L Department Director: Contact Number: Ext. 1016 City Manager: Subject: OCPS Substantial Amendment to the Ocoee Crown Point PUD (Planned Unit Development) Project No(s): RZ-19-05-05 Commission District # 1 — Larry Brinson, Sr. Background Summary: The Ocoee Crown Point PUD (see PUD site plan attached hereto as Exhibit "A") is envisioned to be a multi -use project combining an assortment of public uses with residential, office and commercial uses in a high -quality Traditional Neighborhood Development environment. The project was initiated as a joint venture between the City of Ocoee and Orange County Public Schools (OCPS), with the school board retaining ownership of five tracts of land with the largest tract proposed as a bus depot or townhomes. The school board is requesting an amendment to the PUD in order to change the land use from Bus Depot to Workforce Education or Townhomes for tract 13 and to incorporate Workforce Education or Townhomes as a secondary use to the remaining tracts they own. Below is a summary of the changes to the tracts owned by OCPS. • Change the land use of Tract 13 from Bus Depot/Townhome to Workforce Education/Townhomes. • Change the land use of Tract 41 from OCPS Stormwater to Workforce Education/Townhomes. • Change the land use of Tract 7A and 7B from Workforce Education to Workfrorce Education/Townhomes. • Change the land use of Tract 34 from Right -of -Way to Workforce Education/Townhomes. Issue: Should the Honorable Mayor and City Commissioners approve an ordinance for the Substantial Amendment to the Crown Point PUD Land Use Plan (PUD/LUP) for tracts of land owned by Orange County Public Schools (OCPS)? DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: On June 5, 2019, the DRC met to determine if the proposed Substantial Amendment to the Ocoee Crown Point PUD/LUP for tracts of land owned by Orange County Public Schools (OCPS) was consistent with the City's regulations and intent for the sale of land. The Development Review Committee voted unanimously to recommend approval of the Amendment to the Ocoee Crown Point PUD. PLANNING AND ZONING COMMISSION RECOMMENDATION: The Planning and Zoning Commission (P&Z) met on June 11, 2019. The P&Z voted unanimously to recommend approval of the Orange County Public Schools (OCPS) Amendment to the Ocoee Crown Point PUD. STAFF RECOMMENDATION: Staff recommends that the Honorable Mayor and City Commissioners approve an ordinance for a Substantial Amendment to the Crown Point PUD Land Use Plan (PUD/LUP) for tracts of land owned by Orange County Public Schools (OCPS). WHEREAS, the owner of certain real property located within the corporate limits of the City of Ocoee, Florida, as hereinafter described owner (the "Owner"), has submitted an application to the City Commission of the City of Ocoee, Florida (the "Ocoee City Commission") to approve an amendment (the "Amendment") to the Ocoee Crown Point PUD Land Use Plan, as approved by the Ocoee City Commission on September 16, 2003 (the "PUD"); WHEREAS, the Amendment was scheduled for study and recommendation by the Development Review Committee ("DRC") on June 5, 2019; and WHEREAS, the DRC recommended approval of said Amendment; and WHEREAS, the Amendment was scheduled for study and recommendation by the Planning and Zoning Commission of the City of Ocoee ("P&Z") on June 11, 2019; WHEREAS, on June 11, 2019, the P&Z held an advertised public hearing on the Amendment and, after discussion, recommended approval of the amendment; and WHEREAS, on , 2019, the Ocoee City Commission has held an advertised de novo public hearing with respect to the proposed Amendment and this Ordinance and determined that the amendment to the PUD is consistent with the City of Ocoee Comprehensive Plan, as amended; and WHEREAS, this Ordinance has been considered by the Ocoee City Commission in accordance with the procedures set forth in Section 166.041(3), Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Amendment to PUD. The Amendment to the PUD, as prepared by AVCON, Inc., Engineers and Planners, date stamped received by the City of Ocoee on May 31, 2019, with such additional revisions thereto, if any, as may be reflected in the minutes of the City Commission of the City of Ocoee meeting approving same, is hereby approved, subject to the Conditions of Approval as first approved on September 16, 2003 and subsequently amended. The Amendment to the PUD is attached hereto as Exhibit "A", and by this reference made a part hereof. As described herein, the Amendment to the PUD amends the previously approved PUD for Ocoee Crown Point PUD as indicated on said Amendment. All references to the PUD or the -2- Amended PUD for Ocoee Crown Point PUD shall hereafter refer to the previously approved PUD for Ocoee Crown Point PUD as amended by the attached Amendment to the PUD. SECTION 3. Ocoee Comprehensive Plan. The Ocoee City Commission hereby finds that this Ordinance is consistent with the Ocoee Comprehensive Plan. SECTION 4. Inconsistent Ordinances. All ordinances or parts of ordinances in conflict or inconsistent herewith are repealed and rescinded as of the effective date of this Ordinance. SECTION 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 6. Effective Date. This Ordinance shall become effective ten (10) days after its passage and adoption.
