BACKGROUND: The Preliminary Subdivision Plan for Ocoee Crossings was approved by the City Commission this past July. This subdivision will include a total of 214 single family residential lots, located just north of the intersection of Maguire Road and Parkridge-Gotha Road, about one quarter mile south of Moore Road. The zoning on the subject property is R-1-AA. Water and sewer services to the subdivision will be provided by Orange County. There are two large wetland areas adjacent to the proposed subdivision, one on the north side and one on the south side, both adjacent to Maguire Road. There is also a small lake in the southeastern portion of the subdivision. Most of the subject property is currently occupied by citrus trees and pine trees; however, there are a significant number of oak trees, particularly near the wetlands and the small lake. DISCUSSION: The Ocoee Crossings subdivision is intended to be a private gated community. It will have two points of access - one from Maguire Road and one from "H" Street just east of its intersection with Maguire Road. "H" Street will be a public road, but all the other roads within the subdivision will be private. There will be a 6 foot brick wall with appropriate landscaping along P0WI' Protect Ilceee's Water Reseurces w (a/L " October 29, 1999 Honorable Mayor and City Commissioners Page 2 all the boundaries of the subdivision adjacent to Maguire Road, Parkridge-Gotha Road, and along "H" Street at Lots 14 and 15. There will be a landscape buffer planted with a continuous row of trees along the north side of Retention Pond"C" (south side of"H" Street). A unique feature of this subdivision is that it includes land for a Future School and Park Site in the northeastern portion of the site. The Orange County School Board has a contract to purchase a tract of land containing just under 25 acres in the eastern portion of the subdivision for use as an elementary school site and a public park for the City of Ocoee. It is the intent of the School Board to swap a portion of its land for another portion of the Developer's land to place the school and park site entirely along the northern edge of the subdivision. Retention Pond "C" will be a joint use pond providing treatment for stormwater from Maguire Road, the school site, the park site and from part of the subdivision. Since it will be a joint use pond, the ownership and maintenance of that pond will be transferred to the City. Tract "L", the wetland area north of "H" Street, will also be transferred to the City. Per City Code requirements, conservation easements will be provided over both of the wetland areas within the subdivision and the small lake, and all development will remain outside the 100 year flood plain. The two small recreation areas for the project are located near the northeast side of the small lake and will be constructed with the first phase of the subdivision. There will also be two pedestrian access points to the Future School and Park Site. In conjunction with the Final Subdivision Plan for Ocoee Crossings, a Development Agreement is currently being processed. This Agreement addresses the construction and joint use of Retention Pond "C" and the construction of"H" Street which will provide access to the park. The Development Agreement will be considered for approval by the City Commission on the same meeting agenda as that for the Final Subdivision Plan. The Final Subdivision Plan for the Ocoee Crossings subdivision was reviewed by the Development Review Committee (DRC) on October 20, 1999. The Committee voted unanimously to recommend approval of the Final Subdivision Plan, subject to having certain revisions made which were identified in the written comments prepared by staff, and subject to Gotha Development, Inc. acquiring fee simple title to the real property within Ocoee Crossings on or before December 31, 1999. All of the revisions requested by the DRC have been satisfactorily addressed in these plans. PLANNING & ZONING COMMISSION MEETING AND RECOMMENDATION: On October 27, 1999, the Planning and Zoning Commission considered the Ocoee Crossings Final Subdivision Plan. The applicant was available to answer questions. Staff informed the Commission that there had been a few minor engineering issues to be addressed on the Plan, but the City Engineer was now satisfied with recent revisions. After a brief discussion, the Planning and Zoning Commission voted unanimously to recommend approval of the Ocoee Crossings Final Subdivision Plan in accordance with the staff recommendation. October 29, 1999 Honorable Mayor and City Commissioners Page 3 STAFF RECOMMENDATION: Based on the recommendations of the DRC and the Planning and Zoning Commission, Staff respectfully recommends that the Mayor and City Commission approve the Final Subdivision Plan for Ocoee Crossings, as date stamped received by the City on October 29, 1999,subject to: A) City Commission approval of the Ocoee Crossings Development Agreement regarding Tract"C" and "H" Street; and B) Gotha Development, Inc. acquiring fee simple title to the real property within Ocoee Crossings on or before December 31, 1999. C) The project Homeowners Association documents to stipulate compliance with Orange County Resolution No. 96-M-22 Minimum Standard Conditions of Approval pertaining to maintenance of private roads and drainage systems.
