Development Services Director Rumer announced the board currently has two vacancies, because
Alternate Member Lowe resigned, and Chair Keller resigned to run for City Commissioner. He
anticipates the two vacancies to be filled in June when the 2021 terms expire. He further stated the
March and April meetings are canceled due to the upcoming city election.
Vice -Chair Lomneck inquired if an election for chair should be done now. City Attorney
Cookson suggested the board wait until May or June for election of Chair, but said if the board
wishes to elect a chair, Co -Vice Chair will be suitable at this time. Vice -Chair Lomneck nominated
Member Mellen for Co -Vice Chair.

Co -Vice Chair for the interim; Motion carried unanimously.

A. Crossings at Maguire — 2647 and 2663 Maguire Road Annexation, Rezoning to
Planned Unit Development (PUD) & Small Scale Land Use Amendment; Project
No(s): AX-10-20-94, RZ-20-10-13 & CPA 2020-003. (Advertised in the West Orange
Times on Thursday, January 26, 2021) (Development Services Director Rumer)
Development Services Director Rumer presented a brief overview of this proposed Annexation,
Small Scale Comprehensive Land Use Amendment and Rezoning to Planned Unit Development
(PUD) at 2647 Maguire Road (4.92 acres) and 2663 Maguire Road (.61 acres), which is located on
the west side of Maguire Road, 600 feet north of Roberson Road. The applicants propose to develop
the 5.611 acres as a mixed -use commercial PUD consisting of four (4) buildings: (1) a proposed
2,510 square foot coffee shop, (2) a proposed 6,400 square foot office/commercial building, (3) a
proposed 85,140 square foot three-story Mini Warehouse/Storage Building, and (4) a proposed
3,500 square foot bank/credit union. The proposed PUD accesses Maguire Road via one entrance.
If approved by the City Commission, it will require an amendment to the Joint Planning Area
Agreement with Orange County
The larger parcel at 2647 Maguire Road is eligible for annexation as it is adjacent to property
located within the City of Ocoee limits on the north, south, east and west sides. The applicant has
requested a City of Ocoee zoning designation of PUD (Planned Unit Development). According to
the Land Development Code, the PUD zoning designation is intended for all areas shown on the
Future Land Use Map. The PUD zoning designation is consistent with the proposed future land use
designation of Commercial. Based on the PUD Land Use Plan, there are wetlands associated with
the property. A further review from the National Wetlands Mapping Source indicated there is a
small pond that is considered jurisdictional wetlands.
Discussion:
Member Mellen inquired if the wetlands will encroach on the storage building to where it may
need to be mitigated. Development Services Director Rumer said mitigation will need to be done,
and he explained this particular wetland is a closed wetland.

Member Williams asked for Development Services Director Rumer to explain the drive-thru at
the coffee shop. Development Services Director Rumer explained the coffee shop drive-thru and
the entrance and exit off of Maguire Road. He further said they are looking into future
improvements on Maguire Road, which may encompass a northbound left -turn lane into this site.
Member Mellen asked if there is enough room for fire trucks around the self -storage area.
Development Services Director Rumer explained where the fire trucks would park and that they
have sufficient 400-foot hoses to put out any possible fire.
Member Forges asked if there is a way to create an entrance/exit through the property on the south.
Development Services Director Rumer answered in the negative, because the current restaurant
located on the property, Rusteak, has no room on their property for an entrance/exit.
Member Williams asked whether all of the buildings will be completed in one phase.
Alex Mestdagh, Applicant, 280 West Canton Avenue, Suite 110, Winter Park, indicated this will
be one buildout and no phasing will be needed.

Vice -Chair Lomneck opened the public hearing.
Tuesday Goodson, Resident, inquired about the pond and drainage. Development Services
Director Rumer explained the closed basin and drainage within the vicinity of her home.
Recording Clerk announced no emails and/or telephone calls were received.
Vice -Chair Lomneck closed the public hearing.

A. Project Status Report
Development Services Director Rumer updated the Board with the following:
• The foundation was poured at the new City Hall location last week.
• Opening bids were received for the final design of Bluford Avenue from Old Winter
Garden Road up to Geneva Avenue, which will be a roundabout.
• Inspiration PUD is coming to completion.
• Two townhome developments are currently under construction, one off of A.D.
Mims and one off of Clarke Road. A development agreement is going before the
City Commission to facilitate the widening of Clarke Road from A.D. Mims up to
Clarcona Ocoee Road.
• The light industrial building off of Maguire Road is nearing the final stages.
• An annexation, large scale comprehensive plan amendment with rezoning to PUD
for an industrial use off of Ocoee Apopka Road was recently submitted.
• Heichel Plumbing is moving to Ocoee off of Marshall Farms Road, south of State
Road 50, which is within the CRA.
• Sonny's buildout will be starting soon.
• Tijuana Flats is not open yet. They put their sign up while they are doing their
interior buildout.

CONSISTENCY WITH STATE & LOCAL REGULATIONS:
Annexation: With respect to State annexation criteria, Chapter 171.044 of the Florida Statutes
grants municipalities the authority to annex contiguous, compact, non -circuitous territory so long
as it does not create an enclave. The subject property is considered contiguous to the City of
Ocoee since it is bordered by property located within the City limits on the north, south, and west.
Joint Planning Area Agreement: The subject property is located within the Ocoee -Orange County
Joint Planning Area (JPA) and is being considered for annexation as outlined in the JPA
Agreement.
Rezoning: The parcel will receive an "C-2" (Community Commercial) zoning upon annexation.
Comprehensive Plan: The annexation is consistent with the Future Land Use Element Policy 2.5
that states in part, "The City shall consider requests for voluntary annexation into the City when
those lands are logical extensions of the existing City limits when services can be properly
provided, and when proposed uses are compatible with the City's Comprehensive Plan, the JPA
Agreement, and the City's Annexation Policy...." [Emphasis added]. The rezoning is consistent
with Future Land Use Element Policy 1.15 that states in part, "The City may assign an initial
zoning, after annexation, which is consistent with both the Future Land Use Map and the JPA
Agreement."
DISCUSSION:
Annexation Feasibility & Public Facilities Analysis Report (See attached): The property is located
within the Ocoee -Orange County JPA area and is bordered by the City of Ocoee to the north,
south, and west. The property already benefits from Ocoee Fire Rescue services via a joint "First
Responder" Agreement with Orange County. The property will require the City of Ocoee water
service.
Summary: The proposed annexation is a logical extension of the City limits, urban services can
be provided, and the annexation meets state and local regulations.
DEVELOPMENT REVIEW COMMITTEE (DRC) RECOMMENDATION:
The Development Review Committee (DRC) met on Tuesday, May 4, 2021. The DRC determines
the proposed Annexation and Rezoning were consistent with the City's regulations and policies.
The DRC recommends approval of the proposed Annexation and Rezoning from "Orange County"
A-1 (Rural/Agricultural) to "City of Ocoee" C-2 (Community Commercial) of the property known as
the West Orange Park Properties VI I LLC located at 2100 West Road.

Based on the above analysis and the subsequent DRC recommendation, Staff recommends that
the Planning & Zoning Commission, acting as the Local Planning Agency, recommend approval
of the annexation and rezoning from "Orange County" A-1 (Rural/Agricultural) to "City of Ocoee"

BACKGROUND:
The Barkeritaville PUD property is located on the east side of Tomyn Blvd. and 1,517 feet from
Roberson Road. The property is identified as parcel number 31-22-28-0000-00-050. The subject
property is approximately 8.13 acres. The applicant is requesting to amend the Land Use Plan
from Retail to allow a self -storage facility as an approved use to the PUD. The permitted uses
within the PUD/Land Use Plan are for a Veterinary Facility, Pet Resort/Daycare, Office, Retail,
Restaurant, and Veterinary Education and Training.
The applicant, Simmons Pet Properties, is requesting a Substantial Amendment to the PUD to
change the permitted uses from Veterinary Facility, Pet Resort/Daycare, Office, Retail,
Restaurant, and Veterinary Education and Training to Indoor Self -Storage. The revision to the
PUD also includes eliminating a 16,182-SF building to a three-story 104,907-SF / 727 unit
indoor self -storage facility which will complete the buildout of the PUD. The self -storage is
proposed to be accessed via the existing entrance.
The original PUD approved a maximum trip count of 1,041 Daily Trips. Under the proposed
PUD buildout with the Self -storage facility and Pet Paradise Dog Daycare, the total daily trips
are projected to be 388. This will provide a reduction of 653 daily trips.
The proposed architectural design of the Indoor self -storage facility will be architecturally
cohesive with the existing Pet Paradise.

DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC) met on May 4, 2021, and reviewed the
Amendment to the PUD/Land Use Plan Barkeritaville PUD. According to the City's Land
Development Code, alterations to an approved PUD/Land Use Plan shall be classified as either
substantial or nonsubstantial by the DRC. The Committee determined that the proposed
amendment was considered a Substantial Amendment due to the criteria established in the
City's Land Development Code. Accordingly, the proposed Substantial Amendment will be
presented at a public hearing before the Planning and Zoning Commission and a public hearing
before the City Commission. When the discussion was finished, the DRC voted unanimously to
recommend approval of the Substantial Amendment to Barkeritaville PUD.
STAFF RECOMMENDATION:
Staff recommends that the Planning and Zoning Commission recommend Approval of the
Substantial Amendment to the Zoning Uses and Land Use Plan for Barkeritaville PUD as date -
stamped received by the City on March 03, 2021.

BACKGROUND:
The subject property is approximately 0.25 acres in size and is located on the north side of
Rewis Street and the northeast corner of Lyman Street and Rewis Street. The subject parcel
identification number is 18-22-28-7900-05-051. The property is vacant and currently zoned R-1
(Single-family). The Small -Scale Comprehensive Plan Amendment would be from Low -Density
Residential to Commercial. The Rezoning would be from City of Ocoee "R-1" to City of Ocoee
"PUD".

DISCUSSION:
The applicant is proposing to rezone the property to Planned Unit Development (PUD) in order
to develop a two-story mixed -use building with 875 s.f. of ground -floor retail space for a hair
salon and a second story 875 s.f. Apartment. No other uses will be permitted under the PUD. A
two -car carport will also be provided on the 0.25 acres. The PUD Land Use plan provides for a

front building setback of five (5) feet, side setbacks of ten (10) feet, and a rear setback of fifty
(50 feet.
Potable water will be provided by the City of Ocoee via a 6-inch water main on the west side of
Lyman St. The City has a 20" Sanitary Force Main in front of the property on the north side of
Rewis St., but due to the small size of the property and use, tapping into the Force Main is not
viable. Therefore, a septic tank and drain field will need to be utilized. The septic permit is
provided through Orange County Health Department.
Parking is being provided with seven (7) parking spaces, including one (1) handicap parking
space. Stormwater management will be provided through surface retention and possible
exfiltration. The approval of the PUD does not designate stormwater requirements.
Staff is supportive of the proposed use as it is located in a transitional area in proximity to the
downtown core. Rewis Street in the area is a "Collector" road that serves as a transition from
Bluford Avenue to N Lakewood Ave. The location on the "Collector" road is appropriate for a
use similar to C-1, which permits mixed -use.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC) met on Tuesday, May 4, 2021. The DRC made a
recommendation of approval for the Small -Scale Land Use Amendment from Low -Density
Residential (LDR) to Commercial (COM) and Rezoning to Planned Unit Development (PUD) for
a mixed -use building consisting of a Hair Salon on the ground floor and an apartment on the
second floor.
STAFF RECOMMENDATION:
Staff recommends that the Planning & Zoning Commission acting as the Land Planning Agency
recommend approval of the proposed Small -Scale Land Use Amendment from Low -Density
Residential (LDR) to Commercial (COM) and Rezoning to Planned Unit Development (PUD) for

BACKGROUND:
The subject site is approximately 4.76 acres in size and is located on the east side of Ocoee
Apopka Road and 562 feet north of West Silver Star Road. The subject site currently contains
three (3) single-family dwellings. The subject site parcel ID number is 18-22-28-0000-00-056.
The parcel is currently zoned Orange County "A-1" and has a County Land Use of Industrial and
a Commercial Land Use in Ocoee Orange County JPA.

DISCUSSION:
The applicant is proposing to develop a Commercial/Flex Business Center on 4.76 acres. The
applicant is proposing two (2) buildings with a maximum square footage of 61,400. A 29,000-SF
building with a retail front and rear delivery access at grade height will be the project's focal
point. The second building of up to 32,000-SF will include available dock heights. A ROW
dedication of up to 30-feet is being provided. No waivers have been requested. The subject
parcel is not located within the SR 429 Business Character District.

Utilities will be provided by the City of Ocoee via a 12-inch water main on the east side of Ocoee
Apopka Road and an extension of the sewer from the west side of Ocoee Apopka.
Parking is provided via surface lot. Parking is being provided with 80 typical parking spaces and
additional parking in between buildings. A bicycle rack is also required.
Stormwater management will be provided onsite. Stormwater will have to meet the more
stringent Lake Apopka rules.
Landscape buffers on the front side and rear will be provided. Since the proposed Office use is
located adjacent to existing single-family dwellings, a six (6) footwall and landscaping are
required on the rear.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC) met on Tuesday, May 4, 2021. The DRC
recommended approval for the Annexation and Rezoning to PUD with the PUD Master Land
Use plan.
STAFF RECOMMENDATION:
Staff recommends that the Planning & Zoning Commission acting as the Land Planning Agency
recommend approval of the proposed Annexation and Rezoning to Planned Unit Development
(PUD).

CONSISTENCY WITH STATE & LOCAL REGULATIONS:
Annexation: With respect to State annexation criteria, Chapter 171.044 of the Florida Statutes grants
municipalities the authority to annex contiguous, compact, non -circuitous territory so long as it does not
create an enclave. The subject property is considered contiguous to the City of Ocoee since it is bordered
by property located within the City limits on the north.
Joint Planning Area Agreement: The subject property is located within the Ocoee -Orange County Joint
Planning Area (JPA) and is being considered for annexation as outlined in the JPA Agreement.
Rezoning: The parcel will receive an "R-1" (Single -Family Dwelling) zoning upon annexation.
Comprehensive Plan: The annexation is consistent with the Future Land Use Element Policy 2.5 that states
in part, "The City shall consider requests for voluntary annexation into the City when those lands are logical
extensions of the existing City limits when services can be properly provided, and when proposed uses are
compatible with the City's Comprehensive Plan, the JPA Agreement, and the City's Annexation Policy...."
[Emphasis added]. The rezoning is consistent with Future Land Use Element Policy 1.15 that states in part,
"The City may assign an initial zoning, after annexation, which is consistent with both the Future Land Use
Map and the JPA Agreement."
DISCUSSION:
Annexation Feasibility & Public Facilities Analysis Report (See attached): The property is located within the
Ocoee -Orange County JPA area and is bordered by the City of Ocoee to the north. The property already
benefits from Ocoee Fire Rescue services via a joint "First Responder" Agreement with Orange County.
The property will require the City of Ocoee water service.

CONSISTENCY WITH STATE & LOCAL REGULATIONS:
Annexation: With respect to State annexation criteria, Chapter 171.044 of the Florida Statutes
grants municipalities the authority to annex contiguous, compact, non -circuitous territory so long
as it does not create an enclave. The subject property is considered contiguous to the City of
Ocoee since it is bordered by property located within the City limits on the north.
Joint Planning Area Agreement: The subject property is located within the Ocoee -Orange County
Joint Planning Area (JPA) and is being considered for annexation as outlined in the JPA
Agreement.
Rezoning: The parcel will receive an "R-1" (Single -Family Dwelling) zoning upon annexation.
Comprehensive Plan: The annexation is consistent with the Future Land Use Element Policy 2.5
that states in part, "The City shall consider requests for voluntary annexation into the City when
those lands are logical extensions of the existing City limits when services can be properly
provided, and when proposed uses are compatible with the City's Comprehensive Plan, the JPA
Agreement, and the City's Annexation Policy...." [Emphasis added]. The rezoning is consistent
with Future Land Use Element Policy 1.15 that states in part, "The City may assign an initial
zoning, after annexation, which is consistent with both the Future Land Use Map and the JPA
Agreement."
DISCUSSION:
Annexation Feasibility & Public Facilities Analysis Report (See attached): The property is located
within the Ocoee -Orange County JPA area and is bordered by the City of Ocoee to the north. The
property already benefits from Ocoee Fire Rescue services via a joint "First Responder"
Agreement with Orange County. The property will require the City of Ocoee water service.

CONSISTENCY WITH STATE & LOCAL REGULATIONS:
Annexation: With respect to State annexation criteria, Chapter 171.044 of the Florida Statutes
grants municipalities the authority to annex contiguous, compact, non -circuitous territory so long
as it does not create an enclave. The subject property is considered contiguous to the City of
Ocoee since it is bordered by property located within the City limits on the north and west.
Joint Planning Area Agreement: The subject property is located within the Ocoee -Orange County
Joint Planning Area (JPA) and is being considered for annexation as outlined in the JPA
Agreement.
Rezoning: The parcel will receive an "R-1" (Single -Family Dwelling) zoning upon annexation.
Comprehensive Plan: The annexation is consistent with the Future Land Use Element Policy 2.5
that states in part, "The City shall consider requests for voluntary annexation into the City when
those lands are logical extensions of the existing City limits when services can be properly
provided, and when proposed uses are compatible with the City's Comprehensive Plan, the JPA
Agreement, and the City's Annexation Policy...." [Emphasis added]. The rezoning is consistent
with Future Land Use Element Policy 1.15 that states in part, "The City may assign an initial
zoning, after annexation, which is consistent with both the Future Land Use Map and the JPA
Agreement."
DISCUSSION:
Annexation Feasibility & Public Facilities Analysis Report (See attached): The property is located
within the Ocoee -Orange County JPA area and is bordered by the City of Ocoee to the north and
west. The property already benefits from Ocoee Fire Rescue services via a joint "First Responder'
Agreement with Orange County. The property will require the City of Ocoee water service.
Summary: The proposed annexation is a logical extension of the City limits, urban services can
be provided, and the annexation meets state and local regulations.
DEVELOPMENT REVIEW COMMITTEE (DRC) RECOMMENDATION:
The Development Review Committee (DRC) met on Tuesday, May 4, 2021. The DRC determined
the proposed Annexation and Rezoning are consistent with the City's regulations and policies.
The DRC recommends approval of the proposed Annexation and Rezoning from "Orange County"
R-1 (Single Family) to "City of Ocoee" R-1 (Single -Family Dwelling) of the property known as the
Ocoee Rental Trust Property located at 503 2nd Street.

the Planning & Zoning Commission, acting as the Local Planning Agency, recommend approval

CONSISTENCY WITH STATE & LOCAL REGULATIONS:
Annexation: With respect to State annexation criteria, Chapter 171.044 of the Florida Statutes
grants municipalities the authority to annex contiguous, compact, non -circuitous territory so long
as it does not create an enclave. The subject property is considered contiguous to the City of
Ocoee since it is bordered by property located within the City limits on the east.
Joint Planning Area Agreement: The subject property is located within the Ocoee -Orange County
Joint Planning Area (JPA) and is being considered for annexation as outlined in the JPA
Agreement.
Rezoning: The parcel will receive an "R-1" (Single -Family Dwelling) zoning upon annexation.
Comprehensive Plan: The annexation is consistent with the Future Land Use Element Policy 2.5
that states in part, "The City shall consider requests for voluntary annexation into the City when
those lands are logical extensions of the existing City limits when services can be properly
provided, and when proposed uses are compatible with the City's Comprehensive Plan, the JPA
Agreement, and the City's Annexation Policy...." [Emphasis added]. The rezoning is consistent
with Future Land Use Element Policy 1.15 that states in part, "The City may assign an initial
zoning, after annexation, which is consistent with both the Future Land Use Map and the JPA
Agreement."
DISCUSSION:
Annexation Feasibility & Public Facilities Analysis Report (See attached): The property is located
within the Ocoee -Orange County JPA area and is bordered by the City of Ocoee to the east. The
property already benefits from Ocoee Fire Rescue services via a joint "First Responder"
Agreement with Orange County. The property will require the City of Ocoee water service.
Summary: The proposed annexation is a logical extension of the City limits, urban services can
be provided, and the annexation meets state and local regulations.
DEVELOPMENT REVIEW COMMITTEE (DRC) RECOMMENDATION:
The Development Review Committee (DRC) met on Tuesday, May 4, 2021. The DRC determined
the proposed Annexation and Rezoning are consistent with the City's regulations and policies.
The DRC recommends approval of the proposed Annexation and Rezoning from "Orange County"
R-1 (Single Family) to "City of Ocoee" R-1 (Single -Family Dwelling) of the property known as the
Ocoee Rental Trust Property located at 518 2nd Street.
