VI (F) Discussion/ Action re: Results of Bid for Sale of Surplus Property AGENDA 3-4-97 Item VI I MEMORANDUM TO: The Honorable Mayor and City Commissioners of the City of Ocoee FROM: Paul E. Rosenthal, Esq., City Attorney DATE: February 28, 1997 RE: Bid No. B97-05, Sale of City Owned Surplus Real Estate By Memorandum dated February 12, 1997, City Manager Ellis Shapiro has provided you with information regarding the above-referenced bid. A copy of his Memorandum is attached. Pursuant to the direction of the City Commission, Mr. Shapiro, Mr. Shira and I met with Tom West to discuss the possible future use of a portion of the bid property in connection with an extension of the West Orange Trail. In connection with these discussions, Mr. Shira advised that a 60 foot wide right-of-way adjacent to the railroad right-of-way should be obtained in order to he consistent with the width of the former railroad right-of-way on other lands owned by the City. After discussing several options with Mr. West, it was agreed, in concept, that the best approach would be for the City to reserve in the deed of conveyance an unconditional right to repurchase, for a term of three years, the aforementioned 60 foot wide strip. The repurchase price would he on a gross square footage basis based upon the same gross square foot purchase price paid by Mr. West to the City. In the event the City did not repurchase the referenced portion of the bid property within three years, then the City would have no future rights with respect to the property. The staff did not believe that there was a present need to retain title to the 60' strip and reduce the current funds to be paid to the City. Also, an easement did not appear to address future needs. In the event the City Commission concurs with the above proposal and desires to award the bid to Tom West, it is then recommended that the following action he taken: That the Honorable Mayor and Board of City Commissioners award Ocoee Site No. 2, identified as 102 West Ohio Street, to Tom West for a bid purchase price of$84,100 with the condition that the deed of conveyance reserve in favor of the City of Ocoee a right to repurchase, for a term of three years, a 60 foot wide strip of land adjacent to the railroad right-of-way with the repurchase price being on a gross square foot basis based upon the gross square foot purchase price paid by Tom West for the subject property and with the final documentation for such right of repurchase being acceptable to the City in its discretion, and further, that the Mayor and City Clerk be authorized to execute all necessary closing documents in connection therewith. end. cc: Ellis Shapiro P.MM[WFR NIIlN4716,MEM 12/28/97118SIXA I PER:c I / t
