Colonial Drive Commission District#3 — Richard Firstner Background Summary: The applicant, Christian Brothers Automotive, is requesting approval of three (3) variances for a proposed 5,000 s.f. Automotive repair facility with eight (8) bays. The proposed Christian Brothers Automotive Center is proposed on Lot 3 of the West Colonial Ocoee Commercial Subdivision. The Subdivision contains three (3) Lots and a Tract for drainage. Lot 1 has a Popeyes Chicken quick-serve restaurant. Lot 2 has a strip center with a Qdoba, Smoothie King, Orlando Health Urgent Care, National Pizza delivery restaurant, and Lot 3, which is vacant. Lot 3 is south of the Fairfield Inn and Suites and east of Old Towne Pottery. The property is also located within the boundaries of the CRA (Community Redevelopment Agency) and has a zoning designation of C-3 Heavy Commercial. The proposed Small-Scale Site Plan provides the main access point to be located on the internal drive with an existing driveway connection to Maguire Road. Cross access is provided, which provides for additional access through the Fairfield Hotel site and a third entrance at Lot 1 (Popeyes). Stormwater is handled through the master stormwater pond located on Tract A. The request for variances is to provide relief to building setbacks and buffer standards explicitly created for Lot 3 during the subdivision process and are not necessarily only Land Development Code driven. The variances being requested are: i)_ A variance request to reduce the east 10-foot landscape buffer down to one (1) foot for the location of a Compressor Room and driveway adjacent to Tract A (stormwater pond.) ii) A variance request to reduce the building setback from the east property line adjacent to Tract A (stormwater) from 20 feet to one (1) foot for the Compressor Room and 15 feet for the main building. iii) A variance request to reduce the northern building setback as shown on the Preliminary Final Commercial Subdivision plan from 35 feet to 20 feet. According to Article VI, Section 4-9 A., the variance application/applicant must demonstrate: (1) That special conditions and circumstances exist which are peculiar to the land, structures, or required subdivision improvements involved and which are not applicable to other lands, structures, or required subdivision improvements. (2) That a literal interpretation of the provisions of these regulations would deprive the applicant of rights commonly enjoyed by other properties with similar conditions. (3) That the special conditions and circumstances do not result from the actions of the applicant. (4) That the granting of the variance requested will not confer on the applicant any special privilege that is denied by these regulations to other lands, structures, or required subdivision improvements under similar conditions. With respect to the Preliminary Small-Scale Site Plan provided and the location on Lot 3, staff supports the variances request for the following reasons: 1. The setback requirements on the north side were designated only for Lot 3 and are not required in the C-3 zoning district. Staff recalls the intent was to provide additional buffering to the Hotel. The proposed automotive center has provided that the building on the north side will not have any windows or doors. Additionally, all other apparatus will be located in the Compressor Room and not on the back of the building. 2. The eastern lot line of Lot 3 is located next to the drainage pond tract. The pond is currently fenced with more than enough room to maintain the pond berm. 3. The landscape buffer next to the pond tract does not reduce the visual integrity of the pond and commercial Subdivision. Issue: Should the Honorable Mayor and City Commission approve the following variances: i) reducing the current landscape buffer to decrease from 10 ft to 1 ft on the east property line, ii) to decrease the required building setback from 20 ft to 1 ft on the east side, and iii) reduce the building setback from 35 ft to 20 ft on the north property line, for a proposed Christian Brothers Automotive Service Center? Planning and Zoning Commission Recommendation: The Planning and Zoning Commission (P&Z) reviewed the proposed variance requested by Christian Brothers Automotive on June 8, 2021. After a brief discussion, a motion was made to recommend approval of the variance with two (2) conditions: a) tires and equipment must remain inside a building and b) a pedestrian sidewalk be provided to the retail building located south of the proposed site.The Planning and Zoning Commission then voted unanimously to recommend approval of this motion with the conditions. Staff Recommendation: Staff recommends that the Honorable Mayor and City Commission approve the three variances along with the conditions of the Planning and Zoning Commission.
