Item #11 Amendment of Budget for design and construction of 7th Avenue to reflect final costs fir AGENDA ITEM COVER SHEET Meeting Date: July 17, 2007 Item # ----JJ ~.~ Contact Name: David Wheeler 407 -905-3100, ext. 1504 Reviewed By: Department Director: City Manager: Contact Number: ~--- Subject: Amendment of budget for design and construction of ih Avenue to reflect final costs. -- Background Summary: The City Commission established a budget of $430,000 for the design and construction of ih Avenue between 6th Avenue and Moore Road at its meeting of June 7, 2005, and identified funding in that amount from a variety of sources consistent with the Second Amendment to the Second Developer Agreement for the Meadowridge Subdivision (nee Westridge PUD). On March 7, 2006, the City Commission approved the Third Amendment to the Second Developer Agreement, which included a revised budget of $450,000 for construction only of ih Avenue and altered some of the financial arrangements for funding the project. Of particular note, the Amendment stated that the developer's contribution would be limited to $160,000, with the City funding the balance. However, the City never altered its internal financing plan to accommodate the increased commitment contained in the Amendment. Cost to the City for engineering design services totaled $57,384.93; all these fees were paid using the $430,000 budget allocation, leaving $372,615.07 for construction. The final cost of constructing was $432,325, bringing the total cost of the project to $489,709.93 for design and construction. As a result of the City budget never being altered from the original $430,000, the project is under-funded by the amount of $59,709.93 and the final invoice for construction cannot be paid in full. (A partial payment of $372,615.07 was made from the remaining budget allocation in May 2007.) Issue: The Engineering Department proposes that the City Commission reallocate unused funds from other roadway construction projects to fully finance construction of the ih Avenue project and, thereby, allow payment of the final invoice. Recommendations The Engineering Department recommends that the City Commission approve the reallocation of $53,000 in unused funds from the State Road 50 at Maguire Road traffic signal revision project and $6,709.93 in unallocated funds from the planned traffic signal and intersection modification project for Maguire Road at Moore Road/Roberson Road. This change seeks to fulfill prior City Commission commitments with regard to improvements being made by the developer for the City. Attachments: None. Financial Impact: The funding for this change order will reallocate unused funds from other projects, with no net increase in financial commitments for roadway construction and improvement projects.
