04-27-2021 Minutes CITY OF OCOEE Code Enforcement Board April 27, 2021 I. CALL TO ORDER Chair Odom called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida. A. INVOCATION: Member Mann initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Lewis led the Board in the Pledge of Allegiance to the U.S. flag. C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared a quorum (4) present. PRESENT: Chair Odom & Members: Lewis, Mirza, Bandur, Mann, Shropa &Johnson. Also present: Board Attorney B. Scott George, Assistant Support Services Director Doug Gaines, Code Enforcement Clerk Justin Mieras, and Code Enforcement Officer Diaz & Loeffler. ABSENT: Member Mirza is an excused absence. D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS CASE NO 2021-00187 OFFICER LOEFFLER 502 WURST RD SWIFT MICHAEL LEE ESTATE Violation Cited: § 108-23.Q., § 108-24.D., § 115-3.B., &§ 147-27.A. Summary: § 108-23.Q. — Accessory structures. Garages, storage buildings and all other accessory structures shall be maintained and kept in good repair and sound structural condition. § 108-24.D.—It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice box, refrigerator, stove,glass, building material, building rubbish or similar items. It shall be the duty every such owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items. § 115-3.B.—No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass, undergrowth or other dead or living plant life. § 147-27.A.—At non-pickup times, garbage carts shall be placed in side yards or rear yards and screened from view to the extent practicable. Except as provided herein, garbage carts shall at no time be placed in the front yard of the premises. Observation: § 108-23.Q.— Damaged, Crooked, Hanging Fence Section § 108-24.D.—Junk Debris Littering Side Yards Of House § 115-3.B.—Tall Grass And Weeds § 147-27.A.—Trash Can Left Curbside During Non-Collection Day/Time Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of April 27, 2021, the property is still in non-compliance.The City asked for an Order of Compliance by May 07, 2021, or thereafter to be fined $50.00 per day, per violation, until found in compliance. Additionally, the City asked to abate the property if it is found vacant. Member Bandur, seconded by Member Johnson, moved that Case in #2021-00187, the respondent be found in violation as cited as of April 06, 2021, and be given until May 07, 2021, to come into compliance or be fined$50.00 per day, per violation, until found in compliance, and in the event the property becomes vacant to authorize the City to abate the property and assess the cost to the property. Motion carried unanimously. IV.CASE RESOLUTION CASE NO 2020-02121 OFFICER DIAZ 317 LEE ST ZABRPP CORP Violation Cited: §115-3.A.(3) & 165-3.A. Summary: §115-3.A.(3)—No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health, safety and welfare. 165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation: §115-3.A.(3)—Piles of miscellaneous junk/debris on property. §168-6.B.(1)—Junk vehicle(s) untagged, abandoned and inoperable on property Officer Diaz presented the case and gave its history. Officer Diaz further explained that as of April 27, 2021,the property is still in non-compliance. ZABRPP CORP Attorney Roger Kelly confirmed the Board's Order required compliance by January 26, 2021. He explained he under estimated the backup in the court system,and introduced a timeline of their efforts to evict the tenant. He asked the Board to give an additional 30 days. Member Bandur,seconded by Member Mann, moved that Case in#2020-02121, the compliance date be extended to May 24, 2021. Motion carried unanimously. CASE NO 2021-00099 OFFICER SIEGRIST 2292 E H POUNDS DR COLSTON, HORACE.1 COLSTON,VELVET S Violation Cited: §165-3.A. Summary: §165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation: §165-3.A.—One (1) Nissan p/u truck/ blk/ Expired tag JUN-18/with flat RF tire parked in driveway. Assistant Support Services Director Doug Gaines explained that as of April 27, 2021, the property is still in non- compliance.The City asked for an Order Imposing Fine. Member Bandur, seconded by Member Lewis, moved that Case in #2021-00099, the Board impose fines as of April 03, 2021, as previously set by this Board. Motion carried unanimously. CASE NO 2021-00105 OFFICER LOEFFLER 502 WURST RD SWIFT MICHAEL LEE ESTATE Violation Cited: §6-4.H.(6)(b) Summary: §6-4.H.(6)(b)—Trailers of all types shall not be parked or stored for more than 48 hours in a residential district unless it is located behind the front yard building line and screened with a six-foot high opaque fence with gate. Observation: §6-4.H.(6)(b)—Occupation of Camper Trailer that is also Connected To Water& Electric Supply. Officer Loeffler explained that as of April 27, 2021, the property is still in non-compliance. The City asked for an Order Imposing Fine. Member Lewis, seconded by Member Bandur, moved that Case in #2021-00105, the Board impose fines as of April 08, 2021, as previously set by this Board. Motion carried unanimously. V. COMMENTS Chair Odom announced Mr.Stewart has resigned from the Board.The Code Enforcement Board currently has 6 out of the 7 regular member seats filled and 1 out of 2 alternate member seats filled.
