A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A STATE HIGHWAY MAINTENANCE
MEMORANDUM OF AGREEMENT BETWEEN THE CITY
AND THE FLORIDA DEPARTMENT OF TRANSPORTATION
FOR THE MAINTENANCE OF STATE ROAD RIGHT-OF-
WAYS BY THE CITY; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. The City Commission of the City of Ocoee has the authority to adopt this
Resolution pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166,
Florida statutes.
SECTION 2. The Mayor and City Clerk are hereby authorized and directed to execute
the State Highway Maintenance Memorandum of Agreement, Contract No.: ASB34, between the
City and the Florida Department of Transportation, a copy of which is attached hereto and
incorporated by reference.
SECTION 3. Severability. If any section, subsection, sentence, clause, phrase or
portion of the Resolution is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the remaining portion hereto.
SECTION 4. Effective Date. This Resolution shall become effective immediately upon
passage and adoption.

WHEREAS,the Department and the Contractor heretofore on this 17th day of April . 2019

entered Into an Agreement whereby the Department retained the Contractor to perform routine maintenance to include
activities 451.4G1. 471.485.487. 4B4. 541.642`543. 545.4G4 and 54Oon various State Roads in the Cltypf Ocoee; and
WHEREAS,said Agreement has a renewal option which provides for o renewal if mutually agreed toby both parties
and subject bz the same terms and conditions nf the original Agreement
NOW,THEREFORE,this Agreement witnesseth that for and in consideration of the mutualbanofitsto flow each
to the other,the parties agree to a renewal of said original Agreement for a period beginning the I st day ofN1ay2D22and
ending the 3Oth day ofAphl,, 2O25ota cost of$0O.GOO.00.
All terms and conditions of said original Agreement shall remain inforce and effect for this renewal.
