GLASS JIM GLEASON CITY MANAGER ELLIS SHAPIRO Should the Honorable Mayor and City Commissioners adopt Ordinance No. 96-08 which will approve a revision to the Prairie Lake PUD - Land Use Plan to permit a fire station/ public services building to be located on proposed Tract J? BACKGROUND: Prairie Lake PUD, a 280-acre multi -use project located north of A.D. Mims Road situated east and west of Clarke Road extended, was originally approved by the City Commission on December 9, 1986.. On April 16, 1991, a Substantial Amendment was approved to the PUD that provided an overall residential density of 1,746 units. In order to accommodate growth, the City of Ocoee has been looking for a fire station site in the northeast quadrant to reduce fire response times to homes and businesses in that vicinity. After reviewing various sites, the City has negotiated to purchase a 2.06 acre tract from the owner of the Prairie Lake PUD property. Before purchasing the fire station site, the City has applied for an Amendment to permit the proposed fire station/ public services building to be built on a new 2.06 acre parcel within Tract D (see proposed Tract J on the revised PUD Land Use Plan). A purchase agreement will be presented to the City Commission for approval in conjunction with this action. DISCUSSION: Per Section 4-5 (D)(1) of the Ocoee Land Development Code (LDC) any alterations to the approved Land Use Plan must be classified as either Substantial or Non -Substantial Amendments. Substantial Amendments are amendments which: (a.) Include a land use not previously permitted under the approved PUD Zoning; (b.) Would alter the land use type adjacent to a property boundary; (c.) Would require an amendment to the Conditions of Approval; (d.) Would increase the land use intensity within a development phase without a corresponding decrease in some other portion of the overall PUD; (e.) Amend the phasing to propose a land use in advance of the development it was designed to support; and (f.) Make any changes of a similar nature, complexity or approval process. Page 2 The Honorable Mayor and City Commissioners May 15, 1996 Upon review, the DRC determined that the proposed amendment should be classified as a Substantial Amendment because it allows a land use not previously permitted (fire station/ public services building) and would require an amendment to the Conditions of Approval. PLANNING AND ZONING COMMISSION RECOMMENDATION: On May 14, 1996, the Planning and Zoning Commission unanimously approved the proposed Amendment including revisions to the Land Use Plan and additional Conditions of Approval per the Staff recommendation. STAFF RECOMMENDATION: On April 23, 1996, the DRC unanimously approved the proposed Amendment including revisions to the Land Use Plan and additional Conditions of Approval. Based upon these actions, Staff respectfully recommends that the City Commission approve Ordinance No. 96-08. WHEREAS, the City of Ocoee, on behalf of the owner of certain real property located within the corporate limits of the City of Ocoee, Florida, as described in Exhibit "A" attached hereto, has petitioned the City Commission of the City of Ocoee, Florida ("the Ocoee City Commission") to approve revisions ("Substantial Amendment") to the Land Use Plan for the Prairie Lake PUD, as approved by the Ocoee City Commission on April 16, 1991 ("the Approved Land Use Plan"); and WHEREAS, pursuant to Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida ("the Ocoee City Code"), the Planning Director has reviewed said petition and determined that the Substantial Amendment is consistent with the City of Ocoee Comprehensive Plan ("the Ocoee Comprehensive Plan"); and WHEREAS, the Substantial Amendment was scheduled for study and recommendation by the Planning and Zoning Commission of the City of Ocoee, Florida ("the Ocoee Planning and Zoning Commission"); and WHEREAS, the Ocoee Planning and Zoning Commission has reviewed the Substantial Amendment for consistency with the Ocoee Comprehensive Plan and determined that the Substantial Amendment is consistent with the Ocoee Comprehensive Plan and is in the best interest of the City and has recommended to the Ocoee City Commission that it approve the Substantial Amendment and find it consistent with the Ocoee Comprehensive Plan; WHEREAS, the Ocoee City Commission has held a de novo public hearing with official notice thereof with respect to the proposed Substantial Amendment; WHEREAS, the Ocoee City Commission has determined that the Substantial Amendment is consistent with the Ocoee Comprehensive Plan; WHEREAS, this Ordinance has been considered by the Ocoee City Commission in accordance with the procedures set forth in Section 166.041(3), Florida Statutes; and WHEREAS, upon approval of this Ordinance the City intends to purchase that certain real property located within the Prairie Lake PUD, as more particularly described in Exhibit "B" attached hereto ("Tract J"). NOW, THEREFORE, BE IT ENACTED BY THE OCOEE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authority. The Ocoee City Commission has the authority to adopt this ordinance pursuant to Article Vill of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Substantial Amendment to the Approved Land Use Plan. The Approved Land Use Plan, as approved by the Ocoee City Commission on April 16, 1991, is hereby amended 'as follows for Tract J of the Prairie Lake PUD, as shown on the amended Approved Land Use Plan: A. The Revised Land Use Plan for the Prairie Lake PUD dated May 9, 1996 is hereby approved, subject to the terms and conditions set forth in this Ordinance ("the Revised Land Use Plan"). The Revised Land Use Plan supersedes the Approved Land Use Plan. B. The following Conditions of Approval are hereby established with respect to Tract J as shown on the Revised Land Use Plan: (1.) The building setbacks for the fire station/ public services building to be located on Tract J are: Clarke Road - 50' Street Side - 35' Side (other) - 20' Rear - 30'. Maximum height allowed is 35'. Maximum impervious area is 70%. (2.) Tract J shall be screened from adjacent properties using landscaping and decorative fencing. (3.) The site plan for Tract J shall conform to all other City of Ocoee Land Development Code requirements. (4.) No further public hearings shall be required prior to construction on Tract J. (5.) The use of Tract J shall revert to its previously approved use should the City fail to close on Tract J or determine that Tract J is not viable for use as a fire station/ public services building. (6.) The table entitled "Proposed Amendment 1996" ("Exhibit D" attached hereto) is to be attached to the Amended Prairie Lake PUD - Land Use Plan. (7.) Tract J is permitted for a fire station/ public services building to be constructed upon it. SECTION 3. Ocoee Comprehensive Plan. The Ocoee City Commission hereby finds that the Substantial Amendment is consistent with the Ocoee Comprehensive Plan. SECTION 4. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not effect the validity of the remaining portion hereto. SECTION 5. Conflicts. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6.
