RFP #02-001 was advertised on April 28, 2002, a pre-proposal conference was held on May 21, 2002, and the closing date was May 30, 2002. The following four (4) respondents submitted proposal packages: 1. Cingular Wireless 477 Points 2. Nextel Communications 447 Points 3. MetroCall 149/185 Points 4. Verizon Wireless 420 Points The Finance Department has reviewed the proposals and all were considered responsive. Copies of all proposals are available in the finance department for your review. All four (4) proposals were evaluated by the RFP selection committee, which consisted of six (6) members: Commissioner Scott Anderson; Brian Ross, Information Systems Department; Pam Brosonski, Finance Department; Ron Strosnider, Fire Department; Tony Wilson, Police Department; Martin Velie, Protective Inspections Department; and David Wheeler, Utilities/Public Works Department. The four (4) public RFP Selection Committee meetings were held on 6/18/02, 7/03/02, 7/17/02, and 8/06/02 with question and answer sessions with the respondents. Please see the attached Attendee Signature Sheets and the overall evaluation form ranking the respondents. Parker, Dist net 4 MEMORANDUM TO: The Honorable Mayor and City Commissioners FROM: Brian Ross, Information Systems Manager L"/2„---- DATE: August 8, 2002 RE: RFP 02-002 Award Recommendation The Wireless Communications Selection Committee consisting of Scott Anderson, Pam Brosonski, Johnny Farmer, Brian Ross, Ron Strosnider, Martin Velie/Jim Washington, David Wheeler, and Tony Wilson met on 6/18/02, 7/3/02, 7/17/02, and 8/6/02 to discuss the proposals presented by Cingular Wireless, MetroCall, Nextel, and Verizon Wireless. This committee ranked the proposers and eliminated MetroCall due to their financial problems and Verizon Wireless due to their low performance/price ratio, thereby making Cingular Wireless and Nextel the top two proposals. Information Systems distributed phones from Nextel and Cingular Wireless for demonstrations by each department. After these demonstrations,the committee recommends the Motorola V60t (supervisor)and Nokia 3360 (staff)from Cingular Wireless and the Motorola i85s (supervisor) and Motorola i 1000 Plus(staff)from Nextel as the standard phones from the vendors. Each vendor's phones and services worked throughout most of the tested area in the Southeast. The most notable area of signal loss was in the Florida panhandle and Northern Georgia(especially away from the interstate highways) for Nextel and some areas in North Georgia for Cingular Wireless_ TheSelection Committee recognizes three possible uses for cell phones within the City, thus affecting the vendor of choice. The first, and most obvious use of a cell phone is for communication while out in the field. The second use is to replace the City's pagers, which are suffering from numerous service problems and a rate increase. The third option is to use a cell phone in place of expensive 800 MHz radios for non-emergency staff and keep the existing radios for EOC and emergency back up. The first scenario is to purchase phones to replace the pagers and provide communications while in the field. Under this scenario, the Selection Committee recommends awarding the bid to Cingular Wireless because they offer a service plan that costs only a few dollars more per month than the City currently pays for its pagers. With this scenario, certain staff will carry a cell phone and an 800 MHz radio for communication. The second scenario is to use the cell phone as a remote communications device and a replacement for pagers and 800 MHz radios for non-emergency personnel. For this scenario, the Selection Committee recommends using Nextel because they have a group-calling feature which functions similarly to the 800 MHz radios, unlike the service plans offered by Cingular Wireless. In this scenario Public Safety personnel will carry a cell phone and radio and non-emergency personnel will carry just a cell phone. However, because the Nextel wireless service costs more per month than that proposed by Cingular Wireless and because Public Safety personnel will not use the Nextel radio feature to replace their 800 MHz radios, this option carries an expense for unwanted features. To reduce this expense by paying only for those services needed, the Selection Committee recommends using Cingular Wireless for Public Safety personnel to replace cell phones and pagers and using Nextel for all other departments to replace cell phones, pagers and 800 MHz radios. Non- emergency departments will keep some of the 800 MHz radios for communication with Public Safety during EOC activation and other special events. The City employs three hundred twenty-five people in addition to five elected officials. The City currently leases eighteen (18) 1.5-way pagers. The City's goal is to cost effectively provide staff with one of two types of communications devices that can handle all the City's communications needs. This includes a standard communications device for most employees, and a communications device with personal digital assistant features for supervisors and elected officials. It is the City's intention to Ireduce costs by replacing several devices with a single, less expensive one. The City is currently under contract with various companies to provide the above-mentioned services. It is the intent of the City not to renew these existing contracts at the time of their expiration. Then, the City will provide communication services from the contract resulting from this Request for Proposal. The City desires to define two standard types of telephones. The first shall be referred to as a "Staff Phone" and is defined in Appendix B. The second shall be labeled a I "Supervisor Phone" and is defined in Appendix C. Please provide an itemized list of components with total prices for each standard. Over three years ago, Cingular began an effort to converge TDMA and GSM communities, establish a worldwide footprint, and offer products that are TDMA/GSM compatible. Led by the current Cingular partners, a formal alliance between the TDMA industry and the GSM Association resulted in the formation of the GSM/ANSI-136 Interoperability Team (GAIT). GAIT provides a seamless gateway between GSM and TDMA technologies. Cingular currently supports digital TDMA, GSM, and analog transmission technologies. We are deploying voice and wireless application protocol (WAP)/circuit switched data (CSD) enabled devices, which are capable of operating on both TDMA and GSM networks. These multi-mode devices are commonly referred to as GAIT phones and are scheduled for rollout during 2002. Many of these operators already have roaming relationships with Cingular. GSM serves 55 percent of all subscribers and 65 percent of digital subscribers. Due to the convergence of network technologies, wireless voice/data services and network control functions are becoming seamlessly integrated. Currently, we are deploying GPRS (General Packet Radio Service) in our GSM markets, which brings gross data rates of 115 kbps to users on the West coast and in the Carolinas, parts of Georgia, and eastern Tennessee. The nationwide deployment of GPRS will follow completion of the GSM overlay of Cingular's TDMA network. Cingular subsequently plans to deploy the high-speed data solution, EDGE (Enhanced Data rates of Global Evolution), in 2003/2004. This solution will bring gross data rates up to 384 kbps. The deployment of EDGE is another step in our 3G (third generation) strategy and ultimate migration path to W-CDMA (Wide Band CDMA), offering wireless data speeds up to 2 Mbps. These systems will be targeted for data applications and will have multi media capabilities. EDGE is basically a GSM based technology with a software enhancement of GPRS (General Packet Radio Service). The near term benefit will allow Cingular to incorporate technology that enhances our spectral efficiency on the voice side in such a manner to allow for continued and sustained growth. In order to create a seamless, "single-technology" network, we will begin an overlay in our TDMA and analog markets with EDGE and GPRS/GSM technology. Any of the following causes may be considered as sufficient for the disqualification of a respondent and the rejection of its proposal: a) Submission of more than one (1) proposal for the same work by an individual, firm, partnership or corporation under the same or different name. For purposes of this subparagraph, firms, partnerships or corporations under common control may be considered to be the same entity; peurTs 5 b) Evidence of collusion between or among respondents; c) Being in arrears on any of its existing contracts with the City or in litigation with the City or having defaulted on a previous contract with the City; d) Poor, defective or otherwise unsatisfactory performance of work for the City or any other party on prior projects which, in the City's judgement and sole discretion, raises doubts as to Respondent's ability to properly perform the work; or e) Any other cause which, in the City's judgement and sole discretion, is sufficient to justify disqualification of Respondent or the rejection of its proposal. No proposal may be withdrawn for a period of ninety (90) days after the time and date scheduled for the proposal closing. The City reserves the right to accept or reject any or all proposals, to waive informalities or irregularities, to request clarification of information submitted in any proposal, or to readvertise for new proposals. The City may accept any item or group of items of any proposal, unless the respondent qualifies his/her proposal by specific limitations. Award, if made, will be to the most responsible and responsive proposer whose proposal, in the City's opinion, will be most advantageous to the City, price and other factors considered. The City reserves the right, to aid it in determining which proposal is responsible, to require a respondent to submit such evidence of respondent's qualifications as the City may deem necessary, and may consider any evidence available to the City of the financial, technical, and other qualifications and abilities of a respondent, including past performance (experience) with the City and others. The City shall be the final authority in the award of any and all proposals. Pee 6 GENERAL TERMS & CONDITIONS: DEFAULT: As a result of proposals received under this RFP, the award of the contract may be based, in whole or in part, on delivery and specification factors. Accordingly, should the Service Provider not meet the delivery deadline(s) set forth in the specifications or should the Service Provider fail to perform any of the other provisions of the specifications and/or other contract documents, the City may declare the Service Provider in default and terminate the whole or any part of the contract. Upon declaring the Service Provider in default and the contract in whole or in part, the City may procure and/or cause to be delivered the equipment, supplies, or materials specified, or any substitutions therefor and the Service Provider shall be liable to the City for any excess costs resulting therefrom. In the event the Service Provider has been declared in default of a portion of the contract, the Service Provider shall continue the performance of the contract to the extent not terminated under the provisions of this paragraph. Where the Service Provider fails to comply with any of the specifications, except for delivery deadline(s), the City may, in its discretion, provide the Service Provider with written notification of its intention to terminate for default unless prescribed deficiencies arc corrected within a specified period of time. Such notification shall not constitute a waiver of any of the City's rights and remedies hereunder. 2. PATENT INDEMNITY: Except as otherwise provided, the successful respondent agrees to indemnify the City and its officers, agents, and employees against liability, including costs and expenses for infringement upon any letters patent of the United States arising out of the performance of this Contract or out of the use or disposal by or for the account of the City or supplies furnished or construction work performed hereunder. 3. PRICING: Pricing should be provided as indicated on the Scope of Services & the Appendices section attached, to include any alternate proposals. Please note: the pricing shall be included in your proposal for each criteria, and not written on the Appendices. Please note that alternate proposals will not be accepted unless specifically called for in the Scope of Services & the Appendices section of this RFP. A total shall be entered for each item proposed. In case of a discrepancy between the unit price and extended price, the unit price will be presumed to be correct. By submission of this proposal, the Respondent certifies, and in the case of a joint proposal, each party thereto certifies as to its own organization, that in connection with this procurement: a) The Respondent represents that the article(s) to be furnished under this RFP is (are) new and unused (unless specifically so stated) and that the quality has not deteriorated so as to impair its usefulness. 7 b) The prices in this proposal have been arrived at independently, without consultation, communication, or agreement for the purpose of restriction competition, as to any matter relating to such prices with any other respondent or with any competitor; c) Unless otherwise required by law, the prices which have been quoted in this proposal have not been knowingly disclosed by the Respondent and will not knowingly be disclosed by the Respondent prior to opening, directly or indirectly to any other respondent or to any competitor; d) No attempt has been made or will be made by the Respondent to induce any other person or firm to submit or not to submit a proposal for the purpose of restricting competition. However, offered discounts will be taken for less than 30 days if payment is made within discount period. b) In connections with any discount offered, time will be computed from date of delivery and acceptance at destination, or from the date correct invoice is received in the office of Finance, whichever is later. Payment is deemed to be made, for the purpose of earning the discount, on the date of City Check. 5. SAMPLES: Samples of items, as indicated in the Scope of Services section of this RFP, must be furnished free of expense to the City and if not called for within fifteen days from date of RFP closing, same will be disposed of in the best interest of the City. 6. SELECTION CRITERIA: The contract will be recommended to be awarded to the Respondent that demonstrates the ability to provide the highest quality of service at the most reasonable cost. To accomplish this goal, the criteria for selection shall include, but is not limited to, the criteria set forth in the Appendices of this RFP. After evaluations, discussions, and testings are completed, the Respondents will be ranked by the RFP Selection Committee and, whose recommendations will be forwarded to the City Commission. The City Commission shall be the final authority in the award of any and all proposals. 8 7. LITERATURE: If required by the Scope of Services section of this RFP, descriptive literature/brochures shall be included with this bid in order to properly evaluate make/model offered. Bids submitted without same may be considered non-responsive and disqualified. 8. DISPUTES: Any bidder who disputes the reasonableness, necessity, or competitiveness of the terms and/or conditions of the Invitation to Bid, selection or award recommendation shall file a protest in writing to the Office of the City Manager not later than seventy-two (72) hours after award. 9. PAYMENT TERMS: Payment for work completed will be made within (30) days of approved invoice. No payment will be made for materials ordered without proper purchase order authori- zation. Payment cannot be made until materials, goods or services, have been re- ceived and accepted by the City in the quality and quantity ordered. Any contract resulting from this solicitation is deemed effective only to the extent of appropriations available. Nextel and its employees share a mutual interest in adherence to this policy. Maintaining satisfactory performance is the responsibility of all employees and the decision to acknowledge substance-abuse-related problems and seek assistance is also the responsibility of the employee. An employee with a problem related to alcohol or drug abuse should be encouraged to contact the Human Resources Department for information about the Employee Assistance Program ("EAP”). The EAP is available to employees and family members who wish to seek confidential counseling for personal problems, including alcohol or drug abuse related problems. The EAP provides confidential education, encouragement, and assistance, as well as referral services for assessment, and rehabilitation. EAP information is available through the NHQ Benefits Department or your local Human Resources representative. Voluntary participation in an alcohol or drug rehabilitation program will not prevent corrective action for violation of this drug and alcohol abuse policy, for being unable to perform job duties, or for being unable to perform job duties in a manner that does not endanger the employee's health or safety or the health or safety of others. Definition of Drug Abuse Drug abuse means the use of controlled substances—for example, marijuana, heroin, hashish, cocaine, hallucinogens, depressants, and stimulants— not prescribed for current personal treatment by an accredited physician. Prescription Drugs An employee undergoing prescribed medical treatment with any drug that may alter his or her physical or mental ability must report this treatment to his or her manager. The manager will determine whether the Company should permit the employee to continue working in his or her assigned job, temporarily change the employee's job assignment during the period of treatment, or place the employee on a medical leave of absence during that period. Testing 1. Under Nextel's policy, applicants who have been given a conditional offer of employment will be tested for the following substances: amphetamines, marijuana, cocaine, opiates, and phencyclidine. Failure to pass or to cooperate in the drug testing procedure will result in a withdrawal of the conditional offer of employment. 2. Whenever Nextel has reasonable suspicion that an employee's work performance or on-the-job behavior may have been affected in any way by alcohol or drugs, Nextel may require the employee to submit a urine and/or blood sample for testing. Failure to pass or to cooperate in the drug testing procedure will result in immediate termination. However, no employee may be given a drug test without the prior approval of the Human Resources Lead. Any manager who believes an employee may be impaired should contact their Human Resources Lead. 3. All information obtained in the course of testing employees shall be protected as confidential medical information. No data conceming a drug test will be made a part of the employee's personnel file. • Prohibitions Nextel prohibits the following: 1. The use or possession of alcoholic beverages on Company premises or while performing Company business except in connection with Company-authorized events. Only the highest-ranking official of the business unit sponsoring such functions can grant the necessary authorization. Employees who choose to consume alcoholic beverages at Company-authorized events are responsible for exercising moderation and good judgment. 2. The illegal use, manufacture, sale, distribution, dispensation, or possession of alcoholic beverages, narcotics, or drugs while on the job or on Company property, in Company-owned vehicles, in client-owned vehicles entrusted to the Company, or during working hours. Any illegal substances will be turned over to the appropriate law enforcement agency, which may result in criminal prosecution. 3. Use of illegal drugs or alcohol off Nextel premises that adversely affects the employee's work performance or the safety of himself or herself or of others in the workplace. 4. The illegal manufacture, sale, transfer, or possession of alcohol or drugs off Nextel premises that adversely affects the employee's work performance or the safety of himself or herself or of others in the workplace. 5. Storing in a locker, desk, automobile, or other repository on Nextel premises any alcohol or illegal drug. 6. Being under the influence of illegal drugs or alcohol while on the job or Nextel premises, in Company-owned vehicles, in client-owned vehicles, or during working hours. 7. Failing to notify his or her manager about any other employee who is in a condition that impairs 1) his or her ability to perform job duties; or 2) his or her ability to perform job duties in a manner that does not endanger the employee's health or safety or the health or safety of others. 8. The use of over-the-counter or prescription drugs in a manner that may impair job performance or endanger the safety of others in the workplace or that is inconsistent with its medically-prescribed, intended use. 9. Switching or adulterating any urine sample submitted for testing. 10. Refusing to consent to testing or to submit a urine or blood sample for testing when requested by management. 11. Refusing to submit to a search when requested by management. 12. Conviction under any criminal drug statute for a violation occurring in the workplace. 13. Failing to notify his or her manager of any criminal drug statute conviction for a violation occurring in the workplace no later than five (5) business days after such conviction. 14. By CHRISTINA HEADRICK ® St. Petersburg Times, published November 30, 2000 CLEARWATER-- The rules are explicit: No more personal long distance calls from city office telephones will be allowed, unless they're charged to a private calling card. And city mobile phones will be used only for official Clearwater business, unless an employee has an emergency. These are some of the new guidelines in a telecommunications policy that interim City Manager Bill Horne is reviewing with city commissioners before he signs it into effect later this year. "The concerns that I had are addressed in it," said Home. "The philosophical basis for the whole policy is that the city will pay only for business use" of its communications equipment. The policy, somewhat stricter than those employed by other area municipalities, was debated and drafted this fall, after a city audit of former Planning and Development Administrator John Asmar's expenses. The audit found that Asmar used his office phone and city mobile phone to make personal calls, some to a private storage business he owned part of in the Orlando area. Asmar reimbursed the city for the calls and a handful of other personal charges initially paid by the city, but gathering the reimbursements required a time-consuming review of financial paperwork. Asmar ultimately resigne9 under pressure from Horne, after another controversy involving his personal use of e-mail. The new phone policy emphasizes that personal calls are discouraged. The policy also advises employees to take steps like avoiding 900 numbers and using the telephone book rather than directory assistance -- all to save the taxpayers' money. When personal calls are made from a city mobile phone, the new policy sets up a formula that requires employees to reimburse the city at 28 cents per minute, plus taxes on the time, every quarter. The new mobile phones combine the functions of several gadgets. They allow employees to send each other radio messages and receive both numeric and text pages, in addition to serving as telephones. The city has spent about $20,000 so far to equip about 330 employees with the telephones, Mayer said, the bulk of them in the Clearwater Police Department Already, the city saved about $4,000 on its first monthly bill under the new deal with Nextel Communications. Eventually, all city departments will be asked if they want to retire aging radio equipment and pagers and begin using the new mobile phones instead. We, along with numerous other companies, are defendants in these cases. The defendants have removed the cases to federal court, and the plaintiffs have filed motions to remand back to state court in some of the cases. Mr. Angelos' firm has also participated in the filing of an amended complaint in a similar suit pending in federal court in Louisiana, in which we arc also named. These suits seek to require the defendants to provide headsets, or reimburse the cost of headsets, for use with wireless telephones, as well as attorneys' fees and punitive damages. The cases have been transferred to Federal court in Baltimore, Maryland by the judicial panel on Multi- district Litigation. While we cannot predict the outcome of this litigation, we believe that the claims against us are without merit and intend to vigorously defend against them. Beginning in 2000, allegations against us of employment discrimination and harassment were reported in the press, and thereafter, a group of current and former employees filed some related complaints with the Equal Employment Opportunity Commission.
