BACKGROUND: The Ocoee Crossings subdivision will include a total of 215 single family residential lots, located just north of the intersection of Maguire Road and Parkridge-Gotha Road, about one quarter mile south of Moore Road. The zoning on the subject property is R-1-AA. There me two small areas on the south side of the subdivision with A-1 zoning, which are not part of this development. The property to the north has PUD zoning (Westridge PUD), and the property east, west and south of the subdivision is in Orange County with Agricultural, PUD and RCE zoning respectively. Water and sewer services to the subdivision will be provided by Orange County. There are two large wetland areas adjacent to the proposed subdivision, one on the north side and one on the south side, both adjacent to Maguire Road. There is also a small lake in the southeastern portion of the subdivision. Most of the subject property is currently occupied by citrus trees and pine trees; however, there are a significant number of oak trees, particularly near the wetlands and the small lake. DISCUSSION: The Ocoee Crossings subdivision is intended to be a private gated community. It will have two points of access - one from Maguire Road and one from "H" Street just east of its intersection with Maguire Road. "H" Street will be a public road, but all the other roads within the subdivision will be private. There will be a 6 foot brick wall with appropriate landscaping along YfOfNCfPfOfBOf EC09" July 16, 1999 Honorable Mayor and City Commissioners Page 2 the entire western boundary of the subdivision adjacent to Maguire Road (except along Retention Pond "A") and along "H" Street at Lots 14 and 15. Rather than a brick wall, there will be a decorative metal fence with brick columns in front of the retention pond on Maguire Road. There will be a landscape easement planted with a continuous row of trees along the north side of Retention Pond "C" (south side of "H" Street) and along most of Parkridge-Gotha Road. At the rear of Lots 85 and 86 (along Parkridge-Gotha Road) there will be a 6 foot brick wall with appropriate landscaping. A unique feature of this subdivision is that it includes land for a school and park site (Tract "N"). The Orange County School Board has a contract to purchase a tract of land containing just under 25 acres in the eastern portion of the subdivision for use as an elementary school site and a public park for the City of Ocoee. It is the intent of the School Board to swap a portion of its land for another portion of the Developer's land to place the school and park site entirely along the northern edge of the subdivision. Retention Pond "C" will be a joint use pond providing treatment for stormwater from Maguire Road, the school site, the park site and from the subdivision. Since it will be ajoint use pond, the ownership and maintenance of that pond will be transferred to the City. Tract "L", the wetland area north of "H" Street, will also be transferred to the City. Per City Code requirements, conservation easements will be provided over both of the wetland areas within the subdivision and the small lake, and all development will remain outside the 100 year flood plain. The two small recreation areas for the project are located near the northeast side of the small lake and will be constructed with the first phase of the subdivision. There will also be two pedestrian access points to the school and park site (Tract "N"). In conjunction with the Preliminary Subdivision Plan for Ocoee Crossings, a Developer Agreement related to the Maguire Road widening improvements and the school/park site swap is currently being processed. This Agreement addresses the construction and joint use of Retention Pond "C", the construction of "H" Street which will provide access to the park, and the transfer of Tract "N" for the school/park site. The Developer Agreement will be considered for approval by the City Commission on the same meeting agenda as that for the Final Subdivision Plan. The attached Preliminary Subdivision Plan for the Ocoee Crossings subdivision was reviewed by the Development Review Committee (DRC) on June 22, 1999. The Committee voted unanimously to recommend approval of the Preliminary Subdivision Plan, subject to several minor revisions. Almost all of the revisions requested by the DRC have been satisfactorily addressed in these plans. The few remaining issues are addressed in the Staff Recommendation. PLANNING & ZONING COMMISSION MEETING AND RECOMMENDATION On July 13, 1999, the Planning and Zoning Commission held a public hearing regarding the Ocoee Crossings Preliminary Subdivision Plan. During the hearing, other than a representative for the applicant, there was only one other speaker from the audience - the President of the Home Owners' Association from the neighborhood on the south side of Parkridge-Gotha Road. He wanted clarification on a few issues, which was provided, and he wanted to minimize construction traffic on Parkridge-Gotha Road. He also wanted either a brick wall or wrought iron fencing (not decorative metal) behind the ponds backing up to Parkridge-Gotha Road. July 16, 1999 Honorable Mayor and City Commissioners Page 3 When the discussion was finished, the Planning and Zoning Commission voted unanimously to recommend approval of the Ocoee Crossings Preliminary Subdivision Plan, date stamped received by the City on July 9, 1999, in accordance with the staff recommendation, and subject to: 1) Adding some clarification to Condition # 23; 2) Minimizing construction traffic on Parkridge-Gotha Road; and, 3) Requiring either a brick wall or the Retention Pond Fencing (with a wrought iron fence) between Parkridge-Gotha Road and Retention Ponds "E" and "F", the choice of which option to use would be made by the Developer. STAFF RECOMMENDATION: Based on the recommendations of the DRC and the Planning and Zoning Commission, Staff respectfully recommends that the Mayor and City Commission approve the Preliminary Subdivision Plan for Ocoee Crossings, as date stamped received by the City on July 9, 1999, subject to: A) Providing an additional Condition of Approval to comply with Comment # I of the Memo from Martha Formella to Ellen King, dated June 16, 1999 (copy attached). The new Condition will summarize the elements of the Developer Agreement regarding shared drainage, roads and Tract "N"; and B) The following minor revisions being made to the Plan: 1) Provide a title for the Waiver table on Sheet 1. 2) Provide a heavy dashed line to clearly show the phase line on Sheet 1. 3) Provide a 5' concrete sidewalk along the south side of "H" Street. 4) Provide a 5' setback between Pond "F" and the landscape easement along Parkridge-Gotha Road. 5) Revise the arrows showing the location of wetland plantings for Tract "L" to show them on the north side of "H" Street rather than the south side. C) Including the additional changes on the Plan identified in the Planning and Zoning Commission recommendation. Preliminary Subdivision Plan for Ocoee Crossings stamped received by the City of Ocoee May 27, 1999 ("PSP"); 2. Response letter from Jeffrey A. Sedloff, P.E., of June Engineering Consultants, Inc. dated May 27, 1999 and stamped received by the City of Ocoee May 27, 1999; 3. Owner's Affidavits for Parcels IA, III, and 4 stamped received by the City of Ocoee May 21, 1999; 4. Owner's Affidavits for Parcels 6 and 7 stamped received by the City of Ocoee May 26, 1999; 5. Boundary Survey prepared by ASM, Inc. stamped received by the City of Ocoee May 21, 1999; and 6. Annexation Agreement dated December 16, 1992 as recorded in O.R. Book 4513, Page 1899, Public Records of Orange County, Florida. This memorandum supersedes our memorandum dated May 13, 1999 ("Prior Memorandum"). Based on our review of the documents noted above pursuant to the new Land Development CI de, we have the following comments: -1- 1. A note which summarizes the elements of a Development Agreement regarding drainage, roads, and Tract N must be included on the Preliminary Subdivision Plan. A proposed note for discussion is set forth below. It shall be a condition precedent to the approval of the Final Subdivision Plan for Ocoee Crossings that the City and the Developer enter into a Development Agreement which addresses the following in a manner acceptable to the City and the Developer: a. The retention pond shown on -Tract C as Pond C shall be a joint use pond for the benefit of the subdivision, Maguire Road, and Tract N (including the proposed City "park site" and the proposed "school site") with the cost of construction of such pond being allocated between the City and the Developer in a manner to be mutually agreed upon; b. The Developer will construct "H" Street as shown on the Preliminary Subdivision Plan and Final Subdivision Plan in accordance with such plans, all at the sole cost and expense of the Developer without any reimbursement from the City or the School Board; C. The Developer will grant to the City and School Board such easements through Ocoee Crossings as may be needed for connection to Pond C; d. Upon completion of construction of Pond C, and acceptance thereof by the City, Pond C will be conveyed to and thereafter maintained by the City at the cost and expense of the City; e. The Developer and the School Board shall have finalized a "land swap agreement" so that the Developer will own fee title to all lands included within Ocoee Crossings, including those lands proposed to be purchased by the School Board with such agreement also providing that the portion of Tract N not owned by the School Board or the City be conveyed to the School Board; and I. The Developer will provide such access easements to the School Board as may be necessary for the School Board to have "insurable legal access" to the proposed school site, provided however that such easement would terminate in the event insurable legal access from 7' Avenue is obtained by the School Board. 2.
