SUBJECT: Water Distribution Mains -Phase 1 Project
Change Order Request No. 1
Attached for your review is Change Order Request No. 1 on the Water Distribution Mains -
Phase 1 Project with Wharton-Smith, Inc. The Phase 1 Project included new water mains along
Hackney-Prairie, from the Forest Oaks WTP to Rich Drive; Wurst Road, from the Jamela WTP
to Clarcona-Ocoee Road; and Clarcona-Ocoee Road, from Wurst Road to Fifteenth Street. This
change order request was initiated by City Staff to delete work impacted by inability to obtain
temporary construction easements.
The items included in this change order are:
Item 1-A- Deletion of Water Main on Wurst Road from Peters Avenue to Clarcona-Ocoee
Road:
The residents who lived on both sides of Clarcona-Ocoee Road refused to grant or negotiate with
the City for temporary construction easements necessary to install the water main under
Clarcona-Ocoee Road by the method of boring and jacking a steel casing pipe. Staff and PEC,
Inc. re-evaluated all the pipeline work planned for this general area and determined that the water
main on Wurst Road, from Peters Avenue to and across Clarcona-Ocoee Road, could be
eliminated from the program as well as the water main planned to extend east from Fuller's
Cross Road across private property and along Fifth Street and connect to the water main on
Adair Street.
These two water mains are being replaced with the water mains along Eleventh Street, Peters
Avenue, and through Vignetti Park, which will provide the connection between Clarcona-Ocoee
Road and Adair Street that is required. This project was authorized for award for construction at
the October 5, 1999, City Commission Meeting and should begin construction in early
November. Although approximately 4,600 linear feet of water main was added against an

approximate 4,000 linear foot reduction, the costs were approximately equal in value and this
does not take into account legal and right-of-way associated with securing easements. The cost
to delete this work was $54,100.00, with no adjustment in contract time.
Item 1-B: Deletion of Water Main on Clarcona-Ocoee Road from Wurst Road to Fifteenth
Street:
The resident who lived on the west side of Clarcona-Ocoee Road at Fifteenth Street was
requesting more compensation than was justified for a temporary construction easement. In
addition, more buried telephone cables were discovered at Wurst Road than was originally
identified during design and would have necessitated negotiating a different unit price for the
water main installation along Clarcona-Ocoee Road. Staff is looking at rerouting the planned
water main layout to accomplish the design intent and has approached Orange County about
open-cutting Clarcona-Ocoee Road to install the water main at Fifteenth Street. The cost to
delete this work was $19,920.00, with no adjustment in contract time.
The total cost reduction for this change order is $74,020.00 with no adjustment in the contract
time. This change order amounts to approximately 18.88 percent reduction in the original bid
price of$392,000.00.
I recommend that the City Commission approve Change Order No. 1 with Wharton-Smith, Inc.
by decreasing the contract amount by $74,020.00, with no adjustment in contract time, and
authorize the Mayor and City Clerk to execute Change Order No. 1.

CHANGES ORDERED:
I. GENERAL
This change order is necessary to cover changes in the work to be performed under this Contract. The
GENERAL CONDITION, SUPPLEMENTARY CONDITIONS, SPECIFICATIONS and all parts of the
Project Manual listed in Article 1, Definitions, of the GENERAL CONDITIONS apply to and govern all
work under this change order.
II. REQUIRED CHANGES
Item 1-A: RPC 001: Delete the 12 inch water main along Wurst Road from Peters Avenue to Clarcona-Ocoee Road
including the crossing of Clarcona-Ocoee Road and all other ancillary items such as valves, fire hydrants, fittings
and the crossing of Wurst Road at Broad Street.
Item 1-B:RPC 002: Delete the 12 inch water main along Clarcona-Ocoee Road from Wurst Road to Fifteenth Street
including the crossing of Clarcona-Ocoee Road at Fifteenth Street and all other ancillary items such as valves and',
fittings.
III. JUSTIFICATION
Item 1-A: RPC 001: The residents who lived on both sides of Clarcona-Ocoee Road refused to grant or negotiate',

The aforementioned change, and work affected thereby, is subject to all provisions of the original contract not
specifically changed by this Change Order;and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original
contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in
Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs and
modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other
claim for increased costs of performance or modifications of time will be granted by the OWNER for the Work
covered by this Change Order. The CONTRACTOR hereby waives and releases any further claims for cost or time
against the OWNER arising from or relating to the matters or Work set forth or contemplated by this Change Order.
