07-27-2021 Minutes CITY OF OCOEE Code Enforcement Board July 27, 2021 I. CALL TO ORDER Chair Odom called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida. A. INVOCATION: Member Bandur initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Johnson led the Board in the Pledge of Allegiance to the U.S. flag. C. ROLL CALL AND DETERMINATION OF QUORUM: Code Enforcement Clerk Mieras performed roll call and declared a quorum (4) present. PRESENT: Chair Odom, and Members: Bandur, Lewis, Mirza, Shropa, & Johnson. Alternate Member Brennan was present but did not participate as a voting member. Also present: Board Attorney Skip Fowler, Assistant Support Services Director Doug Gaines, Code Enforcement Clerk Justin Mieras, and Code Enforcement Officers Rodriguez, Siegrist, & Loeffler. ABSENT: Member Mann is an excused absence. D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. Member Bandur, seconded by Member Lewis, moved that Case #2021-00478 be moved to the beginning of the agenda and then revert to the original order with Case#2021-00330 and all subsequent cases. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS CASE NO 2021-00478 OFFICER LOEFFLER 1500 LADY AVE DUANE L& DEA M HARRIS Violation Cited: §108-24.D, §147-27.A, & §165-3.A. Summary: §108-24.D.—It shall be unlawful to use a residential property for the storage of any abandoned motor vehicle, ice box, refrigerator, stove,glass, building material, building rubbish or similar items. It shall be the duty every such owner and occupant to keep the premises of residential properties clean and to remove all such abandoned items. §143-27.A. —At non-pickup times, garbage carts shall be placed in side yards or rear yards and screened from view to the extent practicable. Except as provided herein, garbage carts shall at no time be placed in the front yard of the premises. §165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property. Observation: §108-24.D.—Misc.Junk,Trash, Debris, Rubbish, Materials, Parts, Supplies Littering Front, Side And Rear Of Property §143-27.A.—City Waste Cans for Solid Waste and Recycle Materials Stored in A Highly Visible Prohibited Location §165-3.A.—Junk-Or- No Tag-Or- Non-Operational Vehicles Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of July 27, 2021, the property is still in non-compliance.The City asked for an Order of Compliance by August 11,2021,or thereafter to be fined $50.00 per day, per violation, until found in compliance. Respondent Duane Harris explained he has cleaned up the property some,but needs more time to come into compliance. He advised the 15 day time period the city recommended should be fine. Member Bandur, seconded by Member Mirza, moved that Case in#2021-00478, the respondent be found in violation as cited as of July 13, 2021, and be given until August 11, 2021, to come into compliance or be fined$50.00 per day, until found in compliance. Motion carried unanimously. CASE NO 2021-00330 OFFICER SIEGRIST 2576 TWISTING SWEETGUM WAY ESTHER JEAN JOSINVIL Violation Cited: §51-13. Summary: §51-13.—It shall be a violation to do work related to construction without first obtaining a permit. Observation: §51-13.—Two (2)Sections of Six(6) Foot Vinyl Fence Erected Without Permit. Officer Siegrist presented the case and gave its history. Officer Siegrist further explained that as of July 27, 2021, the property is still in non-compliance.The City asked for an Order of Compliance by August 06,2021,or thereafter to be fined $50.00 per day, until found in compliance. Member Bandur,seconded by Member Shropa, moved that Case in#2021-00330, the respondent be found in violation as cited as of June 08, 2021, and be given until August 06, 2021, to come into compliance or be fined$50.00 per day, until found in compliance. Motion carried unanimously. CASE NO 2021-00406 LOPEZ DONIS EDVIN OFFICER LOEFFLER 131 MOBILE LN GONZALEZ VASQUEZ SONIA BEATRIZ GONZALEZ Violation Cited: §51-13. Summary: §51-13.—It shall be a violation to do work related to construction without first obtaining a permit. Observation: §51-13. — Mobile Home Brought into The City Without Pre-Inspection and Approval and Placed At 131 Mobile Lane Without Permit(S) Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of July 27, 2021, the property is still in non-compliance.The City asked for an Order of Compliance by August 11,2021,or thereafter to be fined $50.00 per day, until found in compliance. Member Bandur,seconded by Member Johnson, moved that Case in #2021-00406, the respondent be found in violation as cited as of June 09, 2021, and be given until August 11, 2021, to come into compliance or be fined$50.00 per day, until found in compliance. Motion carried unanimously. CASE NO 2021-00412 OFFICER RODRIGUEZ 524 3RD ST JANITZA SANCHEZ Violation Cited: §115-3.A(3) Summary: §115-3.A(3)—No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health,safety and welfare. Observation: § 115-3.A.(3)—Trash/debris Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of July 27, 2021, the property is still in non-compliance.The City asked for an Order of Compliance by August 06,2021,or thereafter to be fined $50.00 per day, until found in compliance. Member Bandur, seconded by Member Johnson, moved that Case in#2021-00412, the respondent be found in violation as cited as of June 11, 2021, and be given until August 06, 2021, to come into compliance or be fined$50.00 per day, until found in compliance. Motion carried unanimously. IV. CASE RESOLUTION CASE NO 2021-00098 OFFICER LOEFFLER 3205 STONEGATE DR JACKSON EARTHA MIRANDA Violation Cited: §51-13. Summary: §51-13.—It shall be a violation to do work related to construction without first obtaining a permit. Observation: §51-13.— Fence installed without an approved permit. Officer Loeffler explained that as of July 27, 2021, the property was found in compliance. No further action requested. V. COMMENTS The Board welcomed the new Alternate, Member Brennan, and the new attorney, Skip Flower. Assistant Support Services Director Doug Gaines informed the Board that as State of Florida bill 60 took effect on July 1S` a complainant's name and address are now required before Code Enforcement can investigate an issue. He further explained the bill does allow an exception for anonymous complaints if the officer believes the concern merits an imminent threat to life safety.
