CALL TO ORDER Chair Odom called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida. A. INVOCATION: Member Bandur initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Bandur led the Board in the Pledge of Allegiance to the U.S. flag. C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared a quorum (4) present. PRESENT: Chair Odom & Members: Lewis, Mirza, Mann, Bandur, & Stewart. Also present: Board Attorney Mary Sneed, Assistant Support Services Director Doug Gaines, Code Enforcement Clerk Justin Mieras, and Code Enforcement Officers Siegrist & Loeffler. ABSENT: Member Shropa is an excused absence. D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS CASE NO 2020-02072 OFFICER SIEGRIST 9051 A D MIMS RD BOYER SKAFF Violation Cited: §165-3.A. & §168-6.B.(1) Summary: §165-3.A.— No person shall keep any abandoned or junk vehicle on any public property or any private property. §168-6.B.(1)— No owner, private property,shall consent to the parking or storing of vehicles on non-improved surfaces of the property. Observation: §165-3.A.—Multiple/numerous vehicles on property, some inoperable appearance and unknown tags. §168-6.B.(1)— Multiple/numerous vehicles on property parked on grass. Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of November 24, 2020, the property is still in non-compliance.The City asked for Order of Compliance by December 04, 2020, or thereafter to be fined $50.00 per day, per violation until found in compliance. Respondent Skaff Boyer explained most of the vehicles have been removed, but he would need until the end of next week, Friday, December 04, 2020, to remove the final two vehicles. Member Mirza, seconded by Member Bandur, moved that in Case#2020-02072, the respondent be found in violation as cited as of October 09, 2020, and be given until December 08, 2020, to come into compliance or be fined$50.00 per day, per violation that remains in non-compliance. Motion carried unanimously. CASE NO 2020-01950 OFFICER SIEGRIST 2488 TALL MAPLE LOOP CHAN SANDRA Violation Cited: §45-13.A. Summary: §45-13.A. — No person shall cut down, destroy, remove, move, or damage any protected tree on private premises, or ' authorize such work,without first obtaining a permit from the Building Department. Observation: §45-13.A.—Work Without Permit.Two (2) Oak Trees Removed From Front Yard. Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of November 24, 2020, the property is still in non-compliance.The City asked for Order of Compliance by December 04, 2020,or thereafter to be fined $25.00 per day until found in compliance. Member Mirza, seconded by Member Bandur, moved that in Case#2020-01950, the respondent be found in violation as cited as of September 25,2020, and be given until December 04, 2020, to come into compliance or be fined$25.00 per day as lonq as the violation remains in non-compliance. Motion carried unanimously. CASE NO 2020-02148 OFFICER LOEFFLER 1828 LOCHSHYRE LOOP BARRON,WILLIE BARRON, DIANE Violation Cited: §54-3.A.(1), §115-3.B., & §165-3.A. Summary: §54-3.A.(1)—All buildings shall have the assigned building number properly displayed. §115-3.B.— No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds, grass, undergrowth or other dead or living plant life. §165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation: §54-3.A.(1)—No Address Numbers Visible From Street On House Or Mail Box §115-3.B.—Tall Weeds And Grass §165-3.A.—Complaint Received &Observed;Vehicle(Blue Van) Flat Tire Expired Tag Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of November 24, 2020, the property is still in non-compliance.The City asked for Order of Compliance by December 04, 2020,or thereafter to be fined $50.00 per day, per violation until found in compliance. Member Mann, seconded by Member Bandur, moved that in Case#2020-02148, the respondent be found in violation of code §165-3.A only as of October 21, 2020, and be given until December 04, 2020, to come into compliance or be fined $50.00 per day,per violation that remains in non-compliance. Motion carried unanimously. CASE NO 2020-02163 OFFICER LOEFFLER 2010 PAULA MICHELE CT THOMPSON, DANIEL Violation Cited: §115-3.B.& §155-4. Summary: §115-3.B.—No person shall allow or permit excessive growth, ten inches or more on property owned, of weeds,grass, undergrowth or other dead or living plant life. §115-4.—Owners shall control excessive weed or grass growths, as enumerated in § 115-3,on the property and on the portion of the adjoining public right-of-way between the property and the street of each lot. Observation: §115-3.B.—Overgrown Tall Weeds And Grass §115-4.—Easements And Pedestrian Sidewalks Tall Weeds And Grass Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of November 24, 2020, the property is still in non-compliance.The City asked for Order of Compliance by December 04, 2020, or thereafter to be fined $50.00 per day, per violation until found in compliance. Member Stewart, seconded by Member Bandar, moved that in Case#2020-02163, the respondent be found in violation as cited as of October 29, 2020, and be given until December 04, 2020, to come into compliance or be fined$25.00 per day, per violation that remains in non-compliance. Motion carried unanimously. IV.CASE RESOLUTION None. V. COMMENTS Member Stewart recommended establishing a fine recommendation scale. Chair Odom reminded the Board that there is no meeting in December.
