Shira, P.E., City Engineer/Utilities Director SUBJECT: Dorwood Subdivision The proposed plat of this subdivision has been reviewed and approved by the city attorney, city surveyor and city staff. A copy of the plat will be available for your review at the June 26 meeting. At the June 20, 2000 City Commission meeting, consideration of this plat was tabled until June 26, 2000. At the June 20 meeting, a resident raised a question regarding the status of the narrow strip of land running west from Dorwood Avenue. This strip of land is part of the overall tract, and as such is owned in fee simple title by the owner of the overall tract. It is not in itself, an easement, although an access easement which benefits the City of Ocoee exists over a portion of this strip of land. The easement allows Ocoee to traverse this strip of land to gain access to the retention pond for Carriage Oaks subdivision. This easement is shown on the plat as"20'INGRESS/EGRESS EASEMENT ORB 4453, PG 3564" This proposed plat will not eliminate, reduce or in any way affect the city's easement rights. The plat establishes another easement over the entire strip of land that provides for joint access rights for the owners of both of the proposed lots, and assigns maintenance responsibility for the strip of land to the owner of Lot 1. This easement also allows the city to install and maintain utility lines necessary to serve the two lots. This proposed easement is shown on the plat as "INGRESS/EGRESS AND UTILITY EASEMENT" A question was also asked at the June 20 meeting regarding the future condition of the strip of land. I have been informed by the applicant's representative, that their intent is to construct and maintain a gravel driveway from Dorwood Drive to the individual residences. This driveway will not affect the function of the small swale that now exists on the south side of the narrow strip of land. I recommend that the City Commission authorize the Mayor and City Clerk to execute the plat of Dorwood Subdivision. POwNt Portent Ocoee s Water Resources a.`r p
