02-25-2020 Minutes CITY OF OCOEE Code Enforcement Board February 25,2020 I.CALL TO ORDER Chairman Lowery called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida. A. INVOCATION: Member Lowery initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Odom led the Board in the Pledge of Allegiance to the U.S.flag. C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared a quorum (4) present. PRESENT: Chairman Lowery& Members: Odom, Mirza, Bandur, & Mann. Also present: Board Attorney Mary Sneed, Assistant Support Services Director Doug Gaines, Code Enforcement Clerk Justin Mieras,and Code Enforcement Officer Loeffler. ABSENT: Member Lewis is an excused absence. D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS CASE NO 2019-01168 DIANA NAIPAL OFFICER LOEFFLER 1104 PINEWOOD LN AMRITA SINGH NAIPAL JAIPAUL NAIPAL Violation Cited: §115-3.A.(3), §143-27.A., §165-3.A, &§168-6.B.(1) Summary: §115-3.A.(3)—No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health,safety and welfare. §143-27.A.—At non-pickup times,garbage carts shall be placed in side yards or rear yards and screened from view to the extent practicable. Except as provided herein,garbage carts shall at no time be placed in the front yard of the premises. §165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property. §168-6.B.(1)—No owner, private property,shall consent to the parking or storing of vehicles on non-improved surfaces of the property. Observation: §115-3.A.(3)—Misc.Junk,Trash, Debris, Litter Front Driveway And Yard And Overflowing From Garbage Cans. §143-27.A.—Trash Containers I.Garbage Cans Stored In Prohibited Location §165-3.A.—Vehicle With No License Tag Stored On Property §168-6.B.(1)—Vehicle(S) Parked Upon Front Yard Grass Non-Surface Unimproved Surface Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of February 25, 2020, the property is still in non-compliance. The City asked for Order of Compliance within 15 days, or thereafter to be fined $15.00 per day, per violation until found in compliance. Member Odom,seconded by Member Bandur,.moved that Case in#2019-01168, the respondent be found in violation as cited as of January 06, 2020, and be given until March 06, 2020, to come into compliance or be fined$15.00 per day, per violation that remains in non-compliance. Member Odom, seconded by Member Bandur moved to amended compliance to March 11,2020. Motion&Amendment carried unanimously. CASE NO 2020-01200 OFFICER LOEFFLER 2010 PAULA MICHELE CT DANIEL THOMPSON Violation Cited: §115-3.A.(3)&§115-4. Summary: §115-3.A.(3)—No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. §115-4.—Owners shall control excessive weed or grass growths, as enumerated in § 115-3, on the property and on the portion of the adjoining public right-of-way between the property and the street of each lot. Observation: §115-3.A.(3)—Overgrown Tall Weeds And Grass Front,Side & Rear Yards §115-4.—Tall Weeds And Grass; Easement Between Pedestrian Sidewalk And Street Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of February 25, 2020, the property is still in non-compliance. The City asked for Order of Compliance within 15 days or thereafter to be fined $15.00 per day, per violation until found in compliance. Member Odom, seconded by Member Mirza, moved that Case in #2020-01200, the respondent be found in violation as cited as of January 22,2020, and be given until March 11, 2020, to come into compliance or be fined$15.00 per day, per violation that remains in non-compliance. Motion carried unanimously. IV.CASE RESOLUTION CASE NO 2019-01063 OFFICER SIEGRIST 2265 TWISTED PINE RD DEBRA A MCGOWAN Violation Cited: §54-3.A.(1)B.C.D.E. Summary:All buildings shall have the assigned building number properly displayed,whether or not mail is delivered to the building. Observation::No address numbers on house nor mailbox. Officer Siegrist explained that the property was found in compliance in accordance with the Board's Order Requiring Compliance. No further action requested. CASE NO 2019-01078 OFFICER LOEFFLER 605 JAY ST STEPHEN H NAUSUKIEWICZ Violation Cited: §51-13. Summary:It shall be a violation to do work related to construction without first obtaining a permit. Observation: Re-roof without required permits, plans, approval and inspections. Assistant Support Services Director Doug Gaines explained that as of.February 25, 2020, the property is still in non- compliance.The City asked for an Order Imposing Fine. Member Mirza, seconded by Member Odom, moved that Case in #2019-01078, the Board imposes fines as of February 13,2020, as previously set by this Board. Motion carried unanimously. CASE NO 2019-01137 OFFICER DIAZ 609 CABORCA CT MONTY EUGENE STINSON Violation Cited: §115-3.B. Summary: No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass, undergrowth or other dead or living plant life. Observation:Overgrown grass and weeds front back of property. Assistant Support Services Director Doug Gaines explained that the property was found in compliance in accordance with the Board's Order Requiring Compliance. No further action requested. V.
