I irector SUBJECT: Forest Oaks and South Water Treatment Plants Well Pumps and Ground Storage Tanks Project,Bid No. B96-05 Change Order Request No. 1 Attached for your review is Change Order Request No. 1 on the Forest Oaks and South Water Treatment Plants Well Pumps and Ground Storage Tanks Project, Bid No. B96-05. This change order request was initiated by City staff due to operational problems at the treatment plants that occurred after PEC had completed design and the City was in receipt of the bids for the improvements currently under construction. This additional construction request initiated due to a multitude of cascading problems. For approximately three months in the spring of this year, we experienced periods of operation when all four high service pumps were operating at the South Plant and we were unable to maintain system pressure in the southern portion of our distribution system even with the Forest Oaks and Jamela Plants on line. In May of this year, the variable speed driver on one of the high service pumps at the Forest Oaks Plant went out of service and needed to be replaced. Due to the age of a similar high service pump at the Forest Oaks Plant, it is anticipated that its variable speed driver will need to be replaced in the near future. Additionally, the City has been experiencing excessive growth over the past few years,this growth rate is above what PEC had projected in the Water Master Plan. With the addition of the West Oaks Mall and the potential additional growth in that portion of the City,the addition of these pumps and controllers are needed so that the City can continue to provide drinking water and fire protection to the residents and businesses in the manner in which the City has in the past. PEC had foreseen these type of improvements and had proposed recommendations in the Water Master Plan as a near-term future project, but the growth within the City has accelerated that time schedule to a more immediate need. PEC has proceeded with the design of the needed improvements and has negotiated with Wharton-Smith, Inc. for the change order. PEC has recommended that the change order be THE PRIDE OF WEST ORANGE Gd The Honorable Mayor and Board of City Commissioners September 26, 1996 Page Two approved as negotiated with the intent so the contractor can order the materials in a timely manner to facilitate installation without requesting a time extension. The change order request is for$261,086.33, and does not include a request for a contract time extension. This represents an increase of 11.33% over the original contract price of$2,304,000. Although this amount is over the project's budgeted contingency amount of 10%, there are sufficient funds in the operations account to cover this overrun in the Contingency Fund. The alternative to change ordering this work into Wharton-Smith's contract would be to wait until Wharton-Smith has completed their work at the plants and advertise this work as a separate construction project. This would entail the preparation of complete contract documents, technical specification and design drawings,the advertisement/bidding process, complete construction process and field inspection services. Besides the additional engineering costs associated with making this a separate project, the construction dollars would also increase due to contractor mobilization, administration, demolition of some equipment being installed by Wharton-Smith, instead of"swapping out"prior to installing, and construction around equipment installed by Wharton-Smith under the current construction contract. Staff concurs with PEC that the Change Order route is most cost effective, less time consuming, and will have the equipment in place by next spring than the separate bid alternative. I recommend that the City Commission approve Change Order No. 1 by increasing the contract amount by$261,086.33, with no extension in contract time, and authorize the Mayor and City Clerk to execute Change Order No. 1. NARRATIVE OF NEGOTIATIONS Extension of Contract Time The Contractor agreed to perform work in accordance with the Engineer's projected construction schedule which extended substantial completion date 14 calendar days. No change with regard to final completion date is made. Items 1-A Item 1-A RFP No.2 detailing required HSP additions was transmitted to the Contractor by the Engineer on August 19, 1996. The Contractor transmitted CPS No.2 on August 28, 1996 at total reimbursement value of$284,106.25. Negotiations lowered total value of Work to $261,08633 (More basic pump and motor package at $250,323.85 plus Engineers recommended optional items at a value of$10,762.48). Final values are represented in Engineer's Recommendation of September 19, 1996 and CPS 2A. VI.
