01-24-2006 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING JANUARY 24,2006 CALL TO ORDER Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:05 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation and Chairman Godek led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Vice-Chairman Chancey, Members M. Godek, Hopper, Morton, Stanley, and Alternate Members Ballard and Lenko (arrived 7:10 p.m.). Also present were Building Official Jones, Code Enforcement Officers Braddy-Bagwell, Loeffler, and Rodriguez, Permitting Clerk Ramos, Attorney Sneed, and Administrative Assistant III Aycock. ABSENT: Member Amey was excused. Permitting Clerk Ramos administered the oath to Code Enforcement Officers Braddy- Bagwell, Loeffler, Rodriguez, and Siegrist, and anyone intending to speak regarding a case. Chairman Godek welcomed the new members to the board. Officer Loeffler asked Mr. Blackmon to meet him on the property tomorrow so that he can verify compliance and it was agreed. Member Morton, seconded by Member Stanley, moved in Case No. 06-007 to find the Respondent in violation as cited as of October 21, 2005, but to give until January 26, 2006, to comply or be assessed a fine of$100 per day. Officer Loeffler, having been sworn, presented exhibits and gave a detailed history of the Case and stated the property was in non-compliance of 165-3, but in compliance of other citations. Officer Loeffler said that the citations listed numbers 165-4 and 165-5 are only descriptions of what a junk/inoperable vehicle is and should not be listed as code violations. tisr 3 Code Enforcement Board Minutes January 24,2006 Member Chancey inquired if the compliance date had been extended since October. Officer Loeffler said yes, a computer glitch caused him to lose information on the case and he extended the compliance date at that time. Questions and Comments Regarding Case No. 06-010 Susan Valenti, 5026 Lighterwood Court, stated she listed the cars on Kelly Blue Book on the internet in order to sell them and has not sold them yet; however,has received an interest in at least one of them. She said she is a single mom and needs to sell the cars because she needs the money. She added that the garage roof suffered damaged from the hurricane and she is unable to use it for the cars. She is trying to get the garage cleaned out and fixed enough to fit one car inside. She plans to get license plates back on two vehicles with insurance. Chairman Godek asked for a time limit as to when she could come into compliance. Ms. Valenti said she does not know how long they will take to sell,but she definitely needs the money and they have been posted at a fair price. Member Hopper stated it is the homeowners association that is complaining about the problem. Member Stanley, seconded by Member Ballard, moved in Case No. 06-010 to find the Respondent in violation of Section 165-3 as of January 9, 2006, and be given until February *Dv 14, 2006, to come into compliance or be fined$100 per day thereafter. Officer Siegrist, having been sworn in, presented exhibits and gave a detailed history of the case. He stated the Respondent was in compliance of sections 108-22, and 108-23 I, Q, R(1), M(1) & (2); however, sections 108-24 B, and 165-3 remain in non-compliance. 4 Code Enforcement Board Minutes January 24,2006 Questions and Comments Regarding Case No. 05-111 William Armas, 340 Franklin Street, stated there was a warehouse behind the property in 2005 and the Code Enforcement Board granted him permission to put the merchandise into trailers if organized nicely. He said he had done that and has also put a cover over the fan, which they had asked him to do. Mr. Armas said there is one trailer remaining that he is trying to have picked up by the company he rents it from, Affordable Space Rentals. The company that owns the trailer is the only one allowed to remove it and they have told him it may take three weeks to come out. He displayed a picture of the inside of the remaining trailer,which is empty. Member Chancey, seconded by Member Hopper, moved in Case No. 05-111 to extend the compliance date to February 21, 2006. Officer Siegrist also read a letter from the tenant stating complaints of violations and health hazards in the home and that the landlord makes no correction to the problems. Questions and Comments Regarding Case No. 06-005 Member Morton commented that he cannot understand why a landlord would allow a tenant to live such conditions. Officer Loeffler, having been sworn, presented exhibits and gave a detailed history of the case and stated the Respondent is in non-compliance. Officer Loeffler further explained that the City has exhausted all efforts to locate the owner Mr. Norris and a warrant has been issued by the State due to unpaid taxes by Mr. Norris. Questions and Comments Regarding Case No. 06-008 Member Hopper inquired if the lot owner was the same as the trailer owner. Officer Loeffler concurred. Member Morton asked if the lot has gone to a tax deed sale already. Officer Loeffler said it had not. Discussion ensued regarding the options the City could proceed with. Member Stanley, seconded by Member Morton, moved in Case No. 06-008 to find the Respondent in violation as cited as of December 30, 2005, and to give the respondent until January 27, 2006, to become in compliance or have the City proceed to put the property into compliance and impose a lien to recover cost. Motion carried 7-0. Member M. Godek asked how long the building could possibly remain a health hazard. Stop-work notice posted. Notes: August 12, 2005; a meeting between Mr. George Bori,the City Planning Department and Code Officer Loeffler was held. Mr. Bori requested the meeting to display a drawing of a large frame canopy structure he desired at his business. Mr. Bori was advised that it would require a permit, which could only be applied for subsequent to a submitted, reviewed, and approved site-plan. If an approved site-plan were in place, then a permit for any structure or alterations desired at the location could be applied for and would be required to conform with all City Ordinances,City Codes,and the Florida Building Code prior to issuing. Officer Loeffler said a site plan from the applicant has not been received yet. 9 Code Enforcement Board Minutes January 24,2006 COMMENTS Building Official Jones welcomed everyone into 2006. Member Hopper said it was good to have this board for the City; they do a good job and appreciated the Code Enforcement Officers taking care of Ocoee. Member Chancey had a question regarding the shopping center at Wal-mart and if any progress had been done on that. Officer Loeffler said the owner's assistant has spoken to him; however,he has not had any contact with anyone else. Member Morton said it was nice to see new faces.
