Background Summary:
The applicant, Mohammed Hassan, is requesting approval of three (3) variances as follows:
1) Minimum lot width reduction from 70 feet to 50 feet to create three (3) 50-foot wide lots,
2) Minimum lot size reduction from 7,000 SF to 5,000 SF lot sizes, and
3) Minimum front (south) building setback reduction for proposed lot three (3) only from 25 feet to
9.3 feet along Lee Street, which is currently unimproved right-of-way (ROW).
The subject property is located at 613 Lyman Street and is within the R-1 Single-Family Dwelling zoning
district. Per Table 5-2 of the Land Development Code (LDC), the minimum zoning descriptions for
development within the R-1 zoning district are as follows:

According to Chapter 4-9 A., the variance application/applicant must demonstrate:
The applicant has not demonstrated that there are any special conditions and circumstances that exist
which are peculiar to the land or existing structure, as indicated on the aerial and location map attached.
In terms of need and justification, the applicant stated that the variances are needed in order to build
three (3) homes on 5,000 SF lots.

(2) That a literal interpretation of the provisions of these regulations would deprive the applicant of rights
commonly enjoyed by other properties with similar conditions.
The applicant is subject to the same regulations, requirements and rights as other properties with similar
conditions under the existing R-1 zoning district. The applicant is proposing to construct three (3) two-
story homes with approximately 2,096 SF of living area, and the minimum living area is 1,000 SF.
Therefore, the literal application of the minimum standards of Table 5-2 will not result in unnecessary
hardships.
(3) That the special conditions and circumstances do not result from the actions of the applicant.
The existing lot, which is comprised of six (6) 25-foot wide previously platted lots, has 150 feet of
frontage. The applicant's proposal to split the 150-ft lot into three (3) 50-ft lots instead of two (2) 75-ft
lots creates the applicant's need to request three (3) variances. Thus, the applicant has not
demonstrated that the need for the variances is not self-imposed.
(4) That the granting of the variance requested will not confer on the applicant any special privilege that
is denied by these regulations to other lands, structures, or required subdivision improvements under
similar conditions.
The granting of this variance will confer special privileges to the applicant that are not currently granted
to other lands, structures, or required subdivision improvements under similar conditions, as shown on
the location and aerial maps.
Issue:
Should the Honorable Mayor and City Commission approve three (3) variances as follows:
1) Minimum lot width reduction from 70 feet to 50 feet to create three (3) 50-foot wide lots,
2) Minimum lot size reduction from 7,000 SF to 5,000 SF lot sizes, and
3) Minimum front (south) building setback reduction for proposed lot three (3) only from 25 feet to
9.3 feet along Lee Street, which is currently unimproved right-of-way (ROW).

Planning and Zoning Commission Recommendation:
The Planning and Zoning Commission (P&Z) reviewed the proposed variance requested by Mohammed
Hassan on June 8, 2021. After a brief discussion on the topic, a motion by member Lomneck was made
to recommend approval of the variance. The motion included a condition that architectural façade of the
southern elevation for the home on proposed Lot 3 be similar in treatment and material as the primary
façade elevation along Lyman Street, and any fencing along the south property boundary of proposed
Lot 3 be limited to a minimum fifty percent (50%)transparency and shall be of a decorative material. The
Planning and Zoning Commission then voted 2 to 1 to recommend approval of this motion with the
conditions.
Staff Recommendations:
Based on the findings stated above and the requirements of Article IV, Section 4-9, staff does not find
that the variances are needed or justified and is unable to support the variance requests as proposed.
However, staff could support the variances if the applicant agrees, relative to proposed Lot 3, to
enhancing the architectural design of the house facing Lyman Street and Lee Street and limiting any
fencing along the southern property boundary to a minimum of fifty percent (50%) transparency and of
a decorative material and if the City Commission would consider utilization of the unimproved Lee Street
ROW as public open space or a linear park in lieu of as a roadway.
Thus, staff recommends that the Honorable Mayor and City Commission make recommendation of
denial of all three (3) variances.
However, should the Honorable Mayor and City Commission make a recommendation of approval, staff
recommends the following conditions of approval should, during the City Commission public hearing,
the City Commission considers utilization of the unimproved Lee Street ROW as public open space or a
linear park in lieu of as a roadway:
1) Architectural façade of the southern elevation for the home on proposed Lot 3 be similar in
treatment and material as the primary façade elevation along Lyman Street.
2) Any fencing along the south property boundary of proposed Lot 3 shall be limited to a minimum
fifty percent (50%) transparency and shall be of a decorative material.
