The Engineer's estimate for this project was $975,000.00, and the approved budget for the Reserve project is $538,720.00 from the 2003 Water and Sewer Bond Issue. Issue: Award the contract to construct the Reclaimed Water Distribution System, located in the Reserve Subdivision, to Young's Communications Co., Inc. Recommendations Staff recommends that the City Commission: 1) Award Bid #B07 -04 for construction of the Reclaimed Water System Retrofit for Reserve Subdivision to Young's Communications Co., Inc. in the amount of $434,515.00. 2) Authorize the Mayor, City Clerk, and Staff to execute all necessary contract documents once the appropriate bonds and insurance are secured. ("FCCI") with respect to City of Ocoee Bid #B07-04 and Bid #B07-05, based on the bid documents submitted by FCCI in response to the project manuals, including all applicable addenda thereto, for Bid #B07-04 and Bid #B07-05 (collectively, the "Project Manuals"). A copy of the Bid Protest is attached hereto for reference. The Bid Protest was timely received in accordance with Article 28 of the Instructions to Bidders, as set forth in the Project Manuals. A copy of Article 28 is attached hereto for reference. The Bid Protest has been reviewed by the City based on the standards set forth in the Project Manuals. In considering the Bid Protest, the City has been cognizant of the requirements set forth in the Project Manuals. For the reasons set forth below, the Bid Protest is DENIED by the City: 1. Discrepancies in Bid Forms. As more specifically discussed below, the Schedule of Bid Items forms submitted by FCCI in response to the Project Manuals contained discrepancies that the City was required to resolve in accordance with certain requirements and procedures set forth in the Project Manuals. In resolving the discrepancies contained in the Schedule of Bid Items forms submitted by FCCI, the City relied on the following provisions of the Project Manuals: a. Section 12.2 of the Instructions to Bidders set forth in the Project Manuals provides as follows: Bid formes) must be completed in duplicate by handwritten ink or typewriter. The bid price of each item and lump sum "Total Bid" or "Total Base Bid" on the bid form must be stated in words and numerals. In case of a conflict, words shall take precedence. (underlining added) b. Section 17.1 of the Instructions to Bidder set forth in the Project Manuals provides, in part, as follows: Discrepancies between the multiplication of units of work and unit prices will be resolved in favor of unit prices. Discrepancies between the indicated sum of any column of figures and the correCt sum thereof will be resolved in favor . of the correct sum. Discrepancies between words and figures will be resolved in favor of words. (underlining added) 3. Schedules of Bid Items. Each of the Schedule of Bid Items forms (Bid Tabs B) submitted by FCCI as part of its responses to Bid #B07-04 and Bid #B07-05 contained various discrepancies. Copies of the Schedule of Bid Items forms submitted by FCCI are attached hereto for reference. Specifically, on each form, there was a discrepancy between the Unit Price (in words) and the Unit Price (in numerals) with respect to Base Bid Item No. U5 (Connection to Existing Water Main). The Unit Price (in words) provided by FCCI was "seven thousand nine hundred fifty" and the Unit Price (in numerals) provided by FCCI was "$2,650." Based upon the above-referenced provisions of the Project Manuals, the City correctly resolved this discrepancy in favor of the Unit Price (in words). Accordingly, the City correctly considered "seven thousand nine hundred fifty," or $7,950, as FCCI's Unit Price for such item. Further, on each form, there was a discrepancy between the Total Price for Item No. U5 (calculated by multiplying total number of units of work by the Unit Price) and a Unit Price of $7,950. The Schedule of Bid Items forms required that bidders account for three (3) units of work, at the applicable Unit Price, in calculating the Total Price for Item No. U5. Finally, on each form, there was a discrepancy between the indicated sum of figures contained in Total Price column of the Schedule of Bid Items forms and the correct sum of such figures. The indicated sums provided by FCCI for Bid #B07-04 and Bid #B07-05 were $428,200 and $380,250, respectively. Based on the City's resolution of the discrepancies noted above, and based upon the above-referenced provisions of the Project Manuals, the City correctly tabulated FCCI's Total Bid for Bid #B07-04 as $444,100 and FCCI's Total Bid for Bid #B07-05 as $396,150.
