02-09-2021 Minutes Ocoee florida MINUTES PLANNING AND ZONING COMMISSION ACTING AS THE LOCAL PLANNING AGENCY Tuesday, February 9, 2021 I. CALL TO ORDER - 6:30 pm A. Invocation and Pledge of Allegiance B. Roll Call and Determination of Quorum Present: Vice-Chair Lomneck, Member Forges, Member Mellen, Member Williams Absent: None Also Present: Development Services Director Rumer, City Attorney Cookson, Assistant City Attorney Opsahl, Recording Clerk Heard Development Services Director Rumer announced the board currently has two vacancies,because Alternate Member Lowe resigned, and Chair Keller resigned to run for City Commissioner. He anticipates the two vacancies to be filled in June when the 2021 terms expire. He further stated the March and April meetings are canceled due to the upcoming city election. Vice-Chair Lomneck inquired if an election for chair should be done now. City Attorney Cookson suggested the board wait until May or June for election of Chair, but said if the board wishes to elect a chair, Co-Vice Chair will be suitable at this time.Vice-Chair Lomneck nominated Member Mellen for Co-Vice Chair. (6:35 pm) Member Williams, seconded by Member Forges, moved to elect Member Mellen for Co-Vice Chair for the interim; Motion carried unanimously. Vice-Chair Lomneck announced the following, "City Hall is open to the public; however, attendance inside the Ocoee Commission Chambers is limited to accommodate social distancing and is subject to change based on the Governor's Executive Order. III. OLD BUSINESS -None IV. NEW BUSINESS—Public Hearings (6:37 pm) A. Crossings at Maguire—2647 and 2663 Maguire Road Annexation, Rezoning to Planned Unit Development (PUD) & Small Scale Land Use Amendment; Project No(s): AX-10-20-94, RZ-20-10-13 & CPA 2020-003. (Advertised in the West Orange Times on Thursday, January 26, 2021) (Development Services Director Rumer) Development Services Director Rumer presented a brief overview of this proposed Annexation, Small Scale Comprehensive Land Use Amendment and Rezoning to Planned Unit Development (PUD) at 2647 Maguire Road(4.92 acres) and 2663 Maguire Road (.61 acres), which is located on the west side of Maguire Road,600 feet north of Roberson Road. The applicants propose to develop the 5.611 acres as a mixed-use commercial PUD consisting of four (4) buildings: (1) a proposed 2,510 square foot coffee shop, (2) a proposed 6,400 square foot office/commercial building, (3) a proposed 85,140 square foot three-story Mini Warehouse/Storage Building, and (4) a proposed 3,500 square foot bank/credit union. The proposed PUD accesses Maguire Road via one entrance. If approved by the City Commission, it will require an amendment to the Joint Planning Area Agreement with Orange County. The larger parcel at 2647 Maguire Road is eligible for annexation as it is adjacent to property located within the City of Ocoee limits on the north, south, east and west sides. The applicant has requested a City of Ocoee zoning designation of PUD (Planned Unit Development). According to the Land Development Code, the PUD zoning designation is intended for all areas shown on the Future Land Use Map. The PUD zoning designation is consistent with the proposed future land use designation of Commercial. Based on the PUD Land Use Plan, there are wetlands associated with the property. A further review from the National Wetlands Mapping Source indicated there is a small pond that is considered jurisdictional wetlands. Discussion: Member Mellen inquired if the wetlands will encroach on the storage building to where it may need to be mitigated. Development Services Director Rumer said mitigation will need to be done, and he explained this particular wetland is a closed wetland. 2 Planning&Zoning Commission February 9,2021 Member Williams asked for Development Services Director Rumer to explain the drive-thru at the coffee shop. Development Services Director Rumer explained the coffee shop drive-thru and the entrance and exit off of Maguire Road. He further said they are looking into future improvements on Maguire Road, which may encompass a northbound left-turn lane into this site. Member Mellen asked if there is enough room for fire trucks around the self-storage area. Development Services Director Rumer explained where the fire trucks would park and that they have sufficient 400-foot hoses to put out any possible fire. Member Forges asked if there is a way to create an entrance/exit through the property on the south. Development Services Director Rumer answered in the negative, because the current restaurant located on the property, Rusteak, has no room on their property for an entrance/exit. Member Williams asked whether all of the buildings will be completed in one phase. Alex Mestdagh,Applicant, 280 West Canton Avenue, Suite 110, Winter Park, indicated this will be one buildout and no phasing will be needed. (6:56 pm) Vice-Chair Lomneck opened the public hearing. Tuesday Goodson, Resident, inquired about the pond and drainage. Development Services Director Rumer explained the closed basin and drainage within the vicinity of her home. Recording Clerk announced no emails and/or telephone calls were received. Vice-Chair Lomneck closed the public hearing. MISCELLANEOUS - (7:01 pm) A. Project Status Report Development Services Director Rumer updated the Board with the following: • The foundation was poured at the new City Hall location last week. • Opening bids were received for the final design of Bluford Avenue from Old Winter Garden Road up to Geneva Avenue, which will be a roundabout. • Inspiration PUD is coming to completion. • Two townhome developments are currently under construction, one off of A.D. Mims and one off of Clarke Road. A development agreement is going before the City Commission to facilitate the widening of Clarke Road from A.D. Mims up to Clarcona Ocoee Road. • The light industrial building off of Maguire Road is nearing the final stages. • An annexation, large scale comprehensive plan amendment with rezoning to PUD for an industrial use off of Ocoee Apopka Road was recently submitted. • Heichel Plumbing is moving to Ocoee off of Marshall Farms Road, south of State Road 50, which is within the CRA. • Sonny's buildout will be starting soon. • Tijuana Flats is not open yet. They put their sign up while they are doing their interior buildout. B.
