BACKGROUND: On February 11, 1994, the City of Ocoee and Orange County entered into a Joint Planning Area Agreement. One of the functions of the JPA is the establishment of land use designations for properties located within the Joint Planning Area, but not currently within the municipal boundaries of the City. The JPA has been amended three times; the 1st Amendment amended a land use designation on the JPA Map, the 2nd Amendment amended the text of the original agreement, and the 3rd Amendment amended the boundaries of the Joint Planning Area as well as land uses on the JPA map. The 4th Amendment to the JPA is a proposed land use and boundary change for the "Coke Property" to the JPA Map. DISCUSSION: The subject property is approximately 358 acres in size and is located both east and west of Ocoee-Apopka Road, north of Fullers Cross Road, east of Lake Apopka, and south of West Groves (refer to Exhibit "B" of 4th Amendment of JPA). This Amendment proposes to change the land use designations for approximately 1/3 of the subject property from Low Density Residential to a mixture of Institutional (±48 acres), Commercial ( ±25 acres), and Professional Services (±12 acres). No changes are proposed for that portion of the subject property designated as Conservation on the JPA Map. Additionally, the Amendment includes a change to the JPA boundary and land use to include a ±20 acre portion of the Coke Property (Parcel 8 of Exhibit "B") not originally included in the JPA Map. City staff met with Winter Garden on October 23rd to discuss the extraction of Parcel 8. Winter Garden Staff has agreed to support the extraction of Parcel 8 and pursue an Amendment to the WGJAP. Upon approval of the amendment to the WGJPA by the Winter Garden City Council, Parcel 8 may be incorporated in the Ocoee-Orange County JPA. The following table depicts the proposed land use changes by parcel to the JPA map. The proposal is to develop the site with a mixture of uses to include a Community City Park, two public schools (one Elementary and one High School), a workforce education facility, a bus parking and maintenance facility, public safety uses including a fire station and police/fire training facilities, together with residential, neighborhood commercial and professional service tracts that may be sold to private developers (refer to attached Preferred Development Scenario). The 4th Amendment to the JPA must be adopted by Ocoee City Commission and Orange County Board of County Commissioners with the Ocoee City Commission approving the Amendment first. The Amendment went before the Orange County Local Planning Agency on October 19, 2000, and is scheduled before the Orange County Board of County Commissioners on November 14, 2000. PLANNING AND ZONING COMMISSION: On October 10, 2000, this item went before the Local Planning Agency (LPA). After discussion of a few general items, the LPA recommended approval of the Forth Amendment to the Joint Planning Area Agreement and Map for the Coke Property as depicted in Exhibit "B". Pow r3 Protect Qceee`s:6':ater Resources,`; Page 3 Honorable Mayor and City Commissioners October 27,2000 COMMUNITY MEETING: On October 23, 2000, the City of Ocoee hosted a community meeting to discuss plans for the Coke Property with area residents. The meeting was well attended with approximately 30 attendees. The City Manager, gave an overview of the City's, County's and School Board's plans for the property. The audience asked various questions about the project and potential impacts of the project on the surrounding area. The audience commended the City, County and School Board on taking a proactive approach by locating and providing the City with additional park land, area for public facilities, and new school sites. RECOMMENDATION: Staff recommends that the Honorable Mayor and City Commissioners approve the Fourth Amendment to the Ocoee-Orange County Joint Planning Area Agreement to amend the JPA Map for the Coke Property as depicted in Exhibit "B". RECITALS WHEREAS, the County and the City have entered into a certain Joint Planning Area Agreement, dated February 11, 1994 as amended by the First Amendment thereto dated August 4, 1998, as amended by the Second Amendment thereto dated January 19, 1999 and as amended by the Third Amendment thereto dated November 2, 1999 (hereinafter collectively referred to as the "Joint Planning Area Agreement"); and WHEREAS, the Joint Planning Area Agreement relates to property described therein which is located in and around the boundaries of the City (the "Joint Planning Area"); and WHEREAS, both the County and the City exercise comprehensive planning authority pursuant to Chapter 163, Florida Statutes, the Local Government Comprehensive Planning and Land Development Regulation Act, and enforce land development regulations to regulate the development of land within the respective areas of jurisdiction of each party; and WHEREAS, the County and the City have the authority to enter into this Fourth Amendment pursuant to the Local Government Comprehensive Planning and Land 006.195893.3 DRAFT -Tuesday, October 31, 2000 3:02 PM Development Regulation Act in general and Section 163.3171, Florida Statutes, in particular; and WHEREAS, the provisions of Section 8 of the Joint Planning Area Agreement set forth certain procedures for amending without a comprehensive plan amendment the future land use designations shown on the Joint Planning Area Land Use Map (hereinafter the "JPA Land Use Map"); and WHEREAS, the County and City desire to amend the Joint Planning Area Agreement as it relates to certain parcels of property located in Orange County, Florida, consisting of approximately 358.14 gross acres, more or less, as more particularly described in Exhibit "1" attached hereto and by this reference made a part thereof (hereinafter the "Affected Parcels"); and WHEREAS, the City has entered into a contract to purchase the Affected Parcels and intends to acquire title to the Affected Parcels pursuant to said contract; and WHEREAS, the Affected Parcels are located within the Joint Planning Area except for an approximate 20 acre portion thereof as depicted in Exhibit "2" attached hereof (hereinafter the "Additional Land"); and WHEREAS, the Additional Land is presently subject to that certain Restated Interlocal Agreement for Joint Planning Area between Orange County and the City of Winter Garden with an Effective Date of June 19, 1997 ("Winter Garden JPA Agreement"); and WHEREAS, the City is requesting that the City of Winter Garden consent to the removal of the Additional Land from the Winter Garden JPA Agreement so that it may be included within the Joint Planning Area; and -2- 006.195893.3 WHEREAS, the County and City desire to amend the Joint Planning Area Agreement in order to (i) add the Additional Land to the Joint Planning Area; (ii) amend the JPA Land Use Map to establish a land use designation for the Additional Land; and (iii) amend the land use designations shown on the JPA Land Use Map for a portion of the Affected Parcels (hereinafter collectively referred to as the "Proposed Map Amendment"); and WHEREAS, the City has notified the County of the Proposed Map Amendment pursuant to the provisions of Section 8C of the Joint Planning Area Agreement, and requested that the County amend the JPA Land Use Map as it relates to the Affected Parcels; and WHEREAS, the County has advised the City that it desires that separate public hearings be held with respect to this Fourth Amendment; and WHEREAS, the local planning agencies of both the County and City have considered this Fourth Amendment and recommended its adoption to the Orange County Board of County Commissioners and the Ocoee City Commission, respectively; and WHEREAS, pursuant to Section 163.3171(3), Florida Statutes, this Fourth Amendment has been approved at advertised public hearings held by both the Orange County Board of County Commissioners and the Ocoee City Commission. NOW, THEREFORE, in consideration of the covenants made by each party to the other and of the mutual advantages to be realized by the parties hereto, the receipt and sufficiency of which is hereby acknowledged, the County and the City hereby agree as follows: Section 1. Recitals. The above Recitals are true and correct and are incorporated herein by reference. 006.195893.3 -3 Section 2. Authority. This Fourth Amendment is entered into pursuant to (1) Chapters 125, 163 and 166, Florida Statutes, (2) the general authority of Section 163.01, Florida Statutes, relating to interlocal agreements, (3) the Charters of the County and City, and (4) the Joint Planning Area Agreement. Section 3. Definitions. All terms and phrases used in this Fourth Amendment shall be as defined in the Joint Planning Area Agreement unless otherwise indicated. Section 4. Amendment to Joint Planning Area. The Joint Planning Area as set forth in Exhibit "A" to the Joint Planning Area Agreement, as heretofore amended, is hereby further amended to add the Additional Land (as depicted in Exhibit "2") to the Joint Planning Area. All references in the Joint Planning Area Agreement to Exhibit "A" shall be deemed to refer to and include the Additional Land depicted on Exhibit "2". The provisions of.this Fourth Amendment relating to the inclusion of the Additional Land within the Joint Planning Area shall only become effective if and when the City of Winter Garden consents to the removal of the Additional Land from the Winter Garden JPA Agreement. Such consent shall be evidenced by an amendment to the Winter Garden JPA Agreement which removes the Additional Land from the Winter Garden JPA Agreement. The County hereby agrees to any such amendment which is approved by Winter Garden. Section 5. Amendment to Joint Planning Area Land Use Map. The JPA Land Use Map is hereby amended to establish a land use designation for the Additional Land and change the land use designations for a portion of the Affected Parcels, said new and revised land use designations being as set forth on Exhibit "3" attached hereto and by this reference made a part hereof (hereinafter the "JPA Land Use Map Amendment"). The existing Exhibit -4- 006.195893.3 "B" to the Joint Planning Area Agreement which sets forth the Joint Planning Area Land Use Map is hereby amended by incorporating the JPA Land Use Map Amendment into and making it a part of Exhibit "B" to the Joint Planning Area Agreement. All references in the Joint Planning Area Agreement to Exhibit "B" shall henceforth be deemed to refer to include the JPA Land Use Map Amendment attached hereto as Exhibit "3". Section 6. Affected Parcels; Amendment to Joint Planning Area Agreement. With respect to the Affected Parcels only, the County and City hereby agree that the future land use designations are conceptual and may be modified pursuant to the provisions of this Section 6. It is the City's intention to annex the Affected Parcels and thereafter zone the Affected Parcels generally consistent with the JPA Land Use Map, as amended by this Fourth Amendment, as a mixed-use PUD consisting of the following permitted use categories: Residential, Commercial, Professional Service and Institutional. The parties hereto acknowledge that educational uses, including a high school, elementary school, work force education facility and school bus parking facilities are permitted uses in all of the foregoing land use categories. Recognizing the conceptual nature of the future land use designations and the need to adjust land use boundaries based on the final approved PUD Master Plan for the Affected Parcels, the parties agree that the City may shift land use boundaries and/or shift the land use designations within the Affected Parcels subject to administrative approval of the County Planning Division Manager without the need for approval in accordance with Section 8 of the Joint Planning Area Agreement and without any requirement for public hearings except as may be required under the City's Land Development Code and applicable Florida Statutes. -5- 006.195893.3 Section 7. Continuing Effect. Except as expressly set forth herein, the Joint Planning Area Agreement remains unchanged and in full force and effect.
