11-28-2006 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING November 28, 2006 CALL TO ORDER Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:00 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation and the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Vice Chair Chancey, Members Ballard, M. Godek, Hopper, Morton, Stanley and Alternate Member Lowery. Also present were Code Enforcement Supervisor Loeffler, Code Enforcement Officers Braddy-Bagwell, and Rodriguez, Permitting Clerk Ramos, and Deputy City Clerk Sibbitt. ABSENT: None Permitting Clerk Ramos administered the oath to Code Enforcement Officers Braddy- Bagwell, Loeffler, Rodriguez, and anyone intending to speak regarding a case. Officer Rodrigruez Re-Inspection Date: 10-16-06 Meeting Date: 10-24-06 Certified Mail Officer Rodriguez gave a detailed history of the case and provided exhibits. She further announced the property was in non-compliance as of November 28,2006. Chairman Godek inquired if anyone was living in the residence and if it is known if the owner has received any of the letters mailed out. Officer Rodriquez stated the property is vacant and the letters are all unclaimed. Member Morton inquired if any neighbors have seen the owners at the home. Officer Rodriguez stated she has noticed that many homes in the ForestBrooke subdivision were purchased for investment properties and the owners do not physically live in the residence. Member Hopper inquired if the City would cut the grass and send the owners the bill. Officer Loeffler stated in the past with the correct budget they have taken action but with the dry season and this being the only house in that subdivision with overgrowth problem the City will not be mowing the grass. Member Stanley inquired as to why the HOA was not cutting the grass and billing the owners. Officer Rodriguez stated the Page 2 of3 Code Enforcement Board Minutes November 28, 2006 complaint she received was from the HOA and she does not believe they take care of that problem. Member Morton inquired if the City could try to locate the owner since the owner is unaware of his violation. Officer Loeffier stated that per Florida State Statute as long as they have sent out regular and certified mail and it comes back they have due process and can post the property. Member HODDer. seconded bv Member Morton, moved in Case No. 06-128 to find the respondent in violation as cited as of September 15, 2006. and be given until January 15, 2007, to come into compliance or be fined $25/per dav thereafter. Motion failed 5-2 with Chairman Godek, Vice Chair Chancev, Members Ballard, Morton, and Stanlev opposin!!. Member Ballard. seconded bv Vice Chair Chancev, moved in Case No. 06-128 to find the reslJondent in violation as cited as of SelJtember 15, 2006, and be given until December 8, 2006, to come into compliance or be fined $50/per day thereafter. Motion carried unanimous Iv. COMMENTS Discussion on December Meeting - A brief discussion ensued regarding cancelling the December Meeting. Member Morton. seconded bv Member Ballard. moved to have the next Code Enforcement Board Meeting in January. Motion carried unanimouslv. Officer Loeffler provided before/after exhibits of the old tattoo parlor and old laundry mat and how the area was cleaned up.
