NEW BUSINESS – Public Hearings (6:31 pm) A. West Orange Surgery Center – 3422 & 3432 Old Winter Garden Road Annexation & Rezoning to PUD; Project No(s): AX-10-21-22 & RZ-21-10-30. (Advertised in the West Orange Times on Thursday, December 2, 2021) Zoning Manager Whitfield presented a brief overview of this project, which contains two (2) properties approximately 1.27 acres in total, and are located at 3422 and 3432 Old Winter Garden Road. The applicant is proposing to annex into the City and rezone the properties as Planned Unit Development (PUD) in order to develop a one-story 11,500 SF surgery center with the following setbacks: 15 foot front setback from Old Winter Garden Road; 10 foot front setback from Blackwood Avenue; 10 foot side setback, and 25 foot rear setback. Stormwater management will be provided through a combination of surface retention and exfiltration. Landscape buffers along the front (Old Winter Garden Road and Blackwood Avenue) and rear property lines will be provided. The rear landscape buffer will be supplemented by either a wall or a fence per Future Land Use Element Policy 7.1. Planning & Zoning Commission December 14, 2021 2 Staff supports the proposed development standards in the West Orange Surgery Center Land Use Plan (LUP) if the applicant revises the LUP to reflect a shared driveway and vehicular connectivity in the northern and southern drive aisles, via cross-access easements, for efficient circulation between the West Orange Surgery Center and West Orange Medical Center. The Development Review Committee (DRC) and staff recommend approval for both items subject to the following conditions: • Applicant shall work with staff and the applicants of the West Orange Medical Center to develop a plan that reflects a shared driveway and vehicular connections along the north and south drive aisles • Resolution of utilities issues, specifically sewer connections Discussion: Member Williams asked for clarification on when the adjacent property to the east will be amending their LUP. Zoning Manager Whitfield explained the properties are owned separately; however, they are amending their Land Use Plans simultaneously and have determined the cross- access connectivity is in both of their best interest. Member Forges inquired if construction will not commence until the easement is finalized. Development Services Director Rumer explained the easement will be a part of the site plan review and approval, which is the next step after this rezoning to PUD and Land Use Plan approval. Member Keller asked if the home on the southwest corner is on the property will be removed. Zoning Manager Whitfield indicated it is a separate property, which will be buffered from this development by a stormwater pond and 10-foot minor landscape buffer as required by the Comprehensive Plan policy. The Comprehensive Plan policy requires landscaping, but allows either a fence or a wall to be used to supplement the required landscaping. Member Kennedy asked if the two neighboring property owners are related, and Zoning Manager Whitfield answered in the negative. The Public hearing was opened. Planning & Zoning Commission December 14, 2021 3 B. Everest Rehabilitation Hospital - Preliminary Large Scale Site Plan; Project No: LS- 2021-007. (Advertised in the West Orange Times on Thursday, December 2, 2021) Development Services Director Rumer presented a brief overview of this property, which is located on the east side of Lake Johio Road and the north side of E. Silver Star Road, approximately 770 feet east of the intersection of N. Clarke Road and E. Silver Star Road. The subject site is approximately 6.79 acres in size. The proposed Everest Rehabilitation Hospital Large Scale Preliminary Site Plan consists of a one-story 39,817 SF rehabilitation facility consisting of 36 beds. Additionally, there is 4,792 SF future expansion space. Parking will be provided to meet two spaces per bed with a required 72 parking spaces. Access to the site is via a right-in / right-out on Silver Star Road. An additional driveway is located on Lake Johio Road with a right-turn lane. A deceleration right-turn lane is being proposed on Silver Star Road; however, FDOT has not yet approved it. Stormwater is going to the master pond, and cross-access is being provided to the last parcel to the east. The development will provide a six-foot wall on the north side of the property. The Development Review Committee (DRC) voted to approve the Preliminary Large Scale Site Plan under the following conditions: • A separate utility meeting is held, and • Remaining comments are satisfied by the time the project is scheduled for the City Commission Discussion: The applicant was present for questions. Member Williams inquired about the adjacent vacant lot to the east. Development Services Director Rumer explained the City is currently working with prospects regarding that lot. Discussion ensued about the wall surrounding the adjacent neighborhood. Dave Schmitt, Applicant, Dave Schmitt Engineering, agreed with staff’s recommendation, and said he will answer any questions the board may have. The public hearing was opened. Planning & Zoning Commission December 14, 2021 4 C. Ocoee Tomyn Road Self-Storage at Barkeritaville PUD Preliminary/Final Large Scale Site Plan; Project No: LS-2021-010. (Advertised in the West Orange Times on Thursday, December 2, 2021) Development Services Director Rumer presented a brief overview of the subject property, which is zoned PUD (Planned Unit Development) and is located on the east side of Tomyn Boulevard/Windermere Road, and approximately 1,517 feet north of the Tomyn Boulevard/Windermere Road and Roberson Road roundabout, adjacent to the Pet Paradise. The subject site is approximately 8.13 acres in size. The Final Large Scale Site Plan consists of a three- story 34,969 SF self-storage facility with a shared entrance drive to the adjacent Pet Paradise. Parking is being provided with one space per 75 units, and one space for each two employees. The loading area is located inside the building with a drive-through center. Stormwater is going to the master stormwater pond which will be enlarged with this project. Utilities are being provided by an existing water and sewer line installed under the South West Utility Service Area. A six-foot sidewalk will be extended on the north end. The Development Review Committee (DRC) voted to approve the Preliminary/Final Large Scale Site Plan. Discussion: The Board had no questions. Bill Hockensmith, Applicant, Florida Engineering Group, said he is present to answer any questions. Member Forges said he agrees with staff’s recommendation and feels there is a need in that area for this type of establishment. The Public hearing was opened. Project Status Report Development Services Director Rumer updated the Board with the following: • Ocoee Medical had a preconstruction meeting today. Their parcel is located at State Road 50 and Maguire, which was an old gas station and is being demolished this week. • He recently visited the Inspiration PUD, and encouraged members to take a drive to see the development. All commercial spaces are leased, and 30 townhomes are already reserved for $630,000 each. • Ocoee Village Center is going forward, and the intersection at Fullers Cross Road and N. Lakewood Avenue will be closed on two (2) separate occasions in the upcoming months. There may be a grocery store going in that vicinity. • The D.R. Horton project will be breaking ground soon by McCormick Road and Apopka Vineland Road with approximately 300 single-family homes. • The Chevron property is under contract, which is an approved PUD named Eagle Creek with approximately 276 townhomes. BACKGROUND: Owner: Empire Finish Systems, LLC Applicant: Christian Sears, representing Empire Finish Systems, LLC Site Location: The subject property contains approximately 0.78 acres and is located on the west side of South Bluford Avenue at the terminus of 7th Street, approximately 285 feet south of Delaware Street. The physical address is 449 South Bluford Avenue. Property Size: +/- 0.78 acres Existing Future Land Use: Low Density Residential (LDR). Development is permitted at a density of up to four (4) dwelling units per acre, resulting in a maximum of three (3) units. Proposed Future Land Use: High Density Residential (HDR). Based on the maximum development allowed by each future land use designation, the proposed FLU Amendment would result in a net increase of 9 dwelling units. Existing Zoning: R-1AA (Single-Family Dwelling District). Proposed Zoning: R-3 (Multi-Family Dwelling District). An R-3 zoning classification is requested because Section 5-3(B)(7) states that this zoning classification is primarily intended for Medium Density Residential or High Density Residential Future Land Use Designations. The table below summarizes the differences in the lot standards between the zoning districts, as established in Table 5-2, Article V. As shown in the table below, a lot in the R-3 zoning district that is developed for a single-family dwelling has similar minimum requirements as a lot in the R-1AA zoning district, which is the 2nd to least dense district in the Single-Family Dwelling Districts category, and it has the same lot requirements as the R-1 zoning district, which is the most dense of the Single-Family Dwelling Districts category. Instead, the development standards established in Section 6-15, as they relate to townhome units, shall apply. To summarize, townhome developments: • Have zero (0) side building setbacks (these are internal building setbacks); • Must meet minimum front building setbacks from the property line and arterial roadway (as would a single-family detached dwelling) and provide a minimum 25-foot building perimeter setback (setback from all boundaries); and • Must provide recreational amenities. A traditional single-family detached development of up to nine (9) dwelling units would not be required to provide recreational amenities. Additionally, as this site is located along the Bluford Avenue Corridor, it will be required to provide landscaping consistent with and supportive of the South Bluford Avenue Streetscape Project. Actual land use, proposed land use and unique features of the subject property: Currently, the property is developed with a 3,779-square foot, 5-bedroom single-family residential structure that was built in 1910. It has been used or occupied as a boarding home and classified as “multi-family” by the Orange County Property Appraiser’s Office. The structure encroaches into the roadway right-of-way by approximately nine (9) feet and has two (2) driveway access points off of South Bluford Avenue. The applicant is requesting to amend the Comprehensive Plan Future Land Use Map for the subject property from LDR to HDR in order to develop a townhome subdivision with seven (7) single-family residential attached (townhome) units and provide the needed infrastructure to support those units. With a property size of 0.78 acres, the HDR designation would be needed, and the proposed 7-unit townhome subdivision results in a density of 9 dwelling units per acre. The property is surrounded on all sides by Low Density Residential future land use map designations, R-1AA zoning districts and single-family detached residential uses. The Planning and Zoning Commission Meeting Date January 11, 2022 Page 3 of 3 Consistency with the Comprehensive Plan and Special Overlay Districts: The subject property is located within the Downtown Redevelopment Area. The requested change from Low Density Residential to High Density Residential to develop a single-family attached townhome subdivision is consistent with the Future Land Use Element Policy 1.4 (to allow mixed and multi-uses in the Special Overlay Areas) and the Downtown Redevelopment Area goal (to provide various forms of residential uses) as this area is currently predominantly single-family detached dwelling units. Schools: Per School Concurrency Element Policy 1.3.5, a townhome unit falls under the School District’s definition for multi-family, for purposes of capacity, and is evaluated based on a student generator of .263 per unit. The impacts to school capacity based on maximum development potential (9 units net) would be 2.3 students and based on the proposed development (6 units net) would be 1.5 students. Per the Interlocal Agreement with the School District, residential developments that create an impact of ten (10) or fewer students are considered de minimis. Transportation: Currently, there is sufficient capacity along all segments of Bluford Avenue (from Old Winter Garden Road to Lakewood Avenue), to accommodate the increase in trips (both daily and PM Peak Hour) resulting from the net increase in the number of dwelling units. Utilities: Water and solid waste services are available to serve this site; however, development of the 7- unit townhome subdivision will require sewer connections. Utilities staff and the applicant have been in discussions and further evaluation will be conducted at time of preliminary subdivision plan. Staff supports the proposed Small-Scale Comprehensive Plan Future Land Use (FLU) Map Amendment from Low Density Residential (LDR) to High Density Residential (HDR) and Rezoning from Single-Family Dwelling District (R-1AA) to Multi-Family Dwelling District (R-3) for the subject property. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on Tuesday, January 4, 2022, to review the proposed Comprehensive Plan Amendment and Rezoning for the property located at 449 South Bluford Avenue, assigned parcel ID number 17-22-28-6144-04-056.
