173 acres) and Commercial (23 acres) in November 1988 after it was annexed. Simultaneously, it was given a Planned Unit Development (PUD) zoning designation which included 30 acres for multiple family use in the residential portion of the PUD, at a density of 15 units per acre which would allow up to 450 units. The multiple family area in this original PUD Land Use Plan covered roughly the same area as the area shown for multiple family use in the Revised Land Use Plan for the current Plantation Grove PUD, except it did not extend south to Moore Road. The Revised Land Use Plan for the Plantation Grove', PUD which is currently in effect was adopted in May 1992. This plan also provides 30 acres for multiple family use (35 including common retention area) covering roughly the same areal as in the original PUD Land Use Plan, but configured to extend all the way south to Moore Road. However, the density in the Revised Plan was increased slightly up to 16 units per acre, which, would allow a total of 480 multi -family units. Another change in the Revised Land Use Planwas that the spine road between the multiple family and single family areas was shortened and the access points to the multiple family area from the spine road were limited to one point, rather than four points as in the original PUD Land Use Plan. The Revised Land Use Plan also added an! access point to the multiple family area from Moore Road. Both the original PUD Land Use Platte and the Revised Land Use Plan showed access to the multiple family parcel from the spine road, rather than direct access to Maguire Road. DISCUSSION: As indicated earlier, the applicant desires to develop a high quality multiple family project and has included several design features and amenities to achieve' this goal. Those features and amenities will be presented in detail as part of the staff report on thin Preliminary Site Plan for the Esplanade at Plantation Grove. However, in order to develop the project as proposed, a few amendments to the Conditions of Approval for the Plantation Grove PUS have been requested. The amendment includes changes to two existing Conditions of Approval and adds two new Conditions of Approval, which are outlined below: a) Existing Condition # 7: Changes the building setback from retention ponds in the multiple family parcel from 25 feet to 15 feet, allowing buildings to be placed closer to the ponds. b) Additional (Existing) Conditions: Changes the minimum net living floor area in the multiple family parcel from 750 sq ft to 650 sq f(, allowing for a small percentage of the project to include carriage house units. c) New Condition # 25: Provides for a concrete' median separator in Moore Road with Phase 3 of the commercial portion of the PUD, to prevent unsafe left turns into the site. d) New Condition - Waivers: Adds a waiver from !Code requirements to allow 18' parking spaces with a 2' overhang into landscaped areas, to allow more green space on the site. July 2, 1998 Honorable Mayor and City Commissioners Page 3 The proposed changes to the currently adopted Land Use Plan for the Plantation Grove PUD would result in standards which are still consistent with the standards applied to other developments in the City. With respect to proposed changes to the Existing Conditions of Approval, the Fire Department has determined that the proposed 15 foot setback from retention ponds is sufficient to adequately access buildings in case of fire or evacuation. The request to change the minimum net living floor area to 650 square feet matches the minimum standard listed in the Code for multiple family units (650 square feet). The proposed development includes a total of 63 units at 650 square feet, which is only 14% oflthe total number of units in the complex (447). The average unit size will be 1,041 square feet ',,and there will be 200 units over 1,300 square feet in size, which is 45% of the total number of uhits in the complex. Given these figures, it is the opinion of staff that the proposed change does raot compromise the City's standards for development and is acceptable in order to permit the high quality of development proposed in the Preliminary Site Plan for the Esplanade at Plantation Grove. The two new Conditions of Approval are administrative in nature. The median sepalrator amendment was requested by City staff for safety reasons, and the parking space size reduction is commonly applied to reduce pavement area. The attached Revised Land Use Plan for the Plantation Grove PUD was reviewed by the Development Review Committee (DRC) on June 3, 1998,. The Committee voted unanimously to recommend approval of this Revised PUD Land Use Plran. The attached Plan is date stamped received by the City on June 9, 1998, but it is the same plan that was approved by the DRC on June 3, 1998. WHEREAS, the owner of certain real property located within the corporate limits of the City of Ocoee, Florida, as described in the legal description provided for in the land use plan attached hereto as Exhibit "A", has petitioned the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission") to approve revisions (the "Amendment") to the Plantation Grove PUD Second Revised Land Use Plan, as approved by the Ocoee City Commission on May 5, 1992, and amended by a non - substantial amendment approved by the Ocoee City Commission on November 5, 1996 (the "Second Revised Land Use Plan"); WHEREAS, pursuant to Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida (the "Ocoee City Code"), the Planning Director has reviewed said petition and determined that the Amendment is consistent with the City of Ocoee Comprehensive Plan (the "Ocoee Comprehensive Plan"); WHEREAS, the Amendment was scheduled for study and recommendation and was reviewed by the Development Review Committee (DRC) on June 3, 1998; WHEREAS, the DRC voted unanimously to recommend approval of the Amendment; WHEREAS, the Amendment was scheduled for study and recommendation by the Planning and Zoning Commission of the City of Ocoee ("PZC") on June 24, 1998; WHEREAS, the PZC reviewed the Amendment for consistency with the Ocoee Comprehensive Plan and determined that the Amendment is 'consistent with the Ocoee Comprehensive Plan and is in the best interest of the City and has recommended to the Ocoee City Commission that it approve the Amendment and find it consistent with the Ocoee Comprehensive Plan; WHEREAS, the Ocoee City Commission has held a de novo public hearing with public notice thereof with respect to the proposed Amendment; WHEREAS, the Ocoee City Commission has determined that the Amendment is consistent with the Ocoee Comprehensive Plan; and WHEREAS, this Ordinance has been considered by the Ocoee City Commission in accordance with the procedures set forth in Section 166.041(3), Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Amendment to the Second Revised Land Use Plan. The Conditions of Approval to the Second Revised Land Use Plan for the Plantation Grove PUD, as approved by the Ocoee City Commission on May 5, 1992, and amended by a non -substantial amendment approved by the Ocoee City Commission on November 5, 1996 (the "Second Revised Land Use Plan"), are hereby amended as follows: E A. Condition of Approval # 7 is amended to provide that all building setbacks from retention ponds in the multiple family parcel be reduced from 25 feet to 15 feet. B. Condition of Approval # 25 is added to read: "Due to the spacing of the entry road for multifamily portions of this project, the developer may be required to install concrete median separators within Moore Road as part' of the Final Site Plan for Phase III of the commercial portion of the PUD." C. The Additional Conditions of Approval are amended by reducing the minimum net living floor area in Parcel "A" (multi -family area) from 750 square feet to 650 square feet. D. A Waiver Table is added which reduces the parking space depth from the Code requirement of 20 feet to the requested depth of 18 feet with a 2 foot grass overhang. All Amendments are reflected in the Second Revised Land Use Plan for the Plantation Grove PUD of June 1998 and date stamped received by the City on June 9, 1998, said plan superseding and replacing all previously approved land use plans for the Plantation Grove PUD. All references to the Land Use Plan or the Second Revised Land Use Plan for the Plantation Grove PUD shall hereafter refer to the aforementioned plan which is hereby approved by the City Commission. SECTION 3. Ocoee Comprehensive Plgn. The Ocoee City Commission hereby finds that the Amendment is consistent with the Ocoee Comprehensive Plan. SECTION 4. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 5. Effective Date. This Ordinance shall become effective immediately upon passage and adoption.
